"y) Small forestry producer (Pequeño productor forestal): owners of farms that develop annual projects for forest protection, forest management, reforestation, or regeneration, less than or equal to 50 hectares, or with projects in agroforestry systems less than or equal to 5,000 trees.

• z)Medium forestry producer (Mediano productor forestal): owners of farms that develop annual projects for forest protection, forest management, reforestation, or regeneration, greater than 50 hectares and less than or equal to 300 hectares, or with projects in agroforestry systems less than or equal to 10,000 trees."

The Minister of Environment and Energy shall annually establish for the National Forest Financing Fund the number of hectares to be financed per activity in the Payment for Environmental Services Program and the amount to be paid, based on the resources allocated in the National Budget and approved by the Office of the Comptroller General of the Republic for said fund, the National Conservation Policies, and the prioritization criteria defined by the National System of Conservation Areas and made official by the Executive Branch. For these purposes, the Minister of Environment and Energy shall proceed to issue a Ministerial Resolution establishing the aspects indicated in this article, which shall be published in the Official Gazette La Gaceta.

The procedures for executing the Payment for Environmental Services (Pago de Servicios Ambientales) shall be issued by the Board of Directors of the National Forest Financing Fund, under the guidelines duly established in this regulation.

The applications for entry into the Payment for Environmental Services Program for the forest protection activity, submitted each year, shall be scored according to the following valuation matrix, which is based on the prioritization criteria defined by the National System of Conservation Areas and made official by the Executive Branch, according to the following table:

• b)The National Forest Financing Fund shall contract farms with the highest score, that meet the requirements established in the Procedures Manual for the Payment for Environmental Services, published in the Official Gazette La Gaceta N° 46, of March 6, 2009, and its reforms, and/or until the approved budget is executed.
• c)In the case of equal scores, they shall be processed according to the order of submission of the applications.
• d)The National Forest Financing Fund shall make available the layers in digital format (shape file), for locating the farms that apply to the Payment for Environmental Services Program.

iii- The Regional Offices of the National Forest Financing Fund have up to sixty calendar days for the valuation of applications according to the scoring matrix established in the respective decree or resolution.

• e)Payment for Environmental Services (Pago por Servicios Ambientales) in Indigenous Territories.

i- The procedure for the application of the Payment for Environmental Services by the Integral Development Associations of the Indigenous Reserves shall be as indicated in the previous subsections; however, by virtue of the particular characteristics presented by those territories and their form of land tenure, the following regulations are established for access to the Program:

• a)In the event that the Indigenous Reserve does not have the respective cadastral map, the project may be processed using the survey boundary (derrotero), for which the National Forest Financing Fund shall use the information detailed in the decree creating the Reserve.
• b)When the application refers to a forest protection project in areas that have been the subject of Payment for Environmental Services in the last five years, the National Forest Financing Fund shall assume, when so requested by the cited Indigenous Associations, the preparation of the technical study and the annual monitoring of the submitted areas, through its professional staff; in accordance with the foregoing, these projects shall not require a forest management contract (contrato de regencia forestal). This exception shall only apply to applications submitted starting in the year 2016.
• c)To formalize the Payment for Environmental Services contract, it shall suffice for the National Forest Financing Fund personnel to verify that the definition of forest established in Forestry Law N° 7575 is met and to determine the area to be submitted. This applies to projects submitted starting in the year 2016. In the case that the areas have not had a Payment for Environmental Services contract previously, the exception of subsection b) above shall not apply, for which the presentation of the technical study and the respective management contract shall be required, in accordance with established procedures.
• d)The Payment for Environmental Services contracts signed by said Associations shall not be registered before the National Registry as an encumbrance (afectación) on the property.

II- The application for entry into the Payment for Environmental Services Program must be accompanied by a certified copy of the Minutes of the General Assembly of Members, in which the execution of the Payment for Environmental Services project is authorized. Said minutes must include the list of attendees and the Treasurer's report approved by the Assembly, reflecting the use made of the resources received by said Associations for the Payment for Environmental Services Program.

III- In the areas submitted to the Payment for Environmental Services Program on which the respective contracts have been signed, traditional activities may be carried out, including the establishment of subsistence agricultural crops as long as they do not exceed 2% of the area under contract, supervised by the personnel of the National Forest Financing Fund. The contract shall establish the conditions required to comply with this provision.

IV- Without exception, in all cases, the procedures for the application of the Payment for Environmental Services Program must be subscribed and signed by the president of the Integral Development Association of the Indigenous Reserve. The contracts signed with these Associations must establish obligations that allow for the public disclosure of financial management to all members of the Association.

