across the entire text - Full Text of Regulation 39101 Amendment to the Regulation of the Organic Law of Agriculture and the Sugar Cane Industry (For the Purposes of Art. 308, Said Provision Shall Apply for the 2000-2001 Harvest) Full Text of record: 105678 No. 39101-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, articles 25, 27.1, 28.2.b) of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law No. 7818 of September 2, 1998, Organic Law of Agriculture and the Sugar Cane Industry.
Considering:
7818, Organic Law of Agriculture and the Sugar Cane Industry (hereinafter the Law), grants independent producer status, among others, to de facto companies (sociedades de hecho), provided they produce cane from a plantation held under a legitimate title and do not fall under the scenarios indicated in article 55 of the Law.
and related articles of the Law, in connection with sections 164, 165, 166, 167, 168, 178, 195, 191, 197 et seq. and related articles of Executive Decree No. 28665-MAG, Executive Regulation of the Organic Law of Agriculture and the Sugar Cane Industry (hereinafter the Regulation), establish the obligation of independent cane producers to register with the LAICA Producer Registry and to demonstrate the legitimate title supporting their registration and cane deliveries, for the purpose of being included on the respective list (nómina) of the mill (ingenio) to which they intend to deliver their cane.

Therefore, They decree:
AMENDMENT TO SUBSECTION C) OF ARTICLE 166 OF EXECUTIVE DECREE No. 28665-MAG, EXECUTIVE REGULATION OF THE ORGANIC LAW OF AGRICULTURE AND THE SUGAR CANE INDUSTRY
28665-MAG, Executive Regulation of the Organic Law of Agriculture and the Sugar Cane Industry, so that henceforth it reads as follows:
"Article 166.-The independent producer must submit the registration application on the forms issued by the Sugar Cane League. Said forms shall contain the following information:

The name of the person authorized to effect the cane registration for future harvests.
The bank account number and the name of the natural or legal person (persona física o jurídica) to whom payments for the sugar and molasses contained in the cane delivered by the de facto company shall be made. The Independent Producer Public Registry shall inform the respective mill of the foregoing. For all purposes, the payment made to the person indicated above shall be considered a payment made to the de facto company by the respective mill.
The name of the natural person authorized to withdraw checks or payment vouchers.
The name of the natural person authorized to sign cane supply contracts, should the mill request it.
They must present the original and a copy, for comparison, of the partners' agreement, with the partners' signatures duly authenticated, which must contain the following information:
. Trade name (Nombre de fantasía) by which the de facto company will be identified.
. Domicile of the company.
. Specification of the type of contribution, value, and proportion made by each of the partners.
. Purpose (Objeto) for which the company is established.
. Term of validity of the agreement.

Sole transitional provision.-De facto companies already registered as independent cane producers shall have a period of two calendar months, counted from the publication of this Decree, to comply with the requirements of article 166, subsection c). Any party failing to comply with the requirements established in this amendment may not register its cane for future harvests. Additionally, the Independent Producer Public Registry shall inform the de facto companies already registered therein of the foregoing.

REFORMA AL INCISO C) DEL ARTÍCULO 166 DEL DECRETO EJECUTIVO Nº 28665-MAG, REGLAMENTO EJECUTIVO DE LA LEY ORGÁNICA DE LA AGRICULTURA E INDUSTRIA DE LA CAÑA DE AZÚCAR
Decretan:
"Artículo 166.-El productor independiente deberá presentar la solicitud de inscripción, en las fórmulas que emita la Liga de la Caña. Dichas fórmulas contendrán los siguientes datos:

El nombre de la persona autorizada para efectuar el registro de la caña para futuras zafras.
El número de cuenta bancaria y el nombre de la persona física o jurídica a quien deberán hacerse los pagos por el azúcar y la miel contenida en la caña entregada por la sociedad de hecho. El Registro Público de Productores Independientes, informará lo anterior al ingenio respectivo. Quien no cumpla con los requisitos establecidos en la presente reforma, no podrá registrar su caña para futuras zafras. Adicionalmente, el Registro Público de Productores Independientes informará de lo anterior a las sociedades de hecho que ya se encuentran inscritas en él.
