96-160 of June 4, 1996, the Ecological Blue Flag Program (PBAE) was created, with the participation of other public and private entities such as: Costa Rican Tourism Institute (ICT), Ministry of Environment, Energy and Telecommunications (MINAET), Ministry of Health (MINSA), Costa Rican Institute of Aqueducts and Sewers (AYA), National Chamber of Tourism (CANATUR), with the purpose of encouraging community participation in the protection of water resources, the environment in general, and the country's public health. Subsequently, the initiative received support and other institutions joined, namely: Ministry of Public Education (MEP), Costa Rican Network of Private Reserves Association, Costa Rican Electricity Institute (ICE), Ministry of Agriculture and Livestock (MAG) and the Costa Rican Social Security Fund (CCSS). These last two institutions are integrated through this Decree.

Likewise, it is necessary to integrate the most relevant normative aspects, the executive decrees that regulate the PBAE. Therefore, They Decree:

31648-MEP-MINAE-S-TUR (Category: Educational Centers) of 2004, No. 31610-S-MINAE-TUR of 2004 (Category: Communities and Category: Beaches), No. 31978-MEP-MINAE-S-TUR (Declaration of public interest PBAE) of 2004, No. 33604-MINAE (Category: Protected Natural Areas) of 2007, No. 34548-MINAE (Category: Actions to Confront Climate Change) of 2008, No. 34777-MINAET-S-MEP (Category: Hydrological Micro-basins) of 2008 and No. 35162-MINAET (Category: Climate Neutral Community) of 2009; as well as the category of Community Health Promotion, created through this regulation. The purpose of this decree is to integrate the scopes of the different categories of the PBAE, creating new mandatory and complementary parameters for them.

The National Commission of the PBAE may invite other representatives from other public and private entities when it deems necessary.

a. Prepare the annual work program, which must be approved by consensus of the Commission or, failing that, by simple majority.

b. Establish a schedule of meetings with a monthly frequency.

c. Elect, every three years, in the month of December, its organic structure, for which the following positions must be selected from within its ranks: President and Secretary. Likewise, for operational aspects, with the support of the institutions represented on the Commission, a General Coordinator may be selected. Also, internally within the Commission, and from its representative members, a Coordinator may be selected for each of the following aspects:

- Finance - Publicity and Marketing - Education and Training - Annual Events and Local Flag Raisings - Others that the Commission defines d. Evaluate, audit, follow up, and select the local committees winning the Ecological Blue Flag Award.

e. Make the adjustments that are necessary and when they are required to the parameters or procedure manuals of the various categories.

f. The opinions or decisions of the CNPBAE shall be unappealable in matters of awarding accolades.

The formation of the different Local Committees for each category will be defined according to Annex A.

• a)Meet at least once a month, keeping a book of minutes where the main agreements, improvements, and educational activities carried out will be recorded. In the month of December of each year, a report of these activities will be presented to the CNPBAE.
• b)The CLPBAE must appoint a coordinator, who will be the direct contact with the CNPBAE and the Technical Work Teams (ETPBAE).
• c)In the case of Educational Centers, the local committee must have the approval of the Director of the institution.
• d)In the first session of the year, the annual work program must be prepared and sent to the CNPBAE.
• e)The local committee is responsible for designating those responsible for each activity to be carried out and for following up on them.
• f)The committee will keep the CNPBAE informed of all the activities carried out during its evaluation period.
• g)The committee will ensure compliance with each of the program's evaluation parameters.
• h)The committee must prepare a final self-evaluation report in the month of December of each year, following the order of the scheme established by the commission for each of the 8 categories. Moreover, in the preparation of the final report, only the members of the registered local committee may participate.
• i)In the interest of democratization and greater participation of the inhabitants of a place in the PBAE, the same committee will not be allowed to register to participate in more than four categories.
• j)The same member or representative may not have interference or participation in more than four local committees of the same category within the PBAE.
• k)The committee must be willing to be audited by the national commission on the self-evaluation proposed.
• l)Appoint two representatives to attend the awards ceremony organized by the CNPBAE, when the committee is awarded.
• m)In the case of Educational Centers, form a commission of teachers and students of up to 5 people to attend the awards ceremony.
• n)The committee will be responsible for organizing the event to raise the Ecological Blue Flag in its registered locality.
• o)Construct the flagpole where the Ecological Blue Flag will be placed, locating it in the public or private area of greatest concurrence or relevance for the winning site and ensure that it remains constantly flying.
• p)The Committee will cover the cost of a new flag, when the one delivered by the CNPBAE suffers deterioration or is stolen.
• q)In the case of Educational Centers, when the local committee becomes a recipient of the Ecological Blue Flag, it will be automatically registered for the next year, informing the CNPBAE if there are changes within the integration of the Committee.
• r)Others aimed at strengthening the committees and the PBAE, derived from the present regulation.

The flag or award will have a length of 1.50 meters and a width of 1 meter.

(attached). The minimum score and the grading of stars on the award for each category of the PBAE are presented in Annex C. (attached).

Said resources must be communicated to the National Commission by the representative of each entity in the month of September of each year. Likewise, public and private sector agencies, within the respective legal framework, may contribute to the extent of their legal and material possibilities, and without prejudice to the fulfillment of their own objectives, in all those activities developed for the strengthening and development of the Ecological Blue Flag Program.

This manual will be reviewed at least every 4 years by the CNPBAE, to determine if it is appropriate to make operational changes to streamline and modernize the program. The procedure manuals for each category will be those in force, approved, and published by the National Commission of the Ecological Blue Flag Program.

- Three stars (AAA): Complies with what is indicated for two stars and has:

- Public showers and sanitary services.

- Maps identifying special zones and tourist services.

- A Regulatory Plan (Plan Regulador) or Management Plan in the case of Conservation Areas and comfortable and safe access for people with disabilities, public showers, and sanitary services.

- Four stars (AAAA): Complies with what is indicated for three stars and has:

- Separation and recycling of solid waste.

- Actions to clean breeding sites of disease-transmitting vectors.

- Has permanent surveillance (lifeguards) and rescue services.

- Has a local Emergency Committee.

- According to Law No. 6043 on the Maritime Terrestrial Zone, has a Regulatory Plan (Plan Regulador) that must be published in the official gazette La Gaceta and/or a Management Plan approved by MINAET in the case of public or private Protected Natural Areas. Likewise, it must contemplate those cases of exception that should be approved by the competent authority.

- Separates and recycles solid waste, has permanent surveillance and rescue services, has a Local Emergency Committee, and participates in the "Sanitary Quality Seal" program, promoted by AyA.

- Five stars (AAAAA): Complies with what is indicated for three stars and has:

- Spaces for vehicles of people with disabilities.

- Special ramps or synthetic, portable mats for access to the beach, that is, up to the berm.

- Tourist Police service.

- Participation in the Sanitary Quality Seal Program.

Communities - One star (A): If the value obtained is between 90% and 100%.

90 points - Two stars (AA): If the evaluation obtained is 100% and the aqueduct participates in the "Sanitary Quality Seal program promoted by AyA".

- Three stars (AAA): Complies with what is indicated for two stars and carries out actions to clean breeding sites of disease-transmitting vectors.

- Four stars (AAAA): Complies with what is indicated for three stars and has an emergency response plan and an urban development program for a minimum of five years.

Protected Natural Areas - One star (A): If the value obtained is between 90% and 100%.

90 points - Two stars (AA): that natural reserve that obtains 100% and, additionally, has an emergency response plan and community cooperation programs for tree planting.

- Three stars (AAA): that natural reserve that obtains what is required for two stars, plus a planned development of the protected natural area for the future and with community outreach actions under the concept of Social Responsibility aimed at communities and educational centers.

Hydrological Micro-basins - One star (A): If the value obtained is between 90% and 100%.

90 points - Two stars (AA): If the evaluation obtained is 100% and the following is in place: that which obtains 100% of the score, plus campaigns so that farmers use organic fertilizers or reduce the use of pesticides and carry out practices to reduce soil erosion.

- Three stars (AAA): Complies with what is indicated for two stars and additionally, within the micro-basin, participates in at least three categories of the Ecological Blue Flag Program: Educational Centers, Communities, Protected Natural Areas, Actions to Confront Climate Change, and Beaches.