V- The cited Associations may submit Payment for Environmental Services projects for a maximum of 1,000 hectares in forest protection and/or regeneration, and 350,000 trees in agroforestry systems per year. In reforestation projects, a maximum of 300 hectares per year.

• f)Maximum Area Limits for PSA Projects.

Under no circumstances may natural persons and their family group, understood as wife or husband, sons and daughters, legal entities and their related companies operating as an economic interest group, maintain more than 600 hectares under contract in the forest protection modality and 750 hectares under contract in the reforestation modality under the Payment for Environmental Services Program. This provision shall govern only for contracts formalized starting in the year 2016."

"The National Forest Financing Fund may grant up to twenty-five percent of the total annual hectares available, for forest protection, reforestation, and agroforestry systems to organizations duly accredited according to the stipulations established herein. These projects shall be processed individually and the respective payments shall be disbursed by the National Forest Financing Fund directly to the organization, which in turn, having deducted the amount agreed upon for the technical advisory, management, and project monitoring services, shall deliver the difference to the producer. The forest protection projects presented by the organizations must be located in one of the first three priority criteria of the valuation matrix of this regulation."

"The Board of Directors shall issue the credit regulations, the conditions for regulating interest rates, the maximum terms, the requirements, and any other necessary to fulfill its functions; likewise, it is empowered to establish the procedures for the execution of the Payment for Environmental Services in accordance with the provisions of Law 7575 and this regulation.

Within the Board of Directors and for two-year periods, a President, Secretary, Treasurer, and two members shall be appointed. The Presidency shall correspond to the representative of the Ministry of Environment and Energy. Likewise, each of the members of the Board of Directors may have an alternate who shall be appointed by the respective competent body, and may be present only when the principal does not attend, for which the principal must give notice at least five days in advance so that the alternate may be convened. Only in this latter scenario shall the alternate have the right to voice and vote."

The functions of FONAFIFO's Board of Directors, in addition to those stipulated in the Law, shall be the following:

• a)Resolve on the credit applications submitted to it.
• b)Approve the Credit Regulation as well as establish the Payment for Environmental Services procedures, in accordance with the provisions of Forestry Law N° 7575 and its regulation.
• c)Supervise and evaluate the actions of the National Forest Financing Fund.
• d)Authorize the contracting of personnel and professional services for the execution and control of the operations it carries out.
• e)Authorize the issuance and/or commercialization of certificates or other contracting mechanisms, for the environmental services established in subsection k of article three of Forestry Law number 7575, provided by forests and forest plantations, from owners and possessors who have transferred these rights to FONAFIFO.
• f)Authorize the issuance of bonds and other securities.

Articles 2.5, 7, 8, 9, 10, 11, 12, and 13 of Executive Decree N° 39083-MINAE of July 24, two thousand fifteen, published in La Gaceta, Supplement N° 143, shall maintain their validity indefinitely for Payment for Environmental Services projects submitted for the year 2016 and following.

Issued at the Presidency of the Republic. - San José, on July 14, two thousand sixteen.

"y) Pequeño productor forestal: dueños de fincas que desarrollan proyectos anuales de protección de bosque, manejo de bosque, reforestación o regeneración, menores o iguales a 50 hectáreas, o con proyectos en sistemas agroforestales menores o iguales a 5.000 árboles.

• z)Mediano productor forestal: dueños de fincas que desarrollan proyectos anuales de protección de bosque, manejo de bosque, reforestación o regeneración, mayores a 50 hectáreas y menores o iguales a 300 hectáreas, o con proyectos en sistemas agroforestales menores o iguales a 10.000 árboles".

El Ministro de Ambiente y Energía le establecerá anualmente al Fondo Nacional de Financiamiento Forestal la cantidad de hectáreas a financiar por actividad en el Programa de Pago por Servicios Ambientales y el monto a pagar, con base en los recursos asignados en el Presupuesto Nacional y aprobados por la Contraloría General de la República al citado fondo, las Políticas Nacionales de Conservación y los criterios de priorización definidos por el Sistema Nacional de Áreas de Conservación y oficializados por el Poder Ejecutivo. Para esos efectos, el Ministro de Ambiente y Energía procederá a emitir una Resolución Ministerial donde disponga los aspectos señalados en este artículo, la cual será publicada en el Diario Oficial la Gaceta.

Los procedimientos para ejecutar el Pago de Servicios Ambientales serán emitidos por la Junta Directiva del Fondo Nacional de Financiamiento Forestal, bajo los lineamientos debidamente establecidos en este reglamento.

