This Council shall be governed by the provisions of this regulation, which is established for an indefinite period and with jurisdiction over the entire Region covered by the La Amistad Pacífico Conservation Area (Área de Conservación La Amistad Pacífico, ACLA-P).

The Regional Council of the La Amistad Pacífico Conservation Area, being a support and administration body, shall respect the laws related to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).

ACLA-P: La Amistad Pacífico Conservation Area.

CONAC: National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación).

CORACLAP: Regional Council of the La Amistad Pacífico Conservation Area.

• a)Municipal sector. b) Government sector. c) Non-governmental organizations. d) Community Organizations. e) Indigenous Organizations.

All of them must be directly or indirectly linked to the development and management of the ACLA-P, to the conservation and sustainable development of the geographical region covered by this Conservation Area.

Of the general assembly

- Appoint the members of the CORACLAP and the Oversight Office (Fiscalía) to their respective positions. - Hear and approve the annual report of the CORACLAP and the Oversight Office (Fiscalía). - Hear and approve specific matters submitted for consideration by the CORACLAP. - Keep informed about the activities carried out by the CORACLAP and the ACLAP. - Propose policies, plans, and projects of interest to the ACLAP or the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).

At this Assembly, the reports of the Presidency, Treasury, and the Oversight Office (Fiscalía) shall be presented and the members of the Executive Committee must be elected in accordance with article 12 of this regulation.

General operating aspects of the CORACLAP

The functions of the CORACLAP shall be the following:

• a)Approve the work agenda for the CORACLAP meetings. b) Meet once a month ordinarily and extraordinarily, when convened by the Presidency, the Ex

• a)Preside over the Assemblies and the sessions of the CORACLAP. b) Represent the Council in the internal activities of the ACLAP and in the Area's outreach activities. c) Ensure that all members can participate equitably in the working sessions. d) Represent the CORACLAP before other public and private entities. e) Resolve any matter in case of a tie, in which case they shall have a double vote. f) Ensure that the CORACLAP complies with the policies, laws, and regulations related to its function, as established by the legal and technical framework binding on SINAC. g) Render reports to the Assembly and the CORACLAP when required. h) Sign the minutes of the CORACLAP jointly with the Ex

1. Functions of the Vice-President: a) Substitute the President in their absence, exercising the same functions. b) Represent the CORACLAP in the functions assigned by the latter.

2. Functions of the Treasurer: a) Collaborate in the preparation of the annual budget of the Regional Council based on the Work Plan. b) Maintain a record of expenses and provide a semi-annual report to the Regional Council and an annual report to the CORACLAP Assembly.

3. Functions of the Board Members (Vocales): a) In their descending order, substitute, with the exception of the President, the other members of the Regional Council in their absence, should the alternate appointed for that member not appear. b) Join the Commissions and represent the CORACLAP in the functions assigned to them.

When this occurs, the pertinent reasoning must be recorded in the minutes. For each session, minutes shall be taken which shall be approved at the following session.

• a)Non-compliance with their functions. b) Conduct contrary to the purposes and principles established in the Biodiversity Law and other related laws, duly proven by the competent authority once due process has been granted.

Of the Oversight Office (Fiscalía) of the CORACLAP

The Oversight Officer (Fiscal) must attend all sessions of the Committee, with the right to speak but without a vote, and may participate in the sessions of the Scientific-Technical Committee mentioned in article 32 of Law No. 7788. Likewise, they must be invol

• a)Present to the CORACLAP all matters within their knowledge that affect the administration of the ACLAP. b) Recommend to the CORACLAP the removal of any of its members. c) Submit an annual report to the General Assembly. d) Attend all sessions of the CORACLAP, with the right to speak but without the right to vote.

Este Consejo se regirá según lo dispuesto en el presente reglamento, mismo que se establece con carácter indefinido y con jurisdicción en toda la Región que cubre el Área de Conservación La Amistad Pacífico.

El Consejo Regional del Área de Conservación La Amistad Pacífico, al ser un órgano de apoyo y administración, respetará las leyes afines con el Sistema Nacional de Áreas de Conservación.

CORACLAP: Consejo Regional del Área de Conservación Amistad Pacífico.

