in the entirety of the text - Complete Text of Norm 39093 Reform of Executive Decree No. 29398 "Declares the CIPANCI National Wildlife Refuge" Complete Text of act: 106277 No. 39093-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the attributions and powers conferred by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution, and in accordance with the provisions of Articles 25 subsection 1), 27 subsection 1) and 28 subsection 1) paragraph b) of the General Law of Public Administration No. 6227, Article 3 subsections I, II and III of the Water Law No. 276 of August 27, 1942, Article 7 subsection b) of the Law of Lands and Colonization No. 2825 of October 14, 1961, Articles 13 and 18 of the Forestry Law No. 7575 of February 13, 1996, Article 37 of the Organic Environmental Law No. 7554 of October 4, 1995, Articles 7 and 82 of the Wildlife Conservation Law No. 7317 of October 30, 1992, the Convention on Wetlands of International Importance (RAMSAR Convention), Law No. 7224 of April 9, 1991, Articles 1, 9, 10, 11 and 73 of the Law on the Maritime Terrestrial Zone No. 6043 of March 2, 1977, Article 2 subsections h) and f) of the Regulation to the Law on the Maritime Terrestrial Zone, Executive Decree No. 7841 of December 16, 1977, and Article IV subsection r) of the Manual for the classification of lands dedicated to the conservation of natural resources within the maritime terrestrial zone of Costa Rica, Executive Decree No. 36786 of August 12, 2011.

1That it is an essential function of the State to ensure the conservation, protection, administration and promotion of the sustainability of the country's natural resources.
2That it is an obligation of the State to implement and comply with the mandate of Article 50 of the Political Constitution, in the sense of protecting the right to a healthy and ecologically balanced environment.
3That the Cipanci National Wildlife Refuge was created and delimited by Executive Decree No. 29398-MINAE of January 22, 2001, published in Supplement No. 25 of the Official Gazette La Gaceta number 62 of March 28, 2001.
4That the area currently affected by the protected wild area regime is insufficient to guarantee long-term ecological and conservation processes, due to the land-use trend of the surrounding lands, which, by the nature of the relief, combined with human risk factors (fires, erosion, illegal logging and hunting, extraction and overexploitation of natural resources, sedimentation and contamination, among others), make the refuge vulnerable.
5That the expansion of the boundaries of the Cipanci National Wildlife Refuge is required, as a measure that guarantees the protection of the existing wetland ecosystems not contemplated in Executive Decree No. 29398-MINAE, through long-term protection and sustainable management processes.
6That additionally, the expansion decreed strengthens the state's will to protect the ecosystems of the Tempisque River, since it complements the environmental protection given by the existence of other neighboring protected wild areas, such as the Zapandí Wetland, the Mata Redonda Lagoon National Wildlife Refuge, the Corral de Piedra Wetland and the Palo Verde National Park, as a block of protected areas in the lower basin of the Tempisque River.
7That in the sector of the refuge administered by the Arenal Tempisque Conservation Area, no modification was made to the current delimitation, but its description by coordinates was simplified.
8That it has been verified that the ria (ría) of the Tempisque River ascends to Paso del Jobo, at the northern end of the artificial canal drawn on the Tempisque Cartographic Sheet (scale 1:50000), for which this stretch of the river has been incorporated as important sites for the development of ecological processes that occur with tidal influence and strengthen the fish biodiversity of the Tempisque and the Gulf of Nicoya.
9That in the sector of the refuge administered by the Tempisque Conservation Area, several

bridge structure over the Tempisque River (which is of strategic importance for the conservation area), and in mangrove patches and strips of 50 and 200 meters wide (as applicable), along the banks of the Tempisque, Charco and Bolsón rivers, as well as the artificial canal drawn on the Tempisque Cartographic Sheet (scale 1:50000).

10.-That the mangrove patches and the strips of 50 and 200 meters along the banks of those rivers and the canal, constitute the maritime terrestrial zone of the ria (ría) of the Tempisque River, and therefore are of public domain (demanial) nature, belong to the State, and are inalienable and imprescriptible.

11.-That prior to the introduction of the concept of ria (ría) of the maritime terrestrial zone, given the Law on the Maritime Terrestrial Zone No. 6043 of March 2, 1977, the Water Law No. 276 of August 27, 1942 and the Law of Lands and Colonization No. 2825 of October 14, 1961, already granted public domain (demanial) status to the portions of land stated in the previous Considering.

