1. 1That in accordance with Article 32 of the Organic Environmental Law, the Ministry of Environment and Energy is responsible for the administration of state Wild Protected Areas.
2. 2That Article 22 of the Biodiversity Law delegates to SINAC the authority to administer state-owned Wild Protected Areas, which establishes that the National System of Conservation Areas (SINAC) is a deconcentrated and participatory institutional management and coordination system, with instrumental legal personality that integrates competencies in forestry, wildlife, and protected areas matters and is attached to the Ministry of Environment and Energy, for the purpose of issuing policies, planning and executing processes aimed at achieving sustainability in the management of the natural resources of Costa Rica.
3. 3That Chirripó National Park is administered by the La Amistad Pacífico Conservation Area (ACLA-P), which was created by Law No. 5773, with an area of 43,700, and likewise expanded by Executive Decree No. 13496-A of March 31, 1982.
4. 4That the La Amistad Pacífico Conservation Area issued resolutions ACLA-P-D-193-2014 at 9:00 a.m. on May 21, 2014, published in La Gaceta No. 110 on Tuesday, June 10, 2014 and effective as of June 23, 2014, ACLA-P-D-02-2015 at 3:00 p.m. on January 6, 2015, published in La Gaceta No. 18 on Tuesday, January 27, 2015, and Resolution No. ACLA-P-D-434-2015 at 10:00 a.m. on September 29, 2015, published in La Gaceta No. 204 on Wednesday, October 21, 2015; in which the provisions for the reservation process of Chirripó National Park are established.
5. 1That for several years the Administration has anticipated the possibility of developing an online reservation platform, for which it contracted professional design services, which have already been presented and are in the process of review, training, and testing before the launch of the new system.
6. 2That it has been anticipated that by the beginning of 2016 the online reservation system may be implemented on an ongoing basis for user access.
7. 3That since the Administration of the National Park will migrate from the ordinary reservation system to the online reservation system for tourist entry to Chirripó National Park, it requires making the corresponding adjustments during the month of January 2016.
8. 4That all of the foregoing requires that the process provided for in Article 5, subsection b) of the Procedure described in Resolution ACLA-P-D-193-2014 be modified so that the second reservation period is carried out as follows:

• A)For the reservation process during the month of March 2016 for Chirripó National Park, the reservation period begins on Monday, January 4, 2016, by calling 905-Chirrip or 905-2447747 for all users nationwide and 506-2742-5348 for international users exclusively.
• B)For the reservation process during the months of April and May 2016 for Chirripó National Park, the reservation period begins on Monday, February 15, 2016, using the online system as will be stated in the corresponding resolution.

THE DIRECTOR OF THE LA AMISTAD PACÍFICO CONSERVATION AREA, RESOLVES 1º—To modify Article 5, subsection b) of the Procedure described in Resolution ACLA-P-D-193-2014 so that the second reservation period is carried out as follows:

• A)For the reservation process during the month of March 2016 for Chirripó National Park, the reservation period begins on Monday, January 4, 2016, by calling 905-Chirrip or 905-2447747 for all users nationwide and 506-2742-5348 for international users exclusively.
• B)For the reservation process during the months of April and May 2016 for Chirripó National Park, the reservation period begins on Monday, February 15, 2016, using the online system as will be stated in the corresponding resolution.

2º—In all other respects, the provisions established in resolutions ACLA-P-D-193-2014, ACLA-P-D-02-2015, and ACLA-P-D-434-2015 cited in the fourth Whereas clause of this resolution remain in effect.

3º—Against this resolution, the ordinary remedies of revocation and/or appeal are available, in accordance with Articles 343 and following of the General Public Administration Law, which shall be resolved, the revocation by the same body that issued it and the appeal by the National Council of Conservation Areas. The remedies must be filed before the body that issues this resolution within three days following its publication.

en la totalidad del texto - Texto Completo Norma 561 Reforma Resolución N° ACLA-P-D-193-2014 Establece el procedimiento para las reservaciones en el Parque Nacional Chirripó Texto Completo acta: 109499 SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Resolución Nº ACLA-P-D-561-2015.-Ministerio del Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Área de Conservación La Amistad Pacífico, San Isidro de El General, a las 11 horas del veintisiete de noviembre del dos mil quince.

