I.—That in Official Gazette La Gaceta No. 245 of December 19, 2014, Executive Decree No. 38768-MP-MINAE-MEP-MOPT-C-MIDEPLAN-MIVAH-MAG-S-MEIC, called "Establishment of the High-Level Commission for the Development Program for the Río Grande de Térraba Basin", was published.
II.—That the High-Level Commission for the Development Program for the Río Grande de Térraba Basin, created by the Decree mentioned in the previous Considering, has the objective of coordinating and supporting the execution of the "Development Program for the Río Grande de Térraba Basin".
III.—That in Official Gazette La Gaceta No. 41 of February 29, 2016, Executive Decree No. 39453-MP-PLAN, called "Reglamento de Organización y Funcionamiento de los Consejos Regionales de Desarrollo", was published.
IV.—That the purpose of the Decree mentioned in the previous Considering is to regulate the Regional Development Councils (Consejos Regionales de Desarrollo), created through Executive Decree No. 37735-PLAN of May 6, 2013, which allow for defining actions to promote regional, territorial, and cantonal development, together with citizen participation.
V.—That, furthermore, these Regional Development Councils are oriented toward the fulfillment of the Regional Development Plan and what is defined in their annual plans, according to the regionalization established in current regulations.
VI.—That since the Río Grande de Térraba Basin belongs to the Brunca Region, the functions of the High-Level Commission for the Development Program for the Río Grande de Térraba Basin are encompassed together with those indicated for the Regional Development Council of that Region.
VII.—That, in view of the foregoing, it follows that there is a duplication of functions, according to what is established in both legal instruments.
VIII.—That efficiency is one of the fundamental principles of public service, therefore, it must be present in every act or manifestation of the Public Administration.
IX.—That for the benefit of the efficiency of the Public Administration and the other principles of public service, the repeal of the Executive Decree mentioned in Considering I of this section is necessary. I.-Que en el Diario Oficial La Gaceta N° 245 del 19 de diciembre del 2014, fue publicado el Decreto Ejecutivo N° 38768-MP-MINAE-MEP-MOPT-C-MIDEPLAN-MIVAH- MAG-S-MEIC, denominado "Constitución de la Comisión de Alto Nivel para el Programa de Desarrollo de la Cuenca del Río Grande de Térraba".
II.-Que la Comisión de Alto Nivel para el Programa de Desarrollo de la Cuenca del Río Grande de Térraba, creada por el Decreto mencionado en el Considerando anterior, tiene como objetivo coordinar y apoyar la ejecución del "Programa de Desarrollo de la Cuenca Río Grande de Térraba".
III.-Que en el Diario Oficial La Gaceta N° 41 del 29 de febrero del 2016, fue publicado el Decreto Ejecutivo N° 39453-MP-PLAN, denominado "Reglamento de Organización y Funcionamiento de los Consejos Regionales de Desarrollo".
IV.-Que el fin del Decreto mencionado en el Considerando anterior se dirige a regular los Consejos Regionales de Desarrollo, creados mediante el Decreto Ejecutivo N° 37735-PLAN del 6 de mayo de 2013, los cuales permiten definir acciones para promover el desarrollo regional, territorial y cantonal, en conjunto con la participación ciudadana.
V.-Que, además, estos Consejos Regionales de Desarrollo se orientan al cumplimiento del Plan Regional de Desarrollo ya lo definido en sus planes anuales, según la regionalización establecida en la normativa vigente.
VI.-Que perteneciendo la Cuenca del Río Grande de Térraba a la Región Brunca, las funciones de la Comisión de Alto Nivel para Programa de Desarrollo de la Cuenca del Río Grande de Térraba, se engloban junto con las indicadas para el Consejo Regional de Desarrollo de esa Región.
VII.-Que, frente a lo anterior, se desprende la existencia de una duplicidad de funciones, según lo establecido en ambos instrumentos jurídicos.