12.-That the ecosystems located in the expanded areas are of high importance for the reproduction of aquatic and terrestrial fauna, especially the different species of fish, shrimp and mollusks.

13.-That in those cases where it is possible, the delimitation of the refuge is strengthened by referencing the official landmarks (mojones) of the National Geographic Institute.

14.-That according to Articles 2, 5 and 11 of Executive Decree No. 33797-MJ-MOPT of March 30, 2007, the Transverse Mercator Projection for Costa Rica, whose acronym is CRTM05, is decreed as the official projection for Costa Rican graphic representation. Therefore, it is essential to refer the new coordinates of the Cipanci National Wildlife Refuge to the mentioned system.

15.-That the modifications provided in this decree are the product of a series of joint efforts between the Cadastre and Registry Regularization Program and the Arenal Tempisque and Tempisque conservation areas. Therefore, They Decree:

"INTEGRAL REFORM OF DECREE No. 29398-MINAE OF JANUARY 22, 2001"

Considering:

29398-MINAE of January 22, 2001 is reformed, which shall read as follows:

"Declare a State-owned National Wildlife Refuge which shall be named "Cipanci Wildlife Refuge" in the area described below:

The boundaries of the Cipanci National Wildlife Refuge by the following literal description and coordinates referenced to the official cartographic projection system for Costa Rica CRTM05 and its associated Datum CR05:

It begins at a point located at the confluence of the Lajas River with the Bebedero River at the point with coordinates 1 E 367596 N 1141044.

It continues southeast upstream along the Lajas River on its left bank, for a distance of 50 meters to the point with coordinates 2 E 367643 N 1141040.

From this point it continues southwest in a line parallel to the left bank of the Bebedero River downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone of said river, to the point with coordinates 3 E 367252 N 1139061.

From this point the boundary of the Refuge continues south along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 4 E 368027 N 1137758, this last point is located at a distance of 50 meters from the left bank of the Bebedero River in a perpendicular line.

It continues southeast in a line parallel to that bank of the river downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone, to the point with coordinates 5 E 367668 N 1137134. This last point is located at a distance of 50 meters from the river bank in a perpendicular line.

From this point the boundary of the Refuge continues south along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 6 E 365083 N 1134000.

From this last point the boundary continues with a straight line to the point with coordinates 7 E 365447 N 1133417.

It continues along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 8 E 365429 N 1130760, located at a distance of 50 meters from the left bank of the Tempisque River in a perpendicular line.

From this last point it continues southwest in a line parallel to that bank of the river downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone, to the point with coordinates 9 E 365328 N 1130178, located at a distance of 50 meters from the left bank of the Tempisque River in a perpendicular line.

From this point the boundary of the Refuge continues southeast along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 10 E 365541 N 1130193.

It continues by a succession of straight lines joining the points with coordinates:

From this last point the boundary of the Refuge continues southwest along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 17 E 365057 N 1129731, located at a distance of 50 meters from the left bank of the Tempisque River in a perpendicular line.

From this last point it continues southwest in a line parallel to that bank of the river downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone, to the point with coordinates 18 E 364792 N 1129467, located at a distance of 50 meters from the left bank of the Tempisque River in a perpendicular line.

It continues by a succession of straight lines joining the points with coordinates:

The boundary of the Refuge continues southwest along the mangrove boundary according to the State Natural Heritage input, to the point with coordinates 174 E 358627 N 1134668.

From this last point it continues with a straight line to the point with coordinates 175 E 359246 N 1135321, a point located on the right bank of the Tempisque River heading towards its mouth.

The boundary continues along the right bank of the Tempisque River heading towards its mouth, to the point with coordinates 176 E 356919 N1139749, a point located on the right bank of the Tempisque River heading towards its mouth.

The boundary continues with a straight line to the point with coordinates 177 E 356887 N 1139710.

From this last point the boundary of the Refuge continues northward, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone. In those cases where the mangrove boundary according to the State Natural Heritage input exceeds the 50-meter strip, the mangrove boundary shall be respected as the boundary of the protected wild area, to the point with coordinates 178 E 345733 N 1144428.

This last point is located at a distance of 50 meters, from the right bank of the Tempisque River heading towards its mouth, in a line perpendicular to the confluence of the Charco River and the Tempisque River.

The boundary continues westward along the right bank of the Charco River to the point with coordinates 179 E 343618 N 1142654.

From this last point, a strip of 200 meters parallel to the right bank heading towards the mouth of the Charco River is included, to the point with coordinates 180 E 345678 N 1144687.