1. 1Que de conformidad con el artículo 32 de la Ley Orgánica del Ambiente, al Ministerio del Ambiente y Energía le compete la administración de las Áreas Silvestres Protegidas estatales.
2. 2Que el artículo 22 de la Ley de Biodiversidad, delega en el SINAC la competencia de administrar las Áreas Silvestres Protegidas de carácter estatal, el cual establece que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, con personería jurídica instrumental que integra las competencias en materia forestal, vida silvestre, áreas protegidas y adscrito al Ministerio de Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
3. 3Que el Parque Nacional Chirripó es administrado por el Área de Conservación La Amistad Pacífico (ACLA-P), mismo que se creó mediante Ley N° 5773, con una superficie de 43.700, así mismo ampliado mediante Decreto Ejecutivo N° 13496-A del 31 de marzo de 1982.
4. 4Que el Área de Conservación La Amistad Pacífico dictó las resoluciones ACLA-P-D-193-2014 de las 9 horas del 21 de mayo del 2014, publicada en La Gaceta N° 110 del día martes 10 de junio del 2014 y vigente a partir del 23 de junio del 2014, ACLA-P-D-02-2015 de las 15:00 horas del 6 de enero del 2015, publicada en La Gaceta N° 18 del martes 27 de enero del 2015 y Resolución N° ACLA-P-D-434-2015 de las 10:00 horas del 29 de setiembre del 2015, publicada en La Gaceta N° 204 del miércoles 21 de octubre del 2015; en las que se establecen las disposiciones para el proceso de reservaciones del Parque Nacional Chirripó.
5. 1Que desde hace varios años la Administración previó la posibilidad de desarrollar una plataforma de reservaciones en línea, para lo cual contrató los servicios profesionales de diseño, que ya han sido presentados y se encuentran en proceso de revisión, capacitación y prueba antes de la puesta en marcha del nuevo sistema.
6. 2Que se ha previsto que para inicios del año 2016 el sistema de reservaciones en línea podrá ponerse en ejecución de manera constante para el acceso de los usuarios.
7. 3Que dado que la Administración del Parque Nacional migrará del sistema ordinario de reservaciones al sistema de reservaciones en línea para ingreso de turistas al Parque Nacional Chirripó, y requiere realizar los ajustes correspondientes durante el mes de enero del año 2016.
8. 4Que todo lo anterior requiere que el proceso previsto en el artículo 5 inciso b) del Procedimiento descrito en la Resolución ACLA-P-D-193-2014 sea modificado para que el segundo periodo de reservaciones se realice de la siguiente manera:

• A)Para el proceso de reservaciones durante el mes de marzo del año 2016 al Parque Nacional Chirripó, el periodo de reservaciones se inicia el lunes 4 de enero del 2016, llamando al número 905-Chirrip o bien 905-2447747 para todos los usuarios a nivel Nacional y al número 506-2742-5348 para los usuarios a nivel internacional exclusivamente.
• B)Para el proceso de reservaciones durante los meses de abril y mayo del año 2016 al Parque Nacional Chirripó, el periodo de reservaciones se inicia el lunes 15 de febrero del 2016 haciendo uso del sistema en línea conforme se dirá en la resolución correspondiente.

EL DIRECTOR DEL ÁREA DE CONSERVACIÓN LA AMISTAD PACÍFICO, RESUELVE text-indent:24.0pt'>1º-Modificar el artículo 5 inciso b) del Procedimiento descrito en la Resolución ACLA-P-D-193-2014 para que el segundo periodo de reservaciones se realice de la siguiente manera:

• A)Para el proceso de reservaciones durante el mes de marzo del año 2016 al Parque Nacional Chirripó, el periodo de reservaciones se inicia el lunes 4 de enero del 2016, llamando al número 905-Chirrip o bien 905-2447747 para todos los usuarios a nivel Nacional y al número 506-2742-5348 para los usuarios a nivel internacional exclusivamente.
• B)Para el proceso de reservaciones durante los meses de abril y mayo del año 2016 al Parque Nacional Chirripó, el periodo de reservaciones se inicia el lunes 15 de febrero del 2016 haciendo uso del sistema en línea conforme se dirá en la resolución correspondiente.

2º-En todo lo demás sigue vigente lo establecido en las resoluciones ACLA-P-D-193-2014, ACLA-P-D-02-2015 y ACLA-P-D-434-2015 citadas en el Resultando cuarto de esta resolución.

3º-Contra la presente resolución proceden los recursos ordinarios de revocatoria y/o apelación, de conformidad con los artículos 343 y siguientes de la Ley General de la Administración Pública, los cuales serán resueltos, el de revocatoria por el mismo órgano que lo dictó y el de apelación por el Consejo Nacional de Áreas de Conservación. Los recursos deberán interponerse ante el órgano que dicta ésta resolución dentro de los tres días posteriores a su publicación.
