in the entirety of the text - Complete Text of Norm 39228 Repeals Executive Decree No. 33867 "Declares of Public Utility for the interests of the State the Administrative Association of the Santa Teresa Cajón de Pérez Zeledón Aqueduct" Complete Text act: 1077FA No. 39228-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Law No. 218 of August 8, 1939, and articles 27 and following of the Regulation to the Associations Law No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.-That article 32 of the Associations Law No. 218 of August eighth, nineteen thirty-nine, and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need, as well as to revoke this benefit, if the reasons for which it was granted disappear.
II.-That because the Costa Rican Institute of Aqueducts and Sewers so ordered, the Rural Aqueduct Associations of the District of Cajón de Pérez Zeledón were required to merge.
III.-That the Administrative Association of the Santa Teresa Cajón de Pérez Zeledón Aqueduct, legal ID No. 3-002-238594, was declared of Public Utility by Executive Decree No. 33867-J, published in Official Gazette No. 144 of July 26, 2007, and is one of the Associations that was required to merge.
IV.-That all the Rural Aqueduct Associations of Cajón de Pérez Zeledón were required to merge, and they came into legal existence as the Administrative Association of the Aqueduct and Sanitary Sewer of the District of Cajón de Pérez Zeledón, legal ID No. 3-002-238594.
V.-That in accordance with article 13 of the Associations Law, the dissolution of the Association is appropriate when it is materially and legally impossible to continue operating as an Association.
VI.-That the Administrative Association of the Aqueduct and Sanitary Sewer of the District of Cajón de Pérez Zeledón, legal ID number: 3-002-238594, is currently requesting the Declaration of Public Utility before the Ministry of Justice and Peace.
VII.-That by virtue of the foregoing, the appropriate course is to revoke the declaration of public utility granted to the Administrative Association of the Santa Teresa Cajón de Pérez Zeledón Aqueduct, legal ID No. 3-002-238594, issued through Executive Decree No. 33867-J, published in La Gaceta number 144 of July 26, 2007. Given at the Presidency of the Republic.-San José, on the thirtieth day of the month of July, two thousand fifteen.

I.-Que el artículo 32 de la Ley de Asociaciones Nº 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social, así como revocar este beneficio, si desaparecen los motivos por los cuales fue concedido.
II.-Que por haberlo dispuesto el Instituto Costarricense de Acueductos y Alcantarillados las Asociaciones de Acueductos Rurales del Distrito de Cajón de Pérez Zeledón debieron fusionarse.
III.-Que la Asociación Administrativa del Acueducto Santa Teresa Cajón de Pérez Zeledón, cédula jurídica Nº 3-002-238594, fue declarada de Utilidad Pública mediante Decreto Ejecutivo Nº 33867-J, publicado en el Diario Oficial N° 144 de 26 de julio del 2007 y es una de las Asociaciones que debió fusionarse.
IV.-Que todas las Asociaciones de Acueductos Rurales de Cajón de Pérez Zeledón, debieron fusionarse, y nacieron a la vida jurídica como Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Cajón de Pérez Zeledón, cédula jurídica Nº 3-002-238594.
V.-Que de conformidad con el artículo 13 de la Ley de Asociaciones la extinción de la Asociación procede cuando sea materialmente y legalmente imposible continuar operando como Asociación.
VI.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Cajón de Pérez Zeledón, cédula jurídica número: 3-002-238594, se encuentra solicitando la Declaratoria de Utilidad Pública ante el Ministerio de Justicia y Paz.
VII.-Que en virtud de lo anterior, lo procedente es revocar la declaratoria de utilidad pública otorgada a la Asociación Administrativa del Acueducto Santa Teresa Cajón de Pérez Zeledón, cédula jurídica Nº 3-002-238594, emitida mediante el Decreto Ejecutivo Nº 33867-J, publicado en La Gaceta número 144 del 26 de julio del 2007. Por tanto,