From this last point the boundary of the Refuge continues, including a strip of land with a width of 200 meters parallel to the right bank, heading towards the mouth of the Tempisque River, to the point with coordinates 181 E 345273 N 1146336.

From this last point the boundary of the Refuge continues, including a strip of land with a width of 200 meters parallel to the right bank of the Bolsón River, heading towards its confluence with the Tempisque River, to the point with coordinates 182 E 341208 N 1146656.

From this last point it continues in a straight line to the point with coordinates 183 E 341210 N 1147095.

From this last point the boundary of the Refuge continues, including a strip of land with a width of 200 meters parallel to the left bank of the Bolsón River, heading towards its confluence with the Tempisque River, to the point with coordinates 184 E 345422 N 1146887.

From this last point, a strip of 200 meters parallel to the right bank, heading towards the mouth of the Tempisque River, is included, to the point with coordinates 185 E 346243 N 1153050.

The boundary of the Refuge continues, joining with straight lines the points with coordinates:

From this last point it continues with a straight line to the point with coordinates 1 E 367596 N 1141044, the starting point of this description."

29398-MINAE of January 22, 2001 is reformed, which shall read as follows:

"The administration of the Refuge corresponds to the Ministry of Environment and Energy through the National System of Conservation Areas, and the provisions established for the category of protected area in national legislation and in the respective Management Plan shall be applied therein".

29398-MINAE, which shall read as follows:

"The water surfaces (espejos de agua) of the Tempisque, Charco and Bolsón rivers, and of the artificial canal drawn on the Tempisque Cartographic Sheet (scale 1:50000) included in the previous delimitation, form part of the Cipanci National Wildlife Refuge".

en la totalidad del texto - Texto Completo Norma 39093 Reforma decreto ejecutivo N° 29398 "Declara Refugio Nacional de Vida Silvestre CIPANCI" Texto Completo acta: 106277 Nº 39093-MINAE EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA Con fundamento en las atribuciones y facultades que les confiere el artículo 140, incisos 3) y 18) y el 146 de la Constitución Política, y de conformidad con lo dispuesto en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 1) acápite b) de la Ley General de la Administración Pública N° 6227, artículo 3 incisos I, II y III de la Ley de Aguas Nº 276 del 27 de agosto de 1942, artículo 7 inciso b) de la Ley de Tierras y Colonización Nº 2825 del 14 de octubre de 1961, artículos 13 y 18 de la Ley Forestal N° 7575 del 13 de febrero de 1996, artículo 37 de la Ley Orgánica del Ambiente N° 7554 del 04 de octubre de 1995, artículos 7 y 82 de la Ley de Conservación de Vida Silvestre N° 7317 del 30 de octubre de 1992, la Convención Relativa a los Humedales de Importancia Internacional (Convención RAMSAR), Ley Nº 7224 del 09 de abril de 1991, artículos 1, 9, 10, 11 y 73 de la Ley sobre la Zona Marítimo Terrestre Nº 6043 del 2 de marzo de 1977, artículo 2 incisos h) y f) del Reglamento a la Ley sobre la Zona Marítimo Terrestre, Decreto Ejecutivo Nº 7841 del 16 de diciembre de 1977, y el artículo IV inciso r) del Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la zona marítimo terrestre de Costa Rica, Decreto Ejecutivo Nº 36786 del 12 de agosto del 2011.

