in the entirety of the text - Complete Text of Norm 38098 Declaration of sanitary emergency in the Asentamiento Triángulo Solidario, located on the dividing line between the cantons of Goicoechea and Tibás due to problems related to the disposal of blackwater, foul odors, and contamination of rivers Complete Text of Record: F5448 Nº 38098-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF HEALTH In use of the powers conferred upon them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; 28 of Law No. 6227 of May 2, 1978 "Ley General de Administración Pública"; 1, 2, 4, 7, 264, 265, 266, 267, and subsequent and concordant articles of Law No. 5395 of October 30, 1973 "Ley General de Salud".
I.-That the health of the population is a public-interest asset protected by the State, with the Executive Branch, through the Ministry of Health, being responsible for the regulation, planning, and coordination of all public and private activities related to health.
II.-That the governing competence of the Ministry of Health must lead to the articulation, strengthening, and modernization of policies, legislation, plans, programs, and projects, as well as to the mobilization and synergy of social, institutional, and community forces that impact the determinants of health in the population.
III.-That the State, through its institutions and other entities of the Public Administration, is obligated to satisfy an essential public service, such as the health of the national population.
IV.-That the authorities of the Ministry of Health have detected in the Asentamiento Triángulo Solidario, located on the dividing line between the cantons of Goicoechea and Tibás, problems related to the disposal of blackwater (aguas negras), foul odors, and contamination of nearby rivers, as well as conditions of uninhabitability, unhealthiness, and ruinousness existing at the site.
V.-That through Resolution No. 2013-007262, of nine hours five minutes on May thirty-first, two thousand thirteen, the Constitutional Court (Sala Constitucional) has ordered that the problems related to the disposal of blackwater (aguas negras), foul odors, and contamination of nearby rivers be resolved, in order to maintain a healthy and balanced environment for the inhabitants of the Asentamiento Triángulo Solidario.
VI.-That it is the responsibility of this Ministry to address the aforementioned situation, since it represents a risk situation for the health of the inhabitants of the Asentamiento Triángulo Solidario, located on the dividing line between the cantons of Goicoechea and Tibás.
VII.-That the right to health of individuals is a fundamental right of immediate application and its protection is an obligation of the State, an unavoidable duty.
VIII.-That the legal norms establishing the competence of the Ministry of Health in health matters enshrine implicit sovereign powers so that it may issue all legal measures necessary to confront and resolve sanitary emergency states.
IX.-That public authorities are obligated to apply the precautionary principle (principio precautorio) in sanitary matters, meaning they must take the preventive measures necessary to avoid serious or irreparable damage to the health of the inhabitants.
X.-That technical and administrative agility must be provided to seek solutions to the problems faced by the inhabitants of the Asentamiento Triángulo Solidario.
XI.-That the foregoing facts constitute an emergency situation in health matters. Therefore, They Decree:

I.-Que la salud de la población es un bien de interés público tutelado por el Estado, correspondiéndole al Poder Ejecutivo, por medio del Ministerio de Salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a la salud.
II.-Que la competencia rectora del Ministerio de Salud debe conducir a la articulación, fortalecimiento y modernización de las políticas, la legislación, los planes, programas y proyectos, así como a la movilización y sinergia de las fuerzas sociales, institucionales y comunitarias que impactan los determinantes de la salud en la población.
III.-Que el Estado, a través de sus instituciones y demás entes de la Administración Pública, se encuentran en la obligación de satisfacer un servicio público esencial, como lo es la salud de la población nacional.
IV.-Que las autoridades del Ministerio de Salud, han detectado en el Asentamiento Triángulo Solidario, ubicado en la línea divisoria entre los cantones de Goicoechea y Tibás, problemas relacionados con la disposición de aguas negras, malos olores y contaminación de ríos aledaños, asimismo condiciones de inhabitabilidad, insalubridad y ruinosidad, existentes en el lugar.
V.-Que mediante Resolución N° 2013-007262, de las nueve horas cinco minutos del treinta y uno de mayo del dos mil trece, la Sala Constitucional ha ordenado solucionar los problemas relacionados con la disposición de aguas negras, malos olores y contaminación de ríos aledaños, a fin de mantener un ambiente sano y equilibrado para los habitantes del Asentamiento Triángulo Solidario.
VI.-Que es competencia de este Ministerio, abordar la situación mencionada, ya que representa una situación de riesgo para la salud de los habitantes del Asentamiento Triángulo Solidario, ubicado en la línea divisoria entre los cantones de Goicoechea y Tibás.
VII.-Que el derecho a la salud de las personas es un derecho fundamental de aplicación inmediata y su tutela obligada por parte del Estado, un deber ineludible.
VIII.-Que las normas legales que establecen la competencia del Ministerio de Salud en materia de salud, consagran potestades de imperio implícitas para que aquel pueda dictar todas las medidas legales que fueren necesarias para enfrentar y resolver los estados de emergencia sanitarios.
IX.-Que las autoridades públicas están obligadas a aplicar el principio precautorio en materia sanitaria en el sentido de que deben tomar las medidas preventivas que fueren necesarias para evitar daños graves o irreparables a la salud de los habitantes.
X.-Que se debe brindar agilidad técnica y administrativa para buscar soluciones a la problemática que tienen los habitantes del Asentamiento Triángulo Solidario.
XI.-Que los hechos anteriores configuran una situación de emergencia en materia de salud. Por tanto,
