2526-2013: Motion presented by Mr. José Rafael Huertas Guillén, Municipal Mayor.
Considering that:
- a)That Article 50 of the Political Constitution recognizes the right of every person to enjoy a healthy and ecologically balanced environment, as well as the duty of the State to guarantee, defend, and preserve said right.
- b)That in accordance with Article 169 of the Political Constitution, the Municipality is responsible for the administration of local interests and services.
- c)That in accordance with Law for the Comprehensive Management of Waste No. 8839 (Ley para la Gestión Integral de Residuos Nº 8839), Municipalities are responsible for the Comprehensive Management of Solid Waste in their canton.
- d)That the Solid Waste Tariff Regulation (Reglamento Tarifario de Desechos Sólidos) has been designed for the knowledge and approval of the Municipal Council, with the purpose of being able to update the rates for the Garbage Collection Service (Servicio de Recolección de Basura).
Therefore, he motions to: Approve the Solid Waste Tariff Regulation (Reglamento Tarifario de Desechos Sólidos) so that the Municipal Administration and this Council can carry out the respective procedure to update the Garbage Collection Rate (Tasa por Recolección de Basura), publish it in La Gaceta, and apply it according to the Municipal Code (Código Municipal).
With dispensation from the Committee Procedure, declare it approved and final, apply Article 45 of the Municipal Code (Código Municipal).
SOLID WASTE TARIFF REGULATION (REGLAMENTO TARIFARIO DE DESECHOS SÓLIDOS) The Municipality of Oreamuno (Municipalidad de Oreamuno), in use of the powers conferred by the Municipal Code (Código Municipal), the Political Constitution, and the laws of the Republic of Costa Rica, establishes the following Regulation for the charging of collection and final disposal of traditional solid waste, by different commercial categories. As well as, for the charging of the final disposal of bulky solid waste.