- Four stars (AAAA): Complies with what is indicated for three stars and additionally complies with the presentation of biological and physical-chemical analyses of the water quality of its transect; likewise, that transect that supplies quality potable water to downstream communities.

Actions to Confront Climate Change Mitigation - One star (A): If the value obtained is between 90% and 100%.

90 points - Two stars (AA): If the evaluation obtained is 100% and the following is in place: a project for the adequate management of solid waste is being executed, which contemplates: Rejection, Reduction, Reuse, and Recycling of the same.

- Three stars (AAA): Complies with what is indicated for two stars and that they are also implementing relevant institutional programs, such as: CST with at least three leaves, ISO 9001, ISO 14001, Risk Management Plans, the Sanitary Quality Seal Program (Programa Sello de Calidad Sanitaria) (in any of its different varieties), or their participation in another category of the PBAE.

- Four stars (AAAA): Complies with what is indicated for three stars and that they also determine the "Carbon Footprint" of the organization and its respective mitigation and adaptation.

- Five stars (AAAAA): Complies with what is indicated for four stars and that they have also already been certified as Carbon Neutral.

Actions to Address Climate Change Adaptation - One star (A): If the value obtained is between 90% and 100%.

90 points - Two stars (AA): If the evaluation obtained is 100% and it complies with the Reuse: of its by-products and harvest residues, or organic waste (animal or vegetable).

- Three stars (AAA): Complies with what is indicated for two stars and that it also carries out the planting of 1000 trees per year.

- Four stars (AAAA): Complies with what is indicated for three stars and they also cooperate with at least one Educational Center that participates in the Ecological Blue Flag Program (Programa Bandera Azul Ecológica) in the category of Educational Centers, so that they carry out good agricultural practices.

Climate Neutral Community - Award with one star (A): The union of local committees that achieve a score of 100 and reach a compensation of at least 20% of greenhouse gas emissions (EGEI).

90 points - Award with two stars (AA): The union of local committees that achieves a compensation of 40% of EGEI.

- Award with three stars (AAA): The union of local committees that achieves a compensation of 50% of EGEI.

- Award with four stars (AAAA): The union of local committees that achieves a compensation of 70% of EGEI.

- Award with five stars (AAAAA): The union of local committees that achieves a compensation of 90% of EGEI.

- Award with six stars (AAAAAA): The union of local committees that achieves a compensation of 100% of EGEI.

Community Health Promotion - Ecological Blue Flag Award with 1 star: is that community local committee that obtains a score between 90 and 100 points in the mandatory parameters.

90 points - Ecological Blue Flag Award with 2 stars: is that community local committee that obtains 100 points in the mandatory parameters and carries out a reforestation campaign.

- Ecological Blue Flag Award with 3 stars: is that local committee that manages to comply with the parameters of point A and B, plus a 10% reduction in annual diarrhea cases or rates, compared to the previous year.

- Ecological Blue Flag Award with 4 stars: for the local committee that complies with the 3 stars and also reduces dengue and malaria cases by 20% annually.

Posteriormente, la iniciativa recibió el apoyo y se incorporaron otras instituciones a saber: Ministerio de Educación Pública (MEP), Asociación Red Costarricense de Reservas Privadas, Instituto Costarricense de Electricidad (ICE), Ministerio de Agricultura y Ganadería (MAG) y la Caja Costarricense del Seguro Social (CCSS). Estas dos últimas instituciones se integran mediante este Decreto.

Asimismo, se hace necesario integrar en los aspectos normativos más relevantes, los decretos ejecutivos que regulan el PBAE. Por tanto,

La finalidad de este decreto es integrar los alcances de las diferentes categorías del PBAE, creando nuevos parámetros obligatorios y complementarios de las mismas.

