in the entirety of the text - Complete Text of Regulation 38438 Amendment of Executive Decree No. 36481 "Regulating the Ecological Blue Flag Program (PBAE)" Complete Text of act: FAF3A No. 38438 MINAE-MEP-S THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY, THE MINISTER OF PUBLIC EDUCATION AND THE MINISTER OF HEALTH In exercise of the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution, Articles 27 and 28, subsection 2, subparagraph b) of Law No. 6227 of May 2, 1978, the General Law of Public Administration, and,
1. That the Political Constitution of Costa Rica, in Article 50, establishes the State's duty to preserve a healthy and ecologically balanced environment, it being its obligation to guarantee, disseminate, and safeguard that right.
2. That by means of Board of Directors Agreement of the Costa Rican Institute of Aqueducts and Sewers (AYA) No. 96-160 of June 4, 1996, the Ecological Blue Flag Program (PBAE) was created, with the participation of other public and private entities such as: Costa Rican Tourism Institute (ICT), Ministry of Environment, Energy, and Telecommunications (MINAET), Ministry of Health (MINSA), Costa Rican Institute of Aqueducts and Sewers (AYA), National Chamber of Tourism (CANATUR), with the purpose of encouraging community participation in the protection of water resources, the environment in general, and the country's public health. Subsequently, the initiative received support and other institutions joined, namely: Ministry of Public Education (MEP), Costa Rican Network of Private Reserves Association, Costa Rican Institute of Electricity (ICE), Ministry of Agriculture and Livestock (MAG), the Costa Rican Social Security Fund (CCSS), and the Business Association for Development (AED).
3. That Executive Decree No. 36481-MINAET-S published in the Official Gazette La Gaceta No. 71 of April 12, 2011, develops 8 participation categories for the program Ecological Blue Flag.
4. That it is appropriate to amend Annexes A, B, and C of Executive Decree 36481-MINAET-S, with the purpose of modifying the parameters, the minimum composition of the committee, the minimum score, and the gradation of stars in the award for the Category of Educational Centers at the preschool, primary, and secondary levels, with the purpose of contextualizing the procedures to the characteristics of the educational system. Therefore, THEY DECREE:
