in the entirety of the text - Complete Text of Rule 38833 Declares of public utility for the interests of the State the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Cajón de Pérez Zeledón Complete Text of record: 10173E N° 38833-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Act No. 218 of August 8, 1939, and articles 27 and following of the Regulations to the Associations Act No. 29496-J, published in La Gaceta number 96 of May 21, 2001.
I.-That article 32 of the Associations Act No. 218 of 08-08-39 and its amendments, grants the Executive Branch the power to declare of Public Utility those simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.-That the ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT AND SANITARY SEWERAGE OF THE DISTRICT OF CAJÓN DE PÉREZ ZELEDÓN, legal entity identification number 3-002-238594, was registered in the Associations Registry of the Public Registry as of March 1, 2004, under file 10873, volume No. 459, entry 4025.
III.-That the purposes pursued by the Association, according to article four of its bylaws, are: ". ARTICLE THREE: The purposes of the Association shall be the following: A) To administer, operate, maintain, develop, and conserve in good condition the aqueduct, in accordance with the provisions and regulations issued thereto by the Costa Rican Institute of Aqueducts and Sewerage, which shall be mandatory. B) To obtain the effective participation of the community, in the construction, operation, maintenance, and development of the aqueduct. C) Collaboration in educational programs and campaigns that are undertaken. D) To help explain and disseminate in the community the provisions and regulations of the Costa Rican Institute of Aqueducts and Sewerage. E) To cooperate with the plans, projects, and works undertaken by the Costa Rican Institute of Aqueducts and Sewerage in the community. F) To participate in matters relating to the administration, conservation, and rational exploitation of waters; control of their contamination or alteration, definition of the measures and actions necessary for the protection of watersheds (cuencas hidrográficas) and ecological stability. G) To ensure that all systems and their aqueduct or sanitary sewerage installations comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, rationalization of expenses, etc. H) To provide public services, in an efficient, egalitarian, and timely manner to all their users, without distinctions of any nature (.)". IV.-That such purposes solve a social need of the highest order, for which they merit the support of the Costa Rican State. Therefore,

en la totalidad del texto - Texto Completo Norma 38833 Declara de utilidad pública para los intereses del Estado la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Cajón de Pérez Zeledón Texto Completo acta: 10173E N° 38833-JP EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta número 96 del 21 de mayo del 2001.
I.-Que el artículo 32 de la Ley de Asociaciones N° 218 de 08-08-39 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DEL DISTRITO DE CAJÓN DE PÉREZ ZELEDÓN, cédula de persona jurídica N° 3-002-238594, se inscribió en el Registro de Asociaciones del Registro Público desde el día 01 de marzo de 2004, bajo el expediente 10873, tomo N° 459, asiento 4025.
III.-Que los fines que persigue la Asociación, según el artículo cuarto de sus estatutos, son: ". ARTÍCULO TERCERO: Los fines de la Asociación serán los siguientes: A) Administrar, operar, dar mantenimiento, desarrollo y conservación en buenas condiciones el acueducto, de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados, que serán de acatamiento obligatorio. B) Obtener la participación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo del acueducto. C) Colaboración en los programas y campañas de índole educativa que se emprendan. D) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. E) Cooperar con los planes, proyectos y obras que emprenda el Instituto Costarricense de Acueductos y Alcantarillados en la comunidad. F) Participar en asuntos relativos a la administración, conservación y definición de las medidas y acciones necesarias para la protección de las cuencas hidrográficas y la estabilidad ecológica. G) Velar porque todos los sistemas sus instalaciones de acueductos o alcantarillados sanitario, cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc. H) Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza (.)". IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
