1That in accordance with the provisions of Law Nº 7064 of April 29, 1987, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, the Minister of said Portfolio is the Rector of the Costa Rican Agricultural Sector, of which fishing forms part as a subsector.
2That Costa Rica is an integral member of the Inter-American Tropical Tuna Commission (Comisión Interamericana del Atún Tropical, CIAT), in whose forum and at the meetings of said Body, a maximum of four Official Commissioners, designated by the Executive Branch, must participate as representatives of the country.
3That Costa Rica has traditionally participated in the industrialization of tuna and fostered the development of said activity, in which the resolutions of the CIAT are of great importance, mainly due to the incidence on purse seine (de cerco) tuna catches that affect the availability of tuna as raw material for the industry, as well as the resolutions on catch closures (veda de captura) of the tuna resource in the Eastern Pacific Ocean (Océano Pacífico Oriental, OPO) and the restrictive actions on the operation of tuna vessels that impact and affect tuna landings (descargas) in our territory.
4That the Office of the Attorney General (Procuraduría General de la República) in its opinion C-407-2007 concluded forcefully that the designation of the official commissioners of Costa Rica before the Inter-American Tropical Tuna Commission corresponds to the Executive Branch.
5That it is official policy to maintain and exercise the optimal representation of the country in International Bodies, which guarantees the best defense of Costa Rica's interests, which must be maintained with respect to the country's participation in the Inter-American Tropical Tuna Commission.
6That the Cost-Benefit Evaluation Form, Section I, called Prior Control of Regulatory Improvement, was completed, the result of which was negative and the proposal does not contain procedures or requirements. Therefore;

A fourth Commissioner may be designated by the Minister of Agriculture and Livestock in consideration of the specialty of the subject matter to be addressed at the respective meetings and the strategic interests of the country. The headship of the Delegation shall be exercised in preferential order by the Minister of Agriculture and Livestock, the Executive President of INCOPESCA or the Commissioner who is designated as such by the Minister of Agriculture and Livestock, when requesting the issuance of Credentials from the Ministry of Foreign Affairs and Worship.

1Que de conformidad con lo dispuesto en la Ley Nº 7064 del 29 de abril de 1987, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, el Ministro de dicha Cartera, es el Rector del Sector Agropecuario Costarricense, del cual la pesca como subsector forma parte.
2Que Costa Rica es miembro integrante de la Comisión Interamericana del Atún Tropical (CIAT), en cuyo seno y en las reuniones de dicho Organismo, deben participar un máximo de cuatro Comisionados Oficiales, designados por el Poder Ejecutivo, como representantes del país.
3Que Costa Rica tradicionalmente ha participado en la industrialización del atún y fomentado el desarrollo de dicha actividad, en la cual las resoluciones de la CIAT, revisten gran importancia, principalmente por la incidencia en las capturas de atún de cerco que afectan la disponibilidad del atún como materia prima para la industria, así como las resoluciones de veda de captura del recurso atunero en el Océano Pacífico Oriental (OPO) y las acciones de restricción sobre la operación de barcos atuneros que repercuten y afectan las descargas de atún en nuestro territorio.
4Que la Procuraduría General de la República en su dictamen C-407-2007 concluyó en forma contundente que la designación de los comisionados oficiales de Costa Rica ante la Comisión Interamericana del Atún Tropical corresponde al Poder Ejecutivo.
5Que es política oficial el mantener y ejercer la óptima representación del país en los Organismos Internacionales, que garantice la mejor defensa de los intereses de Costa Rica, lo cual debe mantenerse respecto de la participación del país, en la Comisión Interamericana del Atún Tropical.
6Que se procedió a llenar el Formulario de Evaluación Costo Beneficio, Sección I, denominada Control Previo de Mejora Regulatoria, siendo que el mismo dio un resultado negativo y la propuesta no contiene trámites ni requisitos. Por tanto;

Artículo 3 — —Executive Decree Nº 35010-MAG, dated January 8, 2009, published in La Gaceta Nº 26 of February 6, 2009, is hereby repealed.

Artículo 4 — —It shall be effective as of its publication.

Artículo 3 — Deróguese el Decreto Ejecutivo Nº 35010- MAG, de fecha 8 de enero del año 2009, publicado en La Gaceta Nº 26 del 6 de febrero de 2009.

Artículo 4 — Rige a partir de su publicación.