1Que es función esencial del Estado velar por la conservación, protección, administración y fomento de la sostenibilidad de los recursos naturales del país.
2Que es una obligación del Estado llevar a la práctica y cumplir con el mandato del artículo 50 de la Constitución Política, en el sentido de proteger el derecho a un ambiente sano y ecológicamente equilibrado.
3Que el Refugio Nacional de Vida Silvestre Cipanci fue creado y delimitado mediante el Decreto Ejecutivo N° 29398-MINAE del 22 de enero del 2001, publicado en el Alcance N° 25 del Diario Oficial La Gaceta número 62 del 28 de marzo del 2001.
4Que el área actualmente afectada al régimen del área silvestre protegida, es insuficiente para garantizar procesos ecológicos y de conservación a largo plazo, debido a la tendencia de uso de los terrenos aledaños, que por la naturaleza del relieve, combinado con factores humanos de riesgo (incendios, erosión, tala y caza ilegal, extracción y sobreexplotación de recursos naturales, sedimentación y contaminación, entre otros), hacen vulnerable al refugio.
5Que se requiere la ampliación de los límites del Refugio Nacional de Vida Silvestre Cipanci, como medida que garantice la protección de los ecosistemas de humedales existentes y no contemplados en el Decreto Ejecutivo N° 29398-MINAE, mediante procesos de protección y manejo sostenible a largo plazo.
6Que adicionalmente, la ampliación que se decreta fortalece la voluntad estatal de tutelar los ecosistemas del río Tempisque, puesto que complementa la protección ambiental dada por la existencia de otras áreas silvestres protegidas aledañas, como lo son el Humedal Zapandí, el Refugio Nacional de Vida Silvestre Laguna de Mata Redonda, el Humedal Corral de Piedra y el Parque Nacional Palo Verde como un bloque de áreas protegidas en la cuenca baja del río Tempisque.
7Que en el sector del refugio administrado por el Área de Conservación Arenal Tempisque no se practicó ninguna modificación a la delimitación vigente, pero sí se simplificó su descripción por coordenadas.
8Que se ha comprobado que la ría del río Tempisque asciende hasta el Paso del Jobo, en el extremo norte del canal artificial dibujado en la Hoja Cartográfica Tempisque (escala 1:50000), por lo cual se ha incorporado este trayecto del río como sitios importantes para el desarrollo de procesos ecológicos que se desarrollan con la influencia mareal y fortalecen la biodiversidad íctica del Tempisque y del Golfo de Nicoya.
9Que en el sector del refugio administrado por el Área de Conservación Tempisque, sí se realizaron varias ampliaciones, tanto en un pequeño sector junto a la estructura del puente sobre el río Tempisque (el cual es de importancia estratégica para el área de conservación), como en manchas de manglar y franjas de 50 y 200 metros de ancho (según el caso), sobre las riberas de los ríos Tempisque, Charco y Bolsón, así como del canal artificial dibujado en la Hoja Cartográfica Tempisque (escala 1:50000).

10.-Que las manchas de manglar y las franjas de 50 y 200 metros sobre las riberas de esos ríos y el canal, constituyen la zona marítimo terrestre de la ría del río Tempisque, y por ende son de naturaleza demanial, pertenecen al Estado, y son inalienables e imprescriptibles.

11.-Que previamente a la introducción del concepto de ría de la zona marítimo terrestre, dado la Ley sobre la Zona Marítimo Terrestre Nº 6043 del 2 de marzo de 1977, la Ley de Aguas Nº 276 del 27 de agosto de 1942 y la Ley de Tierras y Colonización Nº 2825 del 14 de octubre de 1961, ya le otorgaban la condición demanial a las porciones de tierra enunciadas en el Considerando anterior.

12.-Que los ecosistemas ubicados en las áreas ampliadas son de alta importancia para la reproducción de la fauna acuática y terrestre, especialmente las diferentes especies de peces, camarones y moluscos.

13.-Que en aquellos casos en que es posible, se fortalece la delimitación del refugio haciendo referencia a los mojones oficiales del Instituto Geográfico Nacional.

14.-Que según los artículos 2, 5 y 11 del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo del 2007, se decreta como proyección oficial para la representación gráfica costarricense la Proyección Transversal de Mercator para Costa Rica, cuyo acrónimo es CRTM05. Por lo tanto, es indispensable referir las nuevas coordenadas del Refugio Nacional de Vida Silvestre Cipanci al mencionado sistema.

15.-Que las modificaciones dispuestas en este decreto, son el producto de una serie de trabajos conjuntos entre el Programa de Regularización de Catastro y Registro y las áreas de conservación Arenal Tempisque y Tempisque. Por tanto,

"REFORMA INTEGRAL DEL DECRETO N° 29398-MINAE DEL 22 DE ENERO DEL 2001"

Considerando:

Decretan:

"Declárese Refugio Nacional de Vida Silvestre de propiedad estatal el cual se denominará "Refugio de Vida Silvestre Cipanci" en el área que se describe a continuación:

Los límites del Refugio Nacional de Vida Silvestre Cipanci por la siguiente descripción literal y de coordenadas referidas al sistema de proyección cartográfica oficial para Costa Rica CRTM05 y su Datum asociado CR05:

Se parte de un punto localizado en la confluencia del río Lajas con el río Bebedero en el punto con las coordenadas 1 E 367596 N 1141044.

Continúa en dirección sureste aguas arriba del río Lajas sobre su ribera izquierda, hasta una distancia de 50 metros en punto con las coordenadas 2 E 367643 N 1141040.

