en la totalidad del texto - Complete Text of Norm 39538 Declares the Brunca Region of the Republic of Costa Rica as a zone of low prevalence of Bovine Brucellosis and Tuberculosis and reforms the General Regulation for the Granting of the Veterinary Operation Certificate Complete Text record: 10C5E0 No. 39538-MAG-MSP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF AGRICULTURE AND LIVESTOCK AND THE MINISTER OF PUBLIC SECURITY In exercise of the powers conferred by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of the Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 8495 of April 6, 2006, General Law of the National Animal Health Service and the General Police Law No. 7410 of May 26, 1994.

Considering:

8495 of April 6, 2006, called the General Law of the National Animal Health Service, it is the responsibility of the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA), among other competencies, ".to administer, plan, direct and take pertinent measures in the entire country, to fulfill its services, programs and campaigns, in matters of prevention, control and eradication of pests and diseases of animals.".

34669-MAG of July 8, 2008, published in La Gaceta No. 156 of August 13, 2008, which lists the animal diseases of mandatory declaration.

34858-MAG of October 20, 2008, Regulation for the Intervention of Bovine Brucellosis, establishes regulations for the control of Bovine Brucellosis, under the consideration that it is a zoonotic disease and of importance for public health and from which it is necessary to repeal subsection h) of article 8 and the Second Transitory Provision thereof, for the purposes of facilitating the formalization of processes for the declaration of Brucellosis-Free Herds at the national level and in particular in the Brunca Region.

THEY DECREE:

Declaration of the Brunca Region of the Republic of Costa Rica as a zone of low prevalence of bovine brucellosis and tuberculosis and repeal of subsection h) of article 8 and the Second Transitory Provision of Decree No. 34858 -MAG of October 20, 2008, Regulation for the Intervention of Bovine Brucellosis.

Therefore,

the destination of the animals without requiring the diagnostic tests and identification devices indicated in the previous article.

The entry of these animals may only be carried out in means of transport that have been sealed and that this has been recorded in the sanitary guide issued.

Likewise, the introduction of buffalo cattle (buffalo (género Bubalus)) into the Brunca Region is prohibited.

For these purposes, the officers of the Public Force of the Ministry of Public Security shall provide aid and collaboration to the authorities of SENASA, carrying out a physical inspection of the animals and verifying, at the control posts strategically located on the access roads to the Brunca Region, the following aspects:

a)Official Guide for the Mobilization of Bovine Cattle duly issued in accordance with the regulations established in Executive Decree No. 37918, "Regulation to the Law for the Control of Bovine Cattle, Prevention and Punishment of its Robbery, Theft and Receiving".
b)Sanitary guide for the mobilization of cattle issued by the Cantonal Office of SENASA closest to the farm of origin.
c)That the bovines carry the individual identification devices assigned by SENASA.
d)That the means of transport are duly sealed when dealing with animals whose immediate destination is the slaughterhouse.

Considerando:

Declaratoria de la Región Brunca de la República de Costa Rica como zona de baja prevalencia de brucelosis y tuberculosis bovina y derogatoria del inciso h) del artículo 8 y

para la Intervención de la Brucelosis Bovina.

Por tanto,

DECRETAN:

Transitorio Segundo del Decreto Nº 34858 -MAG del 20 de octubre del 2008, Reglamento

razón del destino de los animales sin que se requiera de las pruebas diagnósticas y dispositivos de identificación indicados en el artículo anterior.

El ingreso de estos animales solo podrá realizarse en medios de transporte que hayan sido marchamados y así se haya hecho constar en la guía sanitaria emitida.

Igualmente se prohíbe la introducción de ganado bufalino (género Bubalus) a la Región Brunca.

Para dichos efectos, los oficiales de la Fuerza Pública del Ministerio de Seguridad Pública prestarán auxilio y colaboración a las autoridades del SENASA, realizando inspección física de los animales y verificando, en los puestos de control ubicados estratégicamente sobre las vías de acceso a la Región Brunca, los siguientes aspectos:

a)Guía Oficial de Movilización de Ganado Bovino debidamente emitida conforme a las regulaciones establecidas en el Decreto Ejecutivo N° 37918, "Reglamento a la Ley de Control de Ganado Bovino, Prevención y Sanción de su robo, hurto y receptación".
b)Guía sanitaria de movilización de ganado emitida por la Oficina Cantonal del SENASA más cercana a la finca de origen.
c)Que los bovinos porten los dispositivos de identificación individual asignados por el SENASA.
d)Que los medios de transporte se encuentren debidamente marchamados cuando se trate de animales cuyo destino inmediato es matadero.

Artículo 1 — - That in accordance with article 6, subsection a) of Law No.

Artículo 2 — - That brucellosis and tuberculosis are diseases of mandatory declaration within the Costa Rican territory, as established by Executive Decree No.

Artículo 4 — - That in the brucellosis prevalence study carried out from September to December of the year 2012, it turned out that in the Brunca Region, of 109 herds sampled, only one tested positive, which represents a herd prevalence of 1.5% and an individual prevalence of 0.13%.

Artículo 6 — - That buffalo cattle (buffalo (género Bubalus)) constitute a risk factor for the spread of brucellosis in bovines since there are no validated diagnostic tests to rule out or confirm that said animals are carriers of the indicated disease.

Artículo 8 — - That Decree No.

Artículo 9 — - That having completed the Cost-Benefit Evaluation Form, which, based on section I called Prior Control of Regulatory Improvement, yielded a negative result, the present Regulation does not contain procedures or requirements for the administered parties.

Artículo 2 — Vaccination against brucellosis in the Brunca Region is prohibited.

Artículo 4 — The entry of bovines destined for immediate slaughter in any authorized establishment within the Brunca Region is authorized, with a sanitary guide, which will be issued based on

Artículo 5 — The entry into the Brunca Region of animals for slaughter that have tested positive for brucellosis or tuberculosis and are being selectively eliminated as part of a sanitation program is prohibited.

Artículo 6 — - Que el ganado bufalino (género Bubalus) constituye un factor de riesgo para la propagación de la brucelosis en bovinos toda vez que no se cuenta con pruebas diagnósticas validadas para descartar o confirmar que dichos animales son portadores de la enfermedad indicada.

Artículo 9 — - Que habiéndose llenado el Formulario de Evaluación Costo Beneficio, el cual, con base en la sección I denominada Control Previo de Mejora Regulatoria, arrojó un resultado negativo, se tiene que el presente Reglamento no contiene trámites ni requisitos para los administrados.

Artículo 2 — Se prohíbe la vacunación contra brucelosis en la Región Brunca.

Artículo 4 — Se autoriza el ingreso de bovinos destinados para el sacrificio inmediato en algún establecimiento autorizado dentro de la Región Brunca, con guía sanitaria, que se emitirá en

Artículo 5 — Será prohibido el ingreso a la Región Brunca de animales para sacrificio que hayan resultado positivos a brucelosis o tuberculosis y se estén eliminando selectivamente como parte de un programa de saneamiento.

Artículo 6 — El ingreso de bovinos a la Región Brunca deberá ser controlado.

Artículo 7 — En aras de cumplir con el principio de transparencia que impera en el comercio internacional, notifíquese, para los efectos que corresponda, a la Organización Mundial del Comercio (OMC) y a la Organización Mundial de Sanidad Animal (OIE).

Artículo 8 — Deróguese el inciso h) del artículo 8 y Transitorio Segundo del Decreto Nº 34858-MAG del 20 de octubre del 2008, Reglamento para la Intervención de la Brucelosis Bovina.

Artículo 9 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