Todos ellos deben estar vinculados directa o indirectamente con el desarrollo y manejo del ACLA-P, con la conservación y el desarrollo sostenible de la región geográfica que cubre esta Área de Conservación.

De la asamblea general

- Nombrar a los miembros del CORACLAP y la Fiscalía en sus respectivos puestos.

- Conocer y aprobar el informe anual del CORACLAP y de la Fiscalía.

- Conocer y aprobar asuntos específicos que someta a consideración el CORACLAP.

- Mantenerse informada sobre las actividades que realizan el CORACLAP y el ACLAP.

- Proponer políticas, planes y proyectos de interés para el ACLAP o para el Sistema Nacional de Áreas de Conservación.

En esta Asamblea se darán a conocer los informes de Presidencia, Tesorería y de la Fiscalía y se deberán elegir los miembros del Comité Ejecutivo de conformidad con el artículo 12 de este reglamento.

Podrá convocarse de manera extraordinaria cuando sea necesario, para conocer informes y asuntos específicos que someterá a su conocimiento el CORACLAP, la Fiscalía o el 25% de los Asambleístas, previa convocatoria por es

De la integración del CORACLAP

Aspectos generales de funcionamiento del CORACLAP

Las funciones del CORACLAP serán las siguientes:

• a)Aprobar la agenda de trabajo para las reuniones del CORACLAP.
• b)Reunirse una vez al mes en forma ordinaria y en forma extraordinaria, cuando así lo convoque la Presidencia, la Se

• a)Presidir las Asambleas y las sesiones del CORACLAP.
• b)Representar al Consejo en las actividades internas del ACLAP y en las de proyección del Área.
• c)Asegurarse que en las sesiones de trabajo, puedan participar todos los miembros en forma equitativa.
• d)Ejercer la representación del CORACLAP, ante los demás entes públicos y privados.
• e)Resolver cualquier asunto en caso de empate, en cuyo caso tendrá doble voto.
• f)Velar porque el CORACLAP cumpla las políticas, leyes y reglamentos relativos a su función, según lo establece el ordenamiento jurídico y técnico vinculante al SINAC.
• g)Rendir informes a la Asamblea y al CORACLAP, cuando sean requeridos.
• h)Firmar las actas del CORACLAP en conjunto con el Se

1. Funciones del Vicepresidente(a):

• a)Sustituir al Presidente en su ausencia ejerciendo las mismas funciones que éste.
• b)Representar al CORACLAP en las funciones que le sean asignadas por el segundo.

2. Funciones del Tesorero(a):

• a)Colaborar con la elaboración del presupuesto anual del Consejo Regional en función del Plan de Trabajo.
• b)Mantener un registro de gastos y brindar un informe semestral al Consejo regional y anual a la Asamblea del CORACLAP.

3. Funciones de los Vocales:

• a)En su orden descendente suplir a excepción del Presidente, a los demás miembros del Consejo Regional en su ausencia en el caso que el suplente nombrado para ese miembro no se presente.
• b)Integrar las Comisiones y representar al CORACLAP en las funciones que le sean asignadas.

Cuando ello ocurra, deberá consignarse en el acta el razonamiento pertinente. Para cada sesión se levantará un acta que se aprobará en la sesión siguiente.

Para celebrar una sesión ordinaria, el Se

• a)Incumplimiento de sus funciones.
• b)Conducta contraria a los fines y principios establecidos en la Ley de Biodiversidad y otras leyes conexas, debidamente comprobado por autoridad competente una vez otorgado el debido proceso.

Dicho acuerdo de remoción deberá tomarse por mayoría calificada del CORACLAP.

De la Fiscalía del CORACLAP

El o la Fiscal debe asistir a todas las sesiones del Comité, con derecho a voz, pero sin voto y podrá participar en las sesiones del Comité Científico-Técnico mencionado en el artículo 32 de la Ley Nº 7788. Asimismo, deberá involu

• a)Presentar al CORACLAP todos los asuntos que sean de su conocimiento, que afecten la administración del ACLAP.
• b)Recomendar al CORACLAP la remoción de alguno de sus integrantes.
• c)Entregar un informe anual a la Asamblea General.
• d)Asistir a todas las sesiones del CORACLAP, con derecho a voz, pero sin derecho a voto.
