1º-Whereas in the previous session, a positive recommendation was presented from the Comisión Nacional de Veda, regarding the proposal submitted to this Board of Directors by the representatives of the semi-industrial sardine sector, concerning the amendment of Agreement AJDIP/185-2015, by means of which the closed season in the Gulf of Nicoya was established.

2º-Whereas in their proposal, the semi-industrial sardine sector requests that the capture of sardine be authorized offshore of the Gulf of Nicoya, from a straight imaginary line running from Punta Torres known as Peñón (84°43´52" West Longitude, 09°53¨31" North Latitude) to the Faro de la Isla Negritos afuera (84°49´35" West Longitude, 09°49´14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula.

3º-Whereas in addition to the request made by the semi-industrial sardine sector, as well as the positive opinion issued by the Comisión Nacional de Veda, through official communication DGT-0039- 2015, regarding amending the Closed Season Agreement, under the terms and conditions set forth in the preceding whereas clause, the foregoing based on the grounds that a differentiated closed season must be established for the sardine resource, which would be under analysis by that Commission for the year 2016; in addition to the arguments put forth by this Commission, there is an additional element of the sinking of the vessel that supplied the sector with sardine bait, meaning that there is currently a lack of this input for fishing, which negatively impacts and limits the possibility of carrying out daily fishing operations by the fishing sector.

4º-Whereas under criteria of convenience, utility, and necessity; as well as having the technical opinion of the Comisión Nacional de Veda; given the need to guarantee bait for the fishing fleet, the Directors deem it convenient, under the weighty arguments stated, to amend Agreement AJDIP/185-2015, regarding the possibility of carrying out fishing operations normally by the Semi-industrial Sardine fleet, as established in the whereas clauses set forth in this Agreement, wherefore, the Board of Directors, Therefore; AGREES:

1º-Amend therefore clause 2 of Agreement AJDIP/185-2015, to read as follows: "2-Likewise, a closed season is established for Semi-industrial sardine purse-seine (bolichera/cerco) fishing, in the area comprised by an imaginary line running from Punta Torres known as Peñón (84°43´52" West Longitude, 09°53¨31" North Latitude) to the Faro de la Isla Negritos afuera (84°49´35" West Longitude, 09°49´14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines inland to the mouth of the Tempisque River. For Semi-industrial shrimp trawling fishing, the closed season is established in the area comprised by an imaginary line running from the mouth of the Agujas River (84°39´15" West Longitude, 09°43¨20" North Latitude) to the Faro de la Isla Negritos afuera (84°49´35" West Longitude, 09°49´14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula and from these lines inland to the mouth of the Tempisque River. For both fleets the closed season shall extend from May 15 to September 14, 2015, both dates inclusive".

2º-The other conditions of the aforementioned Agreement remain unchanged.

3º-By reason of the foregoing and under criteria of convenience, necessity, and timeliness, based on the opinion issued by the Comisión Nacional de Vedas, the request for an opinion sent to the Comisión Científico Técnica is rendered without effect.

4º-Final Agreement.

Whereas:

1. 1Que habiéndose presentado en la pasada sesión, criterio positivo de la Comisión Nacional de Veda, en relación con la propuesta presentada ante esta Junta Directiva por parte de los representantes del sector semiindustrial sardinero, sobre la modificación del Acuerdo AJDIP/185-2015, por medio del cual se estableció la veda en el Golfo de Nicoya.
2. 2Que en su propuesta, el sector semiindustrial sardinero, solicita se autorice la captura de sardina aguas afuera del Golfo de Nicoya, a partir de una línea recta imaginaria que va desde Punta Torres conocida como Peñón (84°43´52" Longitud Oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya.
3. 3Que aunado a la solicitud planteada por el sector semiindustrial sardinero, así como al criterio positivo vertido por la Comisión Nacional de Veda, por medio de oficio DGT-0039- 2015, respecto a modificar el Acuerdo de Veda, en los términos y condiciones señaladas en el considerando precedente, lo anterior bajo fundamentos de que para el recurso sardina debe establecerse una veda diferenciada, la cual estaría siendo analizada por esa Comisión para el año 2016; además de los argumentos vertidos por esta Comisión, se tiene como elemento adicional, el hundimiento de la embarcación que proveía al sector de carnada de sardina, por lo que actualmente se carece de ese insumo para la pesca, lo cual impacta y limita negativamente la posibilidad de realizar labores de pesca cotidianas por parte del sector pesquero.
4. 4Que bajo criterios de conveniencia, utilidad y necesidad; así como contándose con el criterio técnico de la Comisión Nacional de Veda; dadas la necesidad de garantizar carnada a la flota pesquera, estiman conveniente los Señores Directores, bajo las argumentaciones de peso dichas, modificar el Acuerdo AJDIP/185-2015, respecto a la posibilidad de realizar faenas de pesca de manera normal, por parte de la flota Semiindustrial Sardinera, conforme se ha establecido en los considerandos enunciados del presente Acuerdo, razón por la cual, la Junta Directiva, Por tanto;

ACUERDA:

1º-Modifíquese el por tanto 2° del Acuerdo AJDIP/185-2015, para que se lea de la siguiente manera: "2-Asimismo se establece una veda para la pesca Semi-industrial sardinera bolichera (cerco), en el área comprendida por una línea imaginaria que va desde Punta Torres conocida como Peñón (84°43´52" Longitud oeste, 09°53¨31"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del Río Tempisque. Para la pesca Semi-industrial camaronera de arrastre se establece la veda en el área comprendida por una línea imaginaria que va desde la desembocadura del Rio Agujas (84°39´15" Longitud Oeste, 09°43¨20"Latinud Norte) al Faro de la Isla Negritos afuera (84°49´35" Longitud Oeste, 09°49´14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya y de esta líneas aguas adentro hasta la desembocadura del Río Tempisque. Para ambas flotas la veda comprenderá desde el 15 de mayo hasta el 14 de setiembre del 2015, ambas fechas incluidas".

2º-Las demás condiciones del Acuerdo supra, se mantienen invariables.

3º-En razón de lo anterior y bajo criterios de conveniencia, necesidad y oportunidad, con sustento en el criterio vertido por la Comisión Nacional de Vedas, se deja sin efecto la solicitud de criterio remitida a la Comisión Científico Técnica.

4º-Acuerdo Firme.