Las solicitudes de ingreso al Programa de Pago por Servicios Ambientales para la actividad de protección de bosque, presentadas cada año, serán calificadas de acuerdo con la siguiente matriz de valoración, la cual se basa en los criterios de priorización definidos por el Sistema Nacional de Áreas de Conservación y oficializados por el Poder Ejecutivo según el siguiente cuadro:

Estos puntos sólo aplican si el área de la finca es igual o menor de 50 hectáreas. | 25 adicionales | | IV | j) Bosques en cualquiera de las prioridades a, b, e, d, e y f, con solicitud de ingreso al Programa de Pago por Servicios Ambientales que tengan menosde 100 hectáreas de folio real y un área de PSA propuesta de 50 Hectáreas máximo, para proyectos de Protección de Bosque tramitados por organizaciones con convenio vigente con el Fondo Nacional de Financiamiento Forestal, que no estén incluidas en el inciso anterior. | 10 adicionales | a) La puntuación de los criterios 1, 2, 3 y 4 serán excluyente entre sí.

• b)El Fondo Nacional de Financiamiento Forestal contratará las fincas con la calificación más alta, que cumplan con los requisitos establecidos en el Manual de Procedimientos para el Pago por Servicios Ambientales, publicado en el Diario Oficial La Gaceta N° 46, del día 6 de marzo del 2009 y sus reformas, y/o hasta ejecutar el presupuesto aprobado.
• c)En caso de calificaciones iguales se tramitarán según el orden de presentación de las solicitudes.
• d)El Fondo Nacional de Financiamiento Forestal pondrá a disposición las capas en formato digital (shape file), para ubicar las fincas que apliquen al Programa de Pago por Servicios Ambientales.

iii- Las Oficinas Regionales del Fondo Nacional de Financiamiento Forestal disponen de hasta sesenta días naturales para la valoración de las solicitudes de acuerdo a la matriz de calificación establecida en el decreto o resolución respectiva.

• e)Del Pago por Servicios Ambientales en Territorios Indígenas.

i- El trámite para la aplicación del Pago por Servicios Ambientales por parte de las Asociaciones de Desarrollo Integral de las Reservas Indígenas, será el indicado en los incisos anteriores; no obstante, en virtud de las características particulares que presentan esos territorios y su forma de tenencia de la tierra, se establecen las siguientes regulaciones para el acceso al Programa:

• a)En caso que la Reserva Indígena no cuente con el respectivo plano catastrado, se podrá dar trámite al proyecto utilizando el derrotero para lo cual, el Fondo Nacional de Financiamiento Forestal utilizará la información que se detalla en el decreto de creación de la Reserva.
• b)Cuando la solicitud se refiera a un proyecto de protección de bosque en áreas que hayan sido objeto de Pago por Servicios Ambientales en los últimos cinco años, el Fondo Nacional de Financiamiento Forestal asumirá cuando así lo soliciten las Asociaciones Indígenas citadas, la elaboración del estudio técnico y el seguimiento anual de las áreas sometidas, mediante su personal profesional; de acuerdo con lo anterior estos proyectos no requerirán un contrato de regencia forestal. Esta excepción solo se aplicará para solicitudes presentadas a partir del año 2016.
• c)Para formalizar el contrato de Pago por Servicios Ambientales bastará con que el personal del Fondo Nacional de Financiamiento Forestal verifique que se cumple con la definición de bosque establecido en la Ley Forestal N° 7575 y determine el área a someter. Esto para los proyectos presentados a partir del año 2016. En el caso de que las áreas no hayan tenido contrato de Pago por Servicios Ambientales anteriormente, no aplicará la excepción del inciso b) anterior, para locual se requerirá la presentación del estudio técnico y el contrato de la regencia respectiva, de acuerdo a los procedimientos establecidos.
• d)Los contratos de Pago por Servicios Ambientales suscritos por dichas Asociaciones no serán inscritos ante el Registro Nacional como una afectación al inmueble.

II- La solicitud de ingreso al Programa de Pago por Servicios Ambientales deberá ir acompañada de una copia certificada del Acta de Asamblea General de Asociados, en la que se autoriza la ejecución del proyecto de Pago por Servicios Ambientales. Dicha acta deberá incluir la lista de los asistentes a la misma y el informe del Tesorero aprobado por la Asamblea, en el que se refleje el uso dado a los recursos recibidos por dichas Asociaciones por concepto del Programa de Pago por Servicios Ambientales.