La Comisión Nacional del PBAE podrá invitar otros representantes de otras entidades públicas y privadas cuando lo considere necesario.

a. Preparar el programa de trabajo anual, el cual debe ser aprobado por consenso de la Comisión o en su lugar mayoría simple.

b. Establecer el cronograma de reuniones con una frecuencia mensual.

c. Elegir con una frecuencia de cada tres años, en el mes de diciembre su estructura orgánica, para lo cual se deben seleccionar en su seno los siguientes puestos Presidente y Secretario. Asimismo para los aspectos operativos, con el apoyo de las instituciones representadas en la Comisión, podrá seleccionarse un Coordinador General. También, a lo interno de la Comisión, y de los miembros representantes de la misma, podrá seleccionarse un Coordinador para cada uno de los siguientes aspectos:

- Finanzas - Publicidad y Mercadeo - Educación y Capacitación - Actos anuales e Izas Locales - Otros que defina la Comisión d. Evaluar, auditar, dar seguimiento y seleccionar los comités locales ganadores del Galardón Bandera Azul Ecológica.

e. Realizar los ajustes que sean necesarios y cuando sean requeridos a los parámetros o manuales de procedimiento de las diversas categorías.

f. Los dictámenes o decisiones de la CNPBAE serán inapelables en materia de otorgamiento de galardones.

La conformación de los diferentes Comités Locales de cada categoría se definirá de acuerdo con el Anexo A.

• a)Sesionar al menos una vez al mes, llevando un libro de actas donde se anotarán los principales acuerdos, mejoras y actividades educativas realizadas. En el mes de diciembre de cada año, se presentará un informe de estas actividades a la CNPBAE.
• b)El CLPBAE deberá nombrar un coordinador, quien será el contacto directo con la CNPBAE y los Equipos Técnicos de Trabajo (ETPBAE).
• c)En el caso de los Centros Educativos, el comité local debe contar con el visto bueno del Director de la institución.
• d)En la primera sesión del año se debe preparar el programa de trabajo anual y enviarlo a la CNPBAE.
• e)Le corresponde al comité local designar responsables de cada actividad a realizar y dar seguimiento a las mismas.
• f)El comité mantendrá informada a la CNPBAE de todas las actividades realizadas durante su periodo de evaluación.
• g)El comité velará por el cumplimiento de cada uno de los parámetros de evaluación del programa.
• h)El comité deberá preparar un informe final de auto-evaluación en el mes de diciembre de cada año, siguiendo el orden del esquema establecido por la comisión para cada una de las 8 categorías. Además, en la elaboración del informe final, solamente podrán participar los integrantes del comité local inscrito.
• i)En aras de una democratización y mayor participación de los habitantes de un lugar en el PBAE, no se permitirá que un mismo comité se inscriba para participar en más de cuatro categorías.
• j)No podrá tener injerencia o participación un mismo miembro o representante, en más de cuatro comités locales de una misma categoría dentro del PBAE.
• k)El comité deberá estar dispuesto al auditoraje de la comisión nacional sobre la auto-evaluación planteada l) Nombrar dos representantes que asistan, al acto de premiación organizado por la CNPBAE, cuando el comité sea galardonado m) En el caso de los Centros Educativos, conformar una comisión con docentes y estudiantes de hasta 5 personas para asistir al acto de premiación.
• n)El comité será el responsable de organizar el acto para izar la Bandera Azul Ecológica en su localidad inscrita.
• o)Construir el asta donde será colocada la Bandera Azul Ecológica, ubicándola en la zona pública o privada de mayor concurrencia o relevancia para el sitio ganador y velar porque la misma se mantenga ondeando constantemente.
• p)El Comité cubrirá el costo de una nueva bandera, cuando la entregada por la CNPBAE sufra deterioro o sea robada.
• q)En caso de Centros Educativos, cuando el comité local se hace acreedor de la Bandera Azul Ecológica, quedará automáticamente inscrito para el próximo año, informando a la CNPBAE si existen cambios dentro de la integración del Comité.
• r)Otras dirigidas al fortalecimiento de los comités y el PBAE, que se deriven de la presente regulación

La bandera o galardón tendrá un largo de 1.50 metros y un ancho de 1 metro.

(adjunto). La nota mínima y la gradación de las estrellas en el galardón para cada categoría del PBAE, se presenta en el Anexo C. (adjunto)

Dichos recursos deben ser comunicados a la Comisión Nacional mediante el representante de cada entidad en el mes de setiembre de cada año. Asimismo las dependencias del sector público y privado, dentro del marco legal respectivo, podrán contribuir en la medida de sus posibilidades jurídicas y materiales, y sin perjuicio del cumplimiento de sus propios objetivos, en todas aquellas actividades que se desarrollen para el fortalecimiento y desarrollo del Programa Bandera Azul Ecológica.