De este punto se continúa en dirección suroeste en una línea paralela a la ribera izquierda del río Bebedero aguas abajo, delimitando una franja de terreno con un ancho de 50 metros correspondiente a la Zona Pública de dicho río, hasta el punto con las coordenadas 3 E 367252 N 1139061.

De este punto se continúa el límite del Refugio en sentido sur sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 4 E 368027 N 1137758, este último punto se encuentra localizado a una distancia de 50 metros desde la ribera izquierda del río Bebedero en línea perpendicular.

Se continúa en dirección sureste en una línea paralela a esa ribera del río aguas abajo, delimitando una franja de terreno con un ancho de 50 metros correspondiente a la Zona Pública, hasta el punto con las coordenadas 5 E 367668 N 1137134. Este último punto se encuentra localizado a una distancia de 50 metros desde la ribera del río en línea perpendicular.

De este punto se continúa el límite del Refugio en sentido sur sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 6 E 365083 N 1134000.

De este último punto se continúa el límite con una línea recta hasta el punto con las coordenadas 7 E 365447 N 1133417.

Se continúa sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 8 E 365429 N 1130760, localizado a una distancia de 50 metros desde la ribera izquierda del río Tempisque en línea perpendicular.

De este último punto se continúa en dirección suroeste en una línea paralela a esa ribera del río aguas abajo, delimitando una franja de terreno con un ancho de 50 metros correspondiente a la Zona Pública, hasta el punto con las coordenadas 9 E 365328 N 1130178, localizado a una distancia de 50 metros desde la ribera izquierda del río Tempisque en línea perpendicular.

De este punto se continúa el límite del Refugio en sentido sureste sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 10 E 365541 N 1130193.

Se continúa por una sucesión de líneas rectas uniendo los puntos con las coordenadas:

11 E 365512 N 1130365 12 E 365587 N 1130507 13 E 365916 N 1130289 14 E 365750 N 1130137 15 E 365914 N 1129960 Este último punto se encuentra localizado en la margen izquierda sentido norte de la Ruta Nacional que comunica el poblado de Monte Potrero con Puerto Alegre.

Se continúa el límite del Refugio sobre la margen izquierda sentido norte de la Ruta Nacional que comunica el poblado de Monte Potrero con Puerto Alegre hasta el punto con las coordenadas 16 E 365735 N 1129747.

De este último punto se continúa el límite del Refugio en sentido suroeste sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 17 E 365057 N 1129731, localizado a una distancia de 50 metros desde la ribera izquierda del río Tempisque en línea perpendicular.

De este último punto se continúa en dirección suroeste en una línea paralela a esa ribera del río aguas abajo, delimitando una franja de terreno con un ancho de 50 metros correspondiente a la Zona Pública, hasta el punto con las coordenadas 18 E 364792 N 1129467, localizado a una distancia de 50 metros desde la ribera izquierda del río Tempisque en línea perpendicular.

Se continúa por una sucesión de líneas rectas uniendo los puntos con las coordenadas:

19 E 364602 N 1128317 20 E 363391 N 1128593 Este último punto se encuentra localizado a una distancia de 50 metros desde la ribera derecha del río Tempisque en línea perpendicular.

Se continúa el límite del Refugio en sentido suroeste sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 21 E 363247 N 1128604.

De este último punto se continúa por una sucesión de líneas rectas uniendo los puntos con las coordenadas:

22 E 363115 N 1128647 23 E 362841 N 1128947 24 E 362491 N 1129047 25 E 362041 N 1129548 26 E 362117 N 1130198 27 E 361342 N 1130574 28 E 361112 N 1130563 Este último punto se encuentra localizado en la margen derecha sentido norte de la Ruta Nacional que comunica el poblado de Loma Bonita con el puente del río Tempisque.

Se continúa el límite del Refugio sobre la margen derecha sentido norte de la Ruta Nacional que comunica el poblado de Loma Bonita con el puente del río Tempisque hasta el punto con las coordenadas: 29 E 361146 N 1130732, correspondiente al Mojón M609 publicado en el Diario Oficial La Gaceta número 122 del 23 junio del 2004.

A partir de este último punto se continúa el límite del Refugio, uniendo por líneas rectas los puntos con coordenadas correspondientes a los mojones publicados en el Diario Oficial La Gaceta número 122 del 23 junio del 2004:

De este último punto se continúa en dirección noroeste en una línea paralela a esa ribera del río, delimitando una franja con un ancho de 50 metros correspondiente a la Zona Pública, hasta el punto con las coordenadas 173 E 359306 N 1135280.

