across the entirety of the text - Complete Text of Norm 052 Reconsiders declarations for the coastal front of the cantons of Nicoya, Hojancha, and Garabito Complete Text of record: F88D9 COSTA RICAN TOURISM INSTITUTE COMMUNICATION OF AGREEMENT OF THE BOARD OF DIRECTORS SJD-052-2014 In regular session of the Board of Directors N° 5830, article 5, subsection V, held on February 11, 2014, the following agreement was adopted, which reads verbatim:

IT IS AGREED:

• A)To accept the technical recommendation contained in official communication N° MPD-P-004-2014, prepared by the Macroprocess of Planning and Development, regarding the Procedure for conducting the Tourism or Non-Tourism Declaration in the Maritime-Terrestrial Zone MPD-PT-FPP-06, for the cantons of Nicoya, Hojancha, and Garabito, province of Guanacaste and Puntarenas respectively, which establishes that in accordance with the authority granted in Article 27 of the Maritime-Terrestrial Zone Law N° 6043, it addresses the request of the Municipality of Garabito, according to Council Agreement of regular session N° 174, article VI, subsection B, held on August 28, 2013, wherein it requests "to carry out a reconsideration of the declarations of tourism interest for the entire coast of the canton of Garabito, as part of the requirements for the formulation and approval of coastal regulatory plans," and given that as part of the planning process carried out by this Institute in support of the Municipalities of Nicoya and Hojancha, it proceeded to reconsider the declarations for the coastal front of both cantons, considering that to date the respective classifications and certifications of State Natural Heritage are available.
• B)To declare as being of tourism suitability the sectors of the maritime- terrestrial zone located on the coastal front of the canton of Garabito and zones adjacent to the mangroves, which are located from the sector of Punta Mala to the mouth of the Río Tusubres, between the following CRTM 05 coordinates:

1078185.2246 N - 430781.72 E 1054893.8811 N - 438971.2202 E C) To declare as being of non-tourism suitability the coastal sectors of the maritime- terrestrial zone on the coastal front of the canton of Garabito and zones adjacent to the mangroves, which are located from the mouth of the Río María Jesús to Punta Mala, between the CRTM 05 coordinates:

1090799.6392 N - 423574.1576 E 1078185.2246 N - 430781.72 E D) To declare as being of tourism suitability the sectors of the maritime- terrestrial zone located on the coastal front of the canton of Nicoya and zones adjacent to the mangroves, from Punta División located at the boundary between Nicoya and Santa Cruz, to the Boca de la Quebrada Dormilona at the boundary between Nicoya and Hojancha, contained between the CRTM 05 coordinates:

1104851.913 N - 313117.466 E 1091939.131 N - 336080.41 E E) To declare as being of tourism suitability the sectors of the maritime- terrestrial zone located on the coastal front of the canton of Hojancha and zones adjacent to the mangroves, from the Boca de la Quebrada Dormilona located at the boundary between Hojancha and Nicoya, to the Ría del Río Ora, contained between the CRTM 05 coordinates:

1091939.131 N - 336080.41 E 1092188.045 N - 340483.512 E F) To exclude from this agreement all those coastal sectors that the Central Pacific Conservation Area and the Tempisque Conservation Area have classified and certified as State Natural Heritage, as well as those sectors that in the future are reclassified by said entities with the Methodology established for that purpose.

• G)To exclude from this agreement the sectors that are affected by the provisions of articles 6 and 73 of the Maritime-Terrestrial Zone Law.
• H)To repeal any and all declarations made in previous years for the cantons of Garabito, Nicoya, and Hojancha.
• I)To instruct the Macroprocess of Planning and Development to communicate this Agreement to the interested parties and to manage its corresponding officialization in the Official Gazette La Gaceta, as established in article 27 of the Maritime-Terrestrial Zone Law.

en la totalidad del texto - Texto Completo Norma 052 Reconsidera declaratorias del frente costero de los cantones de Nicoya, Hojancha y Garabito Texto Completo acta: F88D9 INSTITUTO COSTARRICENSE DE TURISMO COMUNICACIÓN DE ACUERDO DE JUNTA DIRECTIVA SJD-052-2014 En sesión ordinaria de Junta Directiva N° 5830, artículo 5, inciso V, celebrada el día 11 de febrero del 2014, se tomó el siguiente acuerdo que textualmente dice:

SE ACUERDA:

• A)Acoger la recomendación técnica contenida en el oficio N° MPD-P-004-2014, elaborado por el Macroproceso de Planeamiento y Desarrollo, en torno al Procedimiento para practicar la Declaratoria Turística o No Turística en la Zona Marítimo Terrestre MPD-PT-FPP-06, de los cantones de Nicoya, Hojancha y Garabito, provincia de Guanacaste y Puntarenas respectivamente, en donde se establece que de conformidad con la potestad dada en el Artículo 27 de la Ley de la Zona Marítimo Terrestre N° 6043, atiende solicitud de la Municipalidad de Garabito, según Acuerdo de Concejo de sesión ordinaria N° 174, artículo VI inc. B, celebrada el 28 de agosto del 2013, donde solicita "realizar una reconsideración de las declaratorias de interés turístico de la totalidad de la costa del cantón de Garabito, como parte de los requisitos para la formulación y aprobación de planes reguladores costeros", y en vista que como parte del proceso de planificación que realiza este Instituto en apoyo a las Municipalidades de Nicoya y Hojancha, se procedió a reconsiderar las declaratorias del frente costero de ambos cantones, considerando que a la fecha se cuenta con las respectivas clasificaciones y certificaciones de Patrimonio Natural del Estado.
• B)Declarar de aptitud turística los sectores de zona marítimo terrestre localizadas en el frente costero del cantón de Garabito y zonas aledañas a los manglares, que se localizan desde el sector de Punta Mala hasta la desembocadura del Río Tusubres, entre las siguientes coordenadas CRTM 05:

1078185.2246 N - 430781.72 E 1054893.8811 N - 438971.2202 E C) Declarar de aptitud no turística los sectores costeros de zona marítimo terrestre en el frente costero del cantón de Garabito y zonas aledañas a los manglares, que se localizan desde la desembocadura del Río María Jesús hasta Punta Mala, entre las coordenadas CRTM 05:

1090799.6392 N - 423574.1576 E 1078185.2246 N - 430781.72 E D) Declarar de aptitud turística los sectores de zona marítimo terrestre localizadas en el frente costero del cantón de Nicoya y zonas aledañas a los manglares, desde Punta División ubicada en el límite entre Nicoya y Santa Cruz, hasta la Boca de la Quebrada Dormilona en el límite entre Nicoya y Hojancha, contenida entre las coordenadas CRTM 05:

1104851.913 N - 313117.466 E 1091939.131 N - 336080.41 E E) Declarar de aptitud turística los sectores de zona marítimo terrestre localizadas en el frente costero del cantón de Hojancha y zonas aledañas a los manglares, desde la Boca de la Quebrada Dormilona ubicada en el límite entre Hojancha y Nicoya, hasta la Ría del Río Ora, contenida entre las coordenadas CRTM 05:

1091939.131 N - 336080.41 E 1092188.045 N - 340483.512 E F) Excluir de este acuerdo, todos aquellos sectores costeros que el Área de Conservación de Pacífico Medio y Área de Conservación Tempisque, hayan clasificado y certificado como Patrimonio Natural del Estado, así como aquellos sectores que a futuro se reclasifiquen por dichas entidades con la Metodología establecida para tal propósito.

• G)Excluir de éste acuerdo, los sectores que se encuentren afectados por lo establecido en los artículos 6 y 73 de la Ley de la Zona Marítimo Terrestre.
• H)Derogar toda aquella declaratoria que se haya practicado en años anteriores para los cantones de Garabito, Nicoya y Hojancha.
• I)Instruir al Macroproceso Planeamiento y Desarrollo comunicar el presente Acuerdo a los interesados y gestionar su correspondiente oficialización en el Diario Oficial La Gaceta, según lo establece el artículo 27 de la Ley de la Zona Marítimo Terrestre.
