FIRST DIVISION - FULL TEXT of Regulation 39596 Declares of Public Utility for the interests of the State the Association Pro Sostenibilidad de parques Nacionales de las Siete Provincias PROPARQUES Full Text acta: 10C47F No. 39596-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations number 218 of August 8, 1939, and articles 27 and following of the Regulation to the Law of Associations number 29496-J, published in La Gaceta number 96 of May 21, 2001.
I.That article 32 of the Law of Associations number 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of Public Utility those simple, federated, or confederated Associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.That the ASOCIACIÓN PRO SOSTENIBILIDAD DE PARQUES NACIONALES DE LAS SIETE PROVINCIAS PROPARQUES was registered in the Registry of Associations of the Public Registry on July 5, 2006, in volume No. 567, entry 20388.
III.That the purposes pursued by the Association, according to its bylaws, are: "(…) ARTICLE THREE A) Establishment of a common forum among both national and foreign participants in the activity of national parks, reserves, and protected areas to unify policies and create links of cooperation and strengthening of the conservation and sustainability sector of national parks. B) Create a system for the academic education regarding parks, reserves, and protected areas, fostering public interest and knowledge in the sustainability and conservation of parks. C) Professionalization of the Park Ranger. D) Improve the financing structure, by means of a ticket-pass to national parks, which can be obtained via the Internet, upon arrival in the country, or at national or international tourism agencies, for use during the stay of the international tourist in our country or of the national tourist. E) Open the possibility of annual memberships and permanent fundraising, seeking national and international donors. F) Urge the creation of Regional and honorary Boards formed by volunteers in the protection areas" (Folio 52).
IV.That such purposes solve a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore,

l. Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.Que la ASOCIACIÓN PRO SOSTENIBILIDAD DE PARQUES NACIONALES DE LAS SIETE PROVINCIAS PROPARQUES, se inscribió en el Registro de Asociaciones del Registro Público desde el día 5 de julio de 2006, bajo el tomo No. 567, asiento 20388.
III.Que los fines que persigue la Asociación, según sus estatutos, son: "(. ..) ARTÍCULO TERCERO A) Establecimiento de un foro común entre los participantes tanto nacionales como extranjeros de la actividad de parques nacionales, reservas, y áreas protegidas para unificar políticas y crear vínculos de cooperación y fortalecimiento del sector de la conservación y sostenibilidad de parques nacionales. B) Crear un sistema para la enseñanza académica de los parques, reservas y áreas protegidas fomentando el interés y conocimiento público en la sostenibilidad y conservación de los parques. C) Profesionalización del Guarda Parque. D) Mejorar la estructura de financiamiento, mediante un talonario-pase a parques nacionales, el cual se pueda obtener vía Internet, al arribo al país o en agencias de turismo nacional o internacional, para el uso durante la estadía del turista internacional en nuestro país o del turista nacional E) Abrir la posibilidad de membresías anuales y recaudación permanente de fondos, buscando donantes nacionales e internacionales. F) Instar la creación de Juntas Regionales y ad honores formadas por voluntarios en las áreas de protección" (Folio 52).
IV.Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