Este manual será revisado al menos cada 4 años por la CNPBAE, para determinar si procede realizar cambios operativos que permitan agilizar y modernizar el programa. Los manuales de procedimientos de cada categoría serán los vigentes, aprobados y publicados por la Comisión Nacional del Programa Bandera Azul Ecológica.

- Señalización de oleaje fuerte y corrientes marinas, así como animales peligrosos para los turistas nacionales e internacionales, en caso de que existan - Vigilancia ( salvavidas) y socorrismo ( labor de primeros auxilios) en fines de semana y temporadas altas - Señalización de corrientes marinas en caso de que existan y vigilancia y socorrismo en temporadas altas.

- Tres estrellas (AAA): Cumple con lo indicado para dos estrellas y se tiene:

- Duchas y servicios sanitarios públicos.

- Mapas de identificación de zonas especiales y servicios Turísticos.

- Plan Regulador o Plan de Manejo en caso de Áreas de Conservación y accesos cómodos y seguros para personas con discapacidad, duchas y servicios sanitarios públicos.

- Cuatro estrellas (AAAA): Cumple con lo indicado para tres estrellas y se tiene:

- Separación y reciclaje de residuos sólidos - Acciones de limpieza de Criaderos de vectores transmisores de enfermedades.

- Cuente con Vigilancia (salvavidas) y socorrismo en forma permanente.

- Cuente con un Comité de Emergencia local.

- Según la ley Nº 6043 de la Zona Marítima Terrestre, cuente con el Plan Regulador que debe estar publicado en el diario oficial la Gaceta y/o un Plan de manejo aprobado en MINAET en caso de Áreas Naturales Protegidas públicas o privadas. Asimismo se debe contemplar aquellos casos de excepción que deberían estar aprobados por el ente competente.

- Separación y reciclaje de desechos sólidos, cuenta con vigilancia y socorrismo de forma permanente, cuenta con Comité de Emergencia Local y tenga participación en el programa "Sello de Calidad Sanitaria"; impulsado por el AyA.

- Cinco estrellas (AAAAA): Cumple con lo indicado para tres estrellas y se tiene:

- Espacios para vehículos de personas discapacitadas - Rampas especiales o alfombras sintéticas y portátiles para acceso a la playa, es decir hasta la berma.

- Servicio de Policía Turística.

- Participación en el Programa Sello de Calidad Sanitaria.

Comunidades - Una estrella (A): Si el valor obtenido está entre 90% y 100%.

90 puntos - Dos estrellas (AA): Si la evaluación obtenida es del 100% y se tiene participación del acueducto en el programa "Sello de Calidad Sanitaria impulsado por el AyA".

- Tres estrellas (AAA): Cumple con lo indicado para dos estrellas y se hagan acciones de limpieza de criaderos de vectores transmisores de enfermedades.

- Cuatro estrellas (AAAA): Cumple con lo indicado para tres estrellas y se tenga un plan de atención de emergencias y un programa de desarrollo urbano para un mínimo de cinco años plazo.

Centros educativos del nivel preescolar, primaria y secundaria:

Espacios Naturales Protegidos - Una estrella (A): Si el valor obtenido está entre 90% y 100%.

90 puntos - Dos estrellas (AA): aquella reserva natural que obtenga un 100% y además, cuente con un plan de atención de emergencias y programas de cooperación comunal de siembra de árboles.

- Tres estrellas (AAA): aquella reserva natural que obtenga lo de las dos estrellas, más un desarrollo planificado del espacio natural protegido a futuro y con acciones de proyección comunal bajo el concepto de Responsabilidad Social dirigida a comunidades y centros educativos.

Microcuencas Hidrológicas - Una estrella (A): Si el valor obtenido está entre 90% y 100%.

90 puntos - Dos estrellas (AA): Si la evaluación obtenida es del 100% y se tiene: aquella que obtenga un 100% del puntaje, más campañas para que los agricultores utilicen abonos orgánicos o reduzcan el uso de plaguicidas y realicen prácticas para reducir la erosión de suelos.

