in the entirety of the text - Complete Text of Norm 37724 Renders without effect Executive Decree No. 36146 "Declares of Public Utility for the interests of the State the Asociación Conservacionista Isaías Retana Arias" Complete Text record: F011F No. 37724-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Ley de Asociaciones, and articles 27 and following of its Reglamento.

I.-That article 32 of Ley de Asociaciones No. 218 of August eight, nineteen thirty-nine and its amendments, confers upon the Executive Branch the power to declare of Public Utility simple associations, federated or confederated, whose development and activities are particularly useful for the interests of the State and which thereby contribute to addressing a social need.

II.-That the ASOCIACIÓN CONSERVACIONISTA ISAÍAS RETANA ARIAS, legal identification number (cédula de persona jurídica) 3-002-200287, was registered in the Registry of Associations (Registro de Asociaciones) of the Public Registry since October thirteenth, two thousand four, under file 8408, volume 429, entry 3415. Likewise, said entity was declared of Public Utility through Executive Decree (Decreto Ejecutivo) number 36146-J of July seventh, two thousand ten.

III.-That the ASOCIACIÓN CONSERVACIONISTA ISAÍAS RETANA ARIAS requested that the benefit of Public Utility be rendered without effect, a decision taken in the Minutes of the Board of Directors meeting held on February twentieth, two thousand twelve. Given that said entity maintains, both within its bylaws and in its operations, the purposes and objectives in favor of the environment and society that served as the basis for being declared of Public Utility, as they address a social need.

IV.-That despite the continuity of said Association's functioning, through a Board of Directors Agreement it was expressly agreed to renounce the declaration of public utility granted by the Ministry of Justice and Peace, therefore it is appropriate to render without effect the administrative act (acto administrativo) through which the declaration of Public Utility was granted to the applicant Association, as well as the effects derived from said act, in accordance with article 154 of the General Law of Public Administration (Ley General de la Administración Pública).

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado y que por ello contribuyan a solventar una necesidad social.

II.-Que la ASOCIACIÓN CONSERVACIONISTA ISAÍAS RETANA ARIAS, cédula de persona jurídica 3-002-200287, se inscribió en el Registro de Asociaciones del Registro Público desde el día trece de octubre del dos mil cuatro, bajo el expediente 8408, tomo 429, asiento 3415. Asimismo, dicha entidad fue declarada de Utilidad Pública mediante el Decreto Ejecutivo número 36146-J del siete de julio del dos mil diez.

III.-Que la ASOCIACIÓN CONSERVACIONISTA ISAÍAS RETANA ARIAS, solicitó dejar sin efecto el beneficio de Utilidad Pública, decisión que fue tomada en Acta de reunión de Junta Directiva celebrada el veinte de febrero de dos mil doce. Siendo que dicha entidad mantiene tanto dentro de sus estatutos como en su operatividad, los fines y objetivos en favor del ambiente y la sociedad que sirvieron de base para ser declarada de Utilidad Pública, al solventar los mismos una necesidad social.

IV.-Que pese a la continuidad del funcionamiento de dicha Asociación, mediante Acuerdo de Junta Directiva se acordó expresamente la renuncia a la declaratoria de utilidad pública otorgada por el Ministerio de Justicia y Paz, por lo que se procedente dejar sin efecto el acto administrativo en el cual se otorgó la declaratoria Utilidad Pública a la Asociación solicitante, así como los efectos derivados de dicho acto, de conformidad con el artículo 154 de la Ley General de la Administración Pública
