in the entirety of the text - Complete Text of Regulation 38794 Repeals the Regulation of the Regional Council of the La Amistad Pacífico Conservation Area Complete Text of act: 10115D No. 38794-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25, 27 subsection 1, 28 subsection 2.b) of the General Public Administration Act No. 6227 of May 2, 1978; articles 22, 27, and 29 of the Biodiversity Act No. 7788 of April 30, 1998, and articles 12 and 38 of the Regulations to the Biodiversity Act, Executive Decree No. 34433-MINAE of March 11, 2008.

1. 1That the Convention on Biological Diversity and Annexes, ratified by Costa Rica through Act No. 7416 of June 30, 1994, establishes that the State shall exercise complete and exclusive sovereignty over the elements of biodiversity, authorizing the exploration, research, bioprospecting (bioprospección), use, and exploitation of the elements of biodiversity that constitute public domain goods, as well as the utilization of all genetic and biochemical elements and resources.
2. 2That article 27 of the Biodiversity Act, No. 7788 of April 30, 1998, establishes that within the administrative structure of the conservation areas, there must exist, as an administrative unit, the Regional Council of the Conservation Area, known as CORAC.
3. 3That article 38 of the Regulations to the Biodiversity Act, Executive Decree No. 34433-MINAE of March 11, 2008, provides for the operation of the Regional Councils, establishing that each Council must draft its own operating Regulations based on the general guidelines issued by CONAC, which must be consistent with Executive Decree No. 34433-MINAE and with the Costa Rican legal system, and must be approved by this body.
4. 4That the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC), in Ordinary Session No. 08-2009 held on August 31, 2009, through Agreement No. 14, approved the Regulation of the Regional Council of the La Amistad Pacífico Conservation Area, which was subsequently published in the official gazette La Gaceta, which is considered excessive, as approval by CONAC of the corresponding regulation is sufficient.
5. 5That upon review and comparison, the content of Executive Decree No. 35583-MINAET published in La Gaceta No. 239 of December 9, 2009, Regulation of the Regional Council of the La Amistad Pacífico Conservation Area, proved contrary to the general regulations established in the Biodiversity Act No. 7788 of April 30, 1998, and the Regulations to the Biodiversity Act, Executive Decree No. 34433-MINAE of March 11, 2008, which has created complications in the functioning of CORACLAP and in its Assemblies. Therefore,

They decree:

Considering:

en la totalidad del texto - Texto Completo Norma 38794 Deroga Reglamento del Consejo Regional del Área de la Conservación la Amistad Pacífico Texto Completo acta: 10115D N° 38794-MINAE EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA text-indent:24.0pt'>En ejercicio de las facultades que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, 27 inciso 1, 28 inciso 2.b) de la Ley General de Administración Pública Nº 6227 del 2 de mayo de 1978; los artículos 22, 27 y 29 de la Ley de Biodiversidad N° 7788 del 30 abril de 1998 y los artículos 12 y 38 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008.

1. 1Que el Convenio sobre Diversidad Biológica y Anexos, ratificado por Costa Rica mediante Ley N° 7416 del 30 de junio de 1994, establece que el Estado ejercerá la soberanía completa y exclusiva sobre los elementos de la biodiversidad, autorizando la exploración, la investigación, la bioprospección, el uso y el aprovechamiento de los elementos de la biodiversidad que constituyan bienes de dominio público, así como la utilización de todos los elementos y recursos genéticos y bioquímicos.
2. 2Que el artículo 27 de Ley de Biodiversidad, Nº 7788 del 30 abril de 1998, establece que dentro de la estructura administrativa de las áreas de conservación debe existir como unidad administrativa el Consejo Regional de Área de Conservación conocido como CORAC.
3. 3Que el artículo 38 del Reglamento a la Ley de Biodiversidad Decreto Ejecutivo N° 34433-MINAE del 11 de marzo de 2008, dispone sobre el funcionamiento de los Consejos Regionales, estableciendo que cada Consejo deberá elaborar su propio Reglamento de funcionamiento con base en los lineamientos generales emitidos por el CONAC, el cual deberá ser concordante con el Decreto Ejecutivo Nº 34433-MINAE y con el ordenamiento jurídico costarricense, debiendo ser aprobado por este órgano.
4. 4Que el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Ordinaria Nº 08-2009 celebrada el día 31 de agosto del 2009, mediante Acuerdo Nº 14 aprobó el Reglamento del Consejo Regional del Área de Conservación La Amistad Pacífico el cual fue publicado, posteriormente en el diario oficial La Gaceta, lo que se considera excesivo al ser suficiente la aprobación por parte del CONAC del correspondiente reglamento.
5. 5Que revisado y confrontado el contenido del Decreto Ejecutivo Nº 35583-MINAET publicado en La Gaceta N° 239 del 09 de diciembre del 2009, Reglamento del Consejo Regional del Área de Conservación la Amistad Pacífico resultó contrario a la normativa general establecida en la Ley de Biodiversidad Nº 7788 del 30 abril de 1998 y Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008, lo que ha creado complicaciones en el funcionamiento del CORACLAP y en sus Asambleas. Por tanto,

"DEROGATORIA DEL DECRETO EJECUTIVO Nº 35583-MINAET PUBLICADO EN LA GACETA N° 239 DEL 09 DE DICIEMBRE DEL 2009 DENOMINADO REGLAMENTO DEL CONSEJO REGIONAL DEL ÁREA DE CONSERVACIÓN LA AMISTAD PACÍFICO" text-indent:24.0pt'>Artículo 1°-Deróguese el Decreto Ejecutivo Nº 35583-MINAET publicado en La Gaceta N° 239 del 09 de diciembre del 2009 denominado Reglamento del Consejo Regional del Área de Conservación La Amistad Pacífico.