III- En las áreas sometidas al Programa de Pago de Servicios Ambiental sobre las que se hayan suscrito los respectivos contratos, podrán realizar las actividades tradicionales, incluido el establecimiento de cultivos agrícolas de subsistencia en tanto no superen el 2% del área bajo contrato, supervisados por el personal del Fondo Nacional de Financiamiento Forestal. El contrato establecerá las condiciones requeridas para cumplir con esta disposición.

IV- Sin excepción, en todos los casos, los trámites para la aplicación del Programa de Pago por Servicios Ambientales deberán ser suscritos y firmados por el presidente de la Asociación de Desarrollo Integral de la Reserva Indígena. Los contratos suscritos con estas Asociaciones deberán establecer obligaciones que permitan publicitar la gestión financiera a todos los miembros de la Asociación.

V- Las citadas Asociaciones podrán presentar proyectos de Pago por Servicios Ambientales hasta por un máximo de 1.000 hectáreas en protección de bosque y/o regeneración, y de 350.000 árboles en sistemas agroforestales por año. En proyectos de reforestación un máximo de 300 hectáreas por año.

• f)Límites Máximos de Área a los Proyectos de PSA.

En ningún caso las personas fisicas y su grupo familiar entendido este como esposa o esposo, hijos e hijas, las personas jurídicas y sus empresas relacionadas operando como un grupo de interés económico, podrán mantener vigentes más de 600 hectáreas bajo contrato en la modalidad de protección de bosque y 750 hectáreas bajo contrato en la modalidad de reforestación bajo el Programa de Pago por Servicios Ambientales. Esta disposición regirá únicamente para contratos formalizados a partir del año 2016".

"El Fondo Nacional de Financiamiento Forestal podrá otorgar hasta un veinticinco por ciento del total de hectáreas anuales disponibles, para protección del bosque, reforestación y sistemas agroforestales a las organizaciones debidamente acreditadas según las estipulaciones aquí establecidas Estos proyectos serán tramitados de forma individual y los pagos respectivos serán girados por el Fondo Nacional de Financiamiento Forestal directamente a la organización, quién a su vez deducido el monto acordado por los servicios de asesoría técnica, regencia y seguimiento del proyecto, entregará la diferencia al productor. Los proyectos de protección de bosque que presenten las organizaciones, deberán estar ubicados en alguno de los primeros tres criterios de prioridad de la matriz de valoración de este reglamento".

"La Junta Directiva emitirá los reglamentos de crédito, las condiciones para la regulación de las tasas de interés, los plazos máximos, los requisitos y cualquier otro necesario para cumplir con sus funciones, de igual forma se faculta para que establezcan los procedimientos para la ejecución del Pago por Servicios Ambientales de acuerdo con lo establecido en la ley 7575 y este reglamento.

Dentro del seno de la Junta Directiva y por períodos de dos años, se nombrarán Presidente, Secretario, Tesorero y dos vocales. La Presidencia corresponderá al representante del Ministerio de Ambiente y Energía. Asimismo, cada uno de los miembros de la Junta Directiva, podrá tener un suplente que será nombrado por el órgano competente respectivo, y podrán estar presentes únicamente cuando el titular no asista, para ello deberá notificarlo con al menos cinco días de anticipación para que se convoque al suplente. Sólo en este último supuesto, el suplente tendrá derecho a voz y a voto".

Serán funciones de la Junta Directiva de FONAFIFO, además de las estipuladas en la Ley, las siguientes:

• a)Resolver sobre las solicitudes de crédito que le sean presentadas.
• b)Aprobar el Reglamento de Crédito así como establecer los procedimientos de Pago de Servicios Ambientales, de acuerdo con lo establecido en la Ley Forestal N°7575 y su reglamento.
• c)Supervisar y evaluar las actuaciones del Fondo Nacional de Financiamiento Forestal.
• d)Autorizar la contratación de personal y servicios profesionales para la ejecución y control de las operaciones que realice.
• e)Autorizar la emisión y/o comercialización de certificados u otros mecanismos de contratación, de los servicios ambientales establecidos en el inciso k del artículo tres de la Ley Forestal número 7575, brindados por los bosques y plantaciones forestales, de propietarios y poseedores que hayan cedido estos derechos al FONAFIFO.
• f)Autorizar la emisión de bonos y otros títulos valores.

Los artículos 2.5, 7, 8, 9, 10, 11, 12, y 13 del Decreto Ejecutivo N° 39083-MINAE del veinticuatro de julio de dos mil quince, publicado La Gaceta, Alcance N° 143, mantendrán su vigencia indefinidamente para los proyectos de Pago por Servicios Ambientales presentados para el año 2016 y siguientes.
