across the entire text - Full Text of Norm 157 Establishes general regulations for the granting of temporary substitution permits for vessels of the national fishing fleet for commercial purposes Full Text of Record: 10ECFF COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/157-2016.—Puntarenas, on the twenty-seventh day of April, two thousand sixteen.

1.—That in accordance with the provisions set forth in Law 7384 of March 16, 1994, published in the Official Gazette La Gaceta No. 62 of March 29, 1994, INCOPESCA has the legal competence and authority to regulate matters concerning the use, exploitation, and marketing of fishery resources, the granting of fishing permits, vessel construction, and inactivity permits.

2.—That under this legal authority, various agreements were adopted regulating the granting of inactivity permits, as a policy to guarantee adequate and rational exploitation of fishery resources and optimal performance of fishing activities.

3.—That in order to achieve greater and better application and understanding of the existing legal provisions regarding the temporary substitution of vessels, it has been deemed appropriate and convenient to consolidate them into a single legal provision; the Board Members deem it necessary to clearly establish the operative regulations regarding temporary vessel substitutions, for which reason, the Board of Directors. Therefore,

To establish the General Regulations for the granting of temporary substitution permits for vessels of the national fishing fleet for commercial purposes in accordance with the following provisions:

• 1)The administration of the Institute, through the Head of the Protection and Registration Department, the Regional Directors, the Heads of Regional Offices, and the Heads of Auxiliary Offices, may authorize, in exceptional cases, the temporary substitution of vessels engaged in fishing for commercial purposes, provided that it is proven before said authorities that the vessel is indeed not in suitable condition to carry out the fishing activity. The foregoing must be accredited in writing and retained in the respective file (expediente).
• 2)The term granted for the temporary substitution shall be one calendar year counting from the date of issuance of the respective authorization by the aforementioned authorities. Upon expiration of the indicated term, the temporary substitution permit shall expire by operation of law and under no circumstances may it be revalidated.
• 3)The temporary substitution shall be governed by the same terms and conditions regarding compliance with the requirements and procedures established in Agreement AJDIP/238-2002.
• 4)The cost of the temporary substitution permit shall be that established in the Institute's Tariff Regulations for the commercial fishing license held by the vessel subject to the temporary substitution.
• 5)Agreements AJDIP-132-99, AJDIP-064-2003, AJDIP/380-2004, AJDIP/534-2004, and AJDIP/109-2005, as well as any other legal provision of equal or lower rank that opposes it, are hereby repealed.

1. 1Que de conformidad con las disposiciones establecidas en la Ley 7384 del 16 de marzo de 1994, publicada en el Diario Oficial La Gaceta Nº 62 del 29 de marzo de 1994, el INCOPESCA tiene competencia y facultad legal para normar lo concerniente al aprovechamiento, explotación y comercialización de los recursos pesqueros, el otorgamiento de los permisos de pesca, construcción de embarcaciones, permisos de inactividad.
2. 2Que al amparo de esa potestad legal se adoptaron diversos acuerdos que regulan el otorgamiento de permisos de inactividad, como política para garantizar una adecuada y racional explotación de los recursos pesqueros y un óptimo rendimiento de las actividades pesqueras.
3. 3Que a efecto de lograr una mayor y mejor aplicación y comprensión de las disposiciones legales existentes en materia de sustitución temporal de embarcaciones, se ha estimado oportuno y conveniente integrarlas en una única disposición legal, estiman los Sres. Directivos la necesidad de establecer con claridad la normativa operante en relación con las sustituciones temporales de embarcaciones, razón por la cual, la Junta Directiva. Por tanto,

ACUERDA:

Establecer las Regulaciones Generales para el otorgamiento de permisos de sustitución temporal de embarcaciones a embarcaciones de la flota pesquera nacional con fines comerciales de conformidad con las siguientes disposiciones:

• 1)La administración del Instituto, por medio del Jefe del Departamento de Protección y Registro, los Directores Regionales, los Jefes de Oficinas Regionales y Jefes de Oficinas Auxiliares, podrá autorizar en casos excepcionales, la sustitución temporal de embarcaciones dedicadas a la pesca con fines comerciales, siempre y cuando se compruebe ante dichas instancias que efectivamente la embarcación no se encuentra en condiciones aptas para realizar la actividad de pesca. Lo anterior deberá acreditarse por escrito y constar en el 2) El plazo otorgado para la sustitución temporal, será de un año calendario contado a partir de la fecha de emisión de la autorización respectiva, por parte de las instancias mencionadas. Vencido el plazo señalado, el permiso de sustitución temporal caducará de pleno derecho y bajo ninguna circunstancia podrá ser revalidado.
• 3)La sustitución temporal se regirá por los mismos términos y condiciones en cuanto al cumplimiento de los requerimientos y procedimientos de lo establecido en el Acuerdo AJDIP/238-2002.
• 4)El costo del permiso de sustitución temporal será el establecido en el Reglamento de Tarifas del Instituto para la licencia de pesca comercial que posee la embarcación objeto de la sustitución temporal.
• 5)Se dejan sin efecto los Acuerdos AJDIP-132-99, AJDIP-064-2003, AJDIP/380-2004, AJDIP/534-2004 y AJDIP/109-2005, así como cualquier otra disposición legal de igual o menor rango que se le oponga.
• 6)Acuerdo Firme