- Tres estrellas (AAA): Cumple con lo indicado para dos estrellas y además que dentro de la micro cuenca se participe en al menos tres categorías del Programa Bandera Azul Ecológica: Centros Educativos, Comunidades, Espacios Naturales Protegidos, Acciones para Enfrentar el Cambio Climático y Playas.

- Cuatro estrellas (AAAA): Cumple con lo indicado para tres estrellas y además cumpla con la presentación de los análisis biológicos y físicos químicos de la calidad de agua de su transepto; igualmente aquel transepto que abastezca de agua potable de calidad a comunidades aguas abajo.

Acciones para enfrentar el Cambio Climático Mitigación - Una estrella (A): Si el valor obtenido está entre 90% y 100%.

90 puntos - Dos estrellas (AA): Si la evaluación obtenida es del 100% y se tiene: en ejecución un proyecto de manejo adecuado de residuos sólidos, que contemple: Rechazo, Reducción, Reutilización y Reciclaje de los mismos.

- Tres estrellas (AAA): Cumple con lo indicado para dos estrellas y que además, estén aplicando programas institucionales de relevancia, tales como: CST con al menos tres hojas, ISO 9001, ISO 14001, Planes de Gestión de Riesgo, Programa Sello de Calidad Sanitaria (en alguna de sus diferentes variedades), o su participación en otra categoría del PBAE.

- Cuatro estrellas (AAAA): Cumple con lo indicado para tres estrellas y que además, determinen la "Huella de Carbono" de la organización y su respectiva mitigación y adaptación.

- Cinco estrellas (AAAAA): Cumple con lo indicado para cuatro estrellas y que además, ya se han certificado con Carbono Neutro.

Acciones para enfrentar el Cambio Climático Adaptación - Una estrella (A): Si el valor obtenido está entre 90% y 100%.

90 puntos - Dos estrellas (AA): Si la evaluación obtenida es del 100% y cumpla con la Reutilización: de sus sub-productos y residuos de la cosecha, o desechos orgánicos (animal o vegetal).

- Tres estrellas (AAA): Cumple con lo indicado para dos estrellas y que además realice la siembra de 1000 árboles al año.

- Cuatro estrellas (AAAA): Cumple con lo indicado para tres estrellas y además cooperen con al menos un Centro Educativo que participante del Programa Bandera Azul Ecológica en la categoría de Centros Educativos, para que realicen buenas prácticas agropecuarias.

Comunidad Clima Neutral - Galardón con una estrella (A): La unión de comités locales que logren un puntaje de 100 y alcancen una compensación de al menos un 20% de emisiones de gases de efecto invernadero (EGEI).

90 puntos - Galardón con dos estrellas (AA): La unión de comités locales que logre una compensación de un 40% de EGEI.

- Galardón con tres estrellas (AAA): La unión de comités locales que logre una compensación de un 50% de EGEI.

- Galardón con cuatro estrellas (AAAA): La unión de comités locales que logre una compensación de un 70% de EGEI.

- Galardón con cinco estrellas (AAAAA): La unión de comités locales que logre una compensación de un 90% de EGEI.

- Galardón con seis estrellas (AAAAAA): La unión de comités locales que logre una compensación de un 100% de EGEI.

Promoción de la Salud Comunitaria - Galardón Bandera Azul Ecológica con 1 estrella: es aquel comité local comunitario que obtenga una nota entre 90 y 100 puntos en los parámetros obligatorios.

90 puntos - Galardón Bandera Azul Ecológica con 2 estrellas: es aquel comité local comunitario que obtenga 100 puntos en los parámetros obligatorios y realice una campaña de reforestación.

- Galardón Bandera Azul Ecológica con 3 estrellas: es aquel comité local que logre cumplir con los parámetros del punto A y B, más la disminución de un 10% de los casos o tasas de diarreas anuales, con respecto al año anterior.

- Galardón Bandera Azul Ecológica con 4 estrellas: para el comité local que cumpla con las 3 estrellas y además disminuya los casos de dengue y malaria en un 20% anual.