Este último punto se encuentra localizado a una distancia de 50 metros desde la ribera derecha del río Tempisque en línea perpendicular.

Se continúa el límite del Refugio en sentido suroeste sobre el límite del manglar según el insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 174 E 358627 N 1134668.

De este último punto se continúa con una línea recta hasta el punto con las coordenadas 175 E 359246 N 1135321, punto localizado sobre la ribera derecha del río Tempisque en sentido de su desembocadura.

Se continúa el límite sobre la ribera derecha del río Tempisque en sentido de su desembocadura, hasta el punto con las coordenadas 176 E 356919 N1139749, punto localizado sobre la ribera derecha del río Tempisque en sentido de su desembocadura.

Se continúa el límite con una línea recta hasta el punto con las coordenadas 177 E 356887 N 1139710.

A partir de este último punto se continúa el lindero del Refugio en sentido norte, delimitando una franja de terreno con un ancho de 50 metros correspondiente a la Zona Pública. En aquellos casos donde el límite del manglar según el insumo de Patrimonio Natural del Estado exceda la franja de 50 metros, se respetara el límite del manglar como límite del área silvestre protegida, hasta el punto con las coordenadas 178 E 345733 N 1144428.

Este último punto se encuentra localizado a una distancia de 50 metros, desde la ribera derecha del río Tempisque en sentido de su desembocadura, en línea perpendicular a la confluencia del río Charco y el río Tempisque.

Se continúa el límite con sentido oeste sobre la ribera derecha del río Charco hasta el punto con las coordenadas 179 E 343618 N 1142654.

A partir de este último punto se incluye una franja de 200 metros paralelos a la ribera derecha en el sentido de desembocadura del río Charco hasta el punto con las coordenadas 180 E 345678 N 1144687.

De este último punto se continúa el límite del Refugio incluyendo una franja de terreno con un ancho de 200 metros paralelos a la ribera derecha, en sentido de la desembocadura del río Tempisque, hasta el punto con las coordenadas 181 E 345273 N 1146336.

De este último punto se continúa el límite del Refugio incluyendo una franja de terreno con un ancho de 200 metros paralelos a la ribera derecha del río Bolsón, en sentido de su confluencia con el río Tempisque hasta el punto con las coordenadas 182 E 341208 N 1146656.

De este último punto se continúa en línea recta hasta el punto con las coordenadas 183 E 341210 N 1147095.

De este último punto se continúa el límite del Refugio incluyendo una franja de terreno con un ancho de 200 metros paralelos a la ribera izquierda del río Bolsón, en sentido de su confluencia con el río Tempisque, hasta el punto con las coordenadas 184 E 345422 N 1146887.

A partir de este último punto se incluye una franja de 200 metros paralelos a la ribera derecha, en el sentido de desembocadura del río Tempisque, hasta el punto con las coordenadas 185 E 346243 N 1153050.

Se continúa el límite del Refugio uniendo con líneas rectas los puntos con las coordenadas:

186 E 346695 N 1153142 187 E 346930 N 1149131 188 E 346718 N 1149126 A partir de este último punto se continúa el lindero hacia el sur, sobre la ribera izquierda del río Tempisque en sentido de su desembocadura, hasta el punto con las coordenadas 189 E 363247 N 1133965.

Este último punto se localiza en la confluencia del río Bebedero y el río Tempisque.

Se continúa el lindero hacia el este sobre la ribera derecha del río Bebedero, hasta el punto con las coordenadas 190 E 367526 N 1141086.

De este último punto se continúa con una línea recta hasta el punto con las coordenadas 1 E 367596 N 1141044, punto de inicio de la presente descripción."

"La administración del Refugio corresponde al Ministerio del Ambiente y Energía a través del Sistema Nacional de Áreas de Conservación y en él se aplicarán las disposiciones establecidas para la categoría de área protegida en la legislación nacional y en el respectivo Plan de Manejo".

"Los espejos de agua de los ríos Tempisque, Charco y Bolsón, y del canal artificial dibujado en la Hoja Cartográfica Tempisque (escala 1:50000) incluidos en la delimitación anterior, forman parte del Refugio Nacional de Vida Silvestre Cipanci".

Artículo 3 — Se adiciona el artículo 3 al Decreto N° 29398-MINAE, el cual se leerá de la siguiente manera:
