I.-That although the Fuel Committee had put forward a proposal to amend Article 52 of the Regulation for the regulation, control, and efficient use of fuel at a competitive international price, intended for the national commercial non-sport fishing fleet and the national tourist fishing fleet in Costa Rican jurisdictional waters or beyond them, adopted by Agreement AJDIP/085-2010, published in the Official Gazette La Gaceta No. 81 of 04-28-2010, which addressed the recognition of fuel to fishing organizations for the loss of fuel coupons (chapas de combustible) at the time of withdrawal at RECOPE, a proposal that had not yet been adopted by the Board of Directors.
II.-That in this regard, the Head of the Quepos Regional Office and the Head of the Technical Secretariat were commissioned, in response to the decision of the Fuel Committee, to prepare the wording of the indicated amendment, which is presented as the addition of an extra paragraph to Article 52, in the following form:
"In cases where the Organization suffers a loss from fuel coupons (chapas de combustible) and issues to the permit holders (permisionarios) their entire fuel allocation in accordance with that authorized by INCOPESCA, the Organization may consolidate the fuel coupons (chapas de combustible) by submitting the application and the invoices issued by RECOPE and providing photocopies, for the purpose of offsetting the fuel already issued to the permit holders (permisionarios); in this way, the amount authorized by INCOPESCA will be billed to the permit holder (permisionario), without causing losses to the Fishing Organization or the permit holder (permisionario)".
III.-Having reviewed the proposal submitted and considering that it meets the needs for effective control and application of the spirit that established the fuel recognition at a competitive price, as well as having been provided with the assessments and recommendation of the Fuel Committee, the Board of Directors, Therefore; AGREES:
1º-To amend Article 52 of the Regulation for the regulation, control, and efficient use of fuel at a competitive international price, intended for the national commercial non-sport fishing fleet and the national tourist fishing fleet in Costa Rican jurisdictional waters or beyond them, adopted by Agreement AJDIP/085-2010, published in the Official Gazette La Gaceta No. 81 of 04-28-2010, by adding a final paragraph, so that it reads in full as follows:

I.-Que siendo que pese a que el Comité de Combustible, había planteado una propuesta de modificación del artículo 52, del Reglamento regulación, control uso eficiente combustible a precio competitivo nivel internacional, destinado flota pesquera nacional comercial no deportiva y flota pesquera nacional turística en aguas jurisdiccionales costarricenses o fuera de ella de Combustible, adoptado mediante Acuerdo AJDIP/085-2010, publicado en el Diario Oficial La Gaceta N° 81 del 28-04-2010, la cual comprendía la atención del reconocimiento de combustible a las organizaciones pesqueras por pérdida de chapas al momento de realizar el retiro en RECOPE, propuesta que aún no había sido adoptada por la Junta Directiva.
II.-Que en ese sentido, se comisionó al Jefe de la Oficina Regional de Quepos, y al Jefe de la Secretaría Técnica, para que en atención de lo resuelto por el Comité de Combustible, prepararan la redacción de la modificación señalada, misma que se presenta como agregado de un párrafo adicional al artículo 52, en la siguiente forma:
"En los casos en que la Organización obtenga perdida por concepto de chapas de combustible y que la misma otorgue a los permisionarios su totalidad de combustible de conformidad con lo autorizado por el INCOPESCA, la Organización podrá consolidar por concepto de chapas de combustible presentando la solicitud y las facturas emitidas por RECOPE y aportar fotocopias, con el propósito de solventar el combustible ya otorgado a los permisionarios de esta forma se facturará al permisionario lo autorizado por el INCOPESCA, sin ocasionar perdidas a la Organización Pesquera y al permisionario".
III.-Conocida la propuesta remitida y por considerarse que la misma responde a las necesidades de un efectivo control y aplicación del espíritu que estableció el reconocimiento de combustible a precio competitivo, así como habiéndose contado con las valoraciones y recomendación del Comité de Combustible, la Junta Directiva, Por tanto; ACUERDA:
1º-Modificar el artículo 52 del Reglamento regulación, control uso eficiente combustible a precio competitivo nivel internacional, destinado flota pesquera nacional comercial no deportiva y flota pesquera nacional turística en aguas jurisdiccionales costarricenses o fuera de ella de Combustible, adoptado mediante Acuerdo AJDIP/085-2010, publicado en el Diario Oficial La Gaceta N° 81 del 28-04-2010, agregándole un párrafo final, para que se lea íntegramente de la siguiente forma:
