in the entirety of the text - Complete Text of Norm 35010 Designation of Permanent Official Commissioners to the Inter-American Tropical Tuna Commission (Comisión Interamericana del Atún Tropical, CIAT) Complete Text of record: 10BB46 Nº 35010-MAG (This executive decree was repealed by Article 3 of Executive Decree N° 39534 of January 20, 2016, "Designation of Permanent Official Commissioners to the Inter-American Tropical Tuna Commission (CIAT)") THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In accordance with the powers established in Articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution; Articles 25, 27 subsection 1, 28 subsection 2 b), of Law Nº 6227 of May 2, 1978, General Law of Public Administration; the Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production that incorporates the Organic Law of the Ministry of Agriculture and Livestock; and Law Nº 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura), published in La Gaceta Nº 62 on March 29, 1994.

1. 1That in accordance with the provisions of Law Nº 7064 of April 29, 1987, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, the Minister of said Portfolio is the Rector of the Costa Rican Agricultural Sector, of which fisheries, as a subsector, forms a part.
2. 2That Costa Rica is a member of the Inter-American Tropical Tuna Commission (CIAT), in whose forum and at the meetings of said Organization, a maximum of four Official Commissioners, designated by the Executive Branch, must participate as representatives of the country.
3. 3That Costa Rica has traditionally participated in the industrialization of tuna and promoted the development of said activity, in which the resolutions of the CIAT are of great importance, mainly due to the impact on purse seine tuna catches that affect the availability of tuna as raw material for the industry, as well as the resolutions on catch closures for the tuna resource in the Eastern Pacific Ocean (EPO) and the restrictive actions on the operation of tuna vessels that have repercussions and affect tuna landings in our territory.
4. 4That the Office of the Attorney General of the Republic (Procuraduría General de la República) in its opinion C-407-2007 conclusively determined that the designation of the official commissioners of Costa Rica to the Inter-American Tropical Tuna Commission corresponds to the Executive Branch.
5. 5That it is official policy to maintain and exercise the optimal representation of the country in International Organizations, which guarantees the best defense of Costa Rica's interests, which must be maintained with respect to the country's participation in the Inter-American Tropical Tuna Commission. Therefore,

THEY DECREE:

Considering:

en la totalidad del texto - Texto Completo Norma 35010 Designación de Comisionados Oficiales Permanentes ante la Comisión Interamericana del Atún Tropical (CIAT) Texto Completo acta: 10BB46 Nº 35010-MAG (Este decreto ejecutivo fue derogado por el artículo 3° del decreto ejecutivo N° 39534 del 20 de enero del 2016 "Designación de Comisionados Oficiales Permanentes ante la Comisión Interamericana del Atún Tropical (CIAT)") EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA De conformidad con las facultades establecidas en los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política; los artículos 25, 27 inciso 1, 28 inciso 2 b), de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública; la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería; y la Ley Nº 7384 del 16 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, publicada en La Gaceta Nº 62 el 29 de marzo de 1994.

1. 1Que de conformidad con lo dispuesto en la Ley Nº 7064 del 29 de abril de 1987, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, el Ministro de dicha Cartera, es el Rector del Sector Agropecuario Costarricense, del cual la pesca como subsector forma parte.
2. 2Que Costa Rica es miembro integrante de la Comisión Interamericana del Atún Tropical (CIAT), en cuyo seno y en las reuniones de dicho Organismo, deben participar un máximo de cuatro Comisionados Oficiales, designados por el Poder Ejecutivo, como representantes del país.
3. 3Que Costa Rica tradicionalmente ha participado en la industrialización del atún y fomentado el desarrollo de dicha actividad, en la cual las resoluciones de la CIAT, revisten gran importancia, principalmente por la incidencia en las capturas de atún de cerco que afectan la disponibilidad del atún como materia prima para la industria, así como las resoluciones de veda de captura del recurso atunero en el Océano Pacífico Oriental (OPO) y las acciones de restricción sobre la operación de barcos atuneros que repercuten y afectan las descargas de atún en nuestro territorio.
4. 4Que la Procuraduría General de la República en su dictamen C-407-2007 concluyó en forma contundente que la designación de los comisionados oficiales de Costa Rica ante la Comisión Interamericana del Atún Tropical corresponde al Poder Ejecutivo.
5. 5Que es política oficial el mantener y ejercer la óptima representación del país en los Organismos Internacionales, que garantice la mejor defensa de los intereses de Costa Rica, lo cual debe mantenerse respecto de la participación del país, en la Comisión Interamericana del Atún Tropical. Por tanto,
