Both the generating entities, the users of the service, as well as the physical or legal persons authorized by the Municipality for the handling of some of the stages of the management of solid waste in the canton, are responsible for complying with the provisions established in this Regulation.
- a)It is the responsibility of the generators:
1. To temporarily store (almacenar) the quantity of solid waste generated in the dwelling, business, or others in such a way that they do not cause any environmental impact and/or risk to health or to other persons in the community.
2. To place the solid waste generated for the collection service only at the beginning and on the day of the corresponding collection day, in such a way that they do not cause environmental or health impacts.
3. The solid waste, when being collected, must be in closed and resistant plastic bags with a weight not exceeding 20 kilograms, placed on the public road in a manner that does not obstruct free transit.
4. In areas where the Municipality offers the separate collection service for recoverable solid waste materials, the same must be separated from the point of generation, packaged, and placed separately for the collection service, on the public road without impeding free transit.
5. Recoverable solid waste materials such as glass, paper, cardboard, plastic, and aluminum, among others, must be delivered dry and free of organic waste and packaged. The entity responsible for collection may establish other or new conditions for their separation, packaging, and collection, which shall be communicated in advance to the users no less than 8 calendar days beforehand.
6. Deliver the recoverable solid waste materials, separated and packaged in different transparent or translucent plastic bags, duly identified. The receptacle for waste may be disposable or reusable.
7. Sharp waste (Residuos punzo-cortantes) shall be individually packaged to reduce the maximum risk to the personnel collecting. Likewise, garden waste must be identified as: grass, leaves, plant remains, sawdust, shredded branches, and trunks, with a diameter not exceeding five centimeters and one centimeter thickness, shall be delivered duly packaged in closed and resistant plastic bags with a weight not exceeding 20 kilograms.
8. Place the quantity of ordinary solid waste to be set out for collection in plastic bags, which may be on the ground or inside trash cans, closed containers (contenedores), or baskets that are at a maximum height of 1.20 meters above ground level, located on a part of the property that borders the public road and from where the collection truck can have easy access to carry out the collection thereof.
9. In areas where collective receptacles are offered, the generators must deposit their solid waste in the same, guaranteeing that they will be freely accessible to the municipal personnel responsible for collection.
10. Provide the corresponding cleaning and maintenance to containers (contenedores) and receptacles in which solid waste is placed while awaiting collection, as well as guarantee the free access of trucks.
- b)Responsibilities of the collection:
1. Provide the solid waste collection service in an accessible, periodic, and efficient manner to all users.
2. Guarantee collection in the area assigned under its responsibility. The frequency of collection is decided by the person responsible for the Municipality.
