in the entirety of the text - Complete Text of Regulation 36146 Declares of Public Utility for the interests of the State the Isaías Retana Arias Conservationist Association Complete Text record: F0122 N° 36146-J (This decree was rendered void by article 1 of executive decree N° 37724 of May 10, 2013) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Law, and articles 27 and following of its Regulation.
I.-That article 32 of the Associations Law No. 218 of August eight, nineteen thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility those simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and thereby contribute to addressing a social need.
II.-That the Isaías Retana Arias Conservationist Association, legal entity identification number 3-002-200287, was registered in the Associations Registry of the Public Registry since October thirteenth, two thousand four, under file number 8408.
III.-That the purposes pursued by the Association, according to article three of its Bylaws, are: "...to promote the conservation, protection, and sustainable development of the natural and human resources of the canton of Pérez Zeledón, including specifically the conservation, protection, and sustainable development of the natural and human resources of the Pedregoso River basin in this canton, as well as the creation of a regional experimental educational institution of an ecological and conservationist nature based in the canton. The specific purposes are: First: To promote in the canton of Pérez Zeledón: a) the protection of hills, wetlands, and buffer zones, b) the creation and maintenance of biological corridors, and c) the natural regeneration of areas with capacity for forest uses; Second: To develop educational projects aimed at training the population in the protection, development, enjoyment, and proper use of natural resources, both in the canton of Pérez Zeledón and specifically in the area encompassed by the Pedregoso River basin; Third: To oversee the protection, restoration, and proper use of the marine resources and basins of the Canton of Pérez Zeledón, especially the Pedregoso River basin, and to prevent their contamination; Fourth: To promote private and public refuges to protect and research the biodiversity of the canton, especially that of the Pedregoso River basin; Fifth: To promote ecological tourism in the area as an alternative and sustainable activity that involves the community; Sixth: To promote reforestation and natural regeneration projects with endemic species; Seventh: To conduct a study of the canton's resources (oriented towards comprehensive territorial planning) and subsequently a participatory planning of the canton based on this study, especially regarding the Pedregoso River basin..." IV.-That such purposes address a social need of the highest order, for which they merit the support of the Costa Rican State. Therefore,

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del ocho de agosto de mil novecientos treinta nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Conservacionista Isaías Retana Arias, cédula de persona jurídica Nº 3-002-200287, se inscribió en el Registro de Asociaciones del Registro Público desde el día trece de octubre de dos mil cuatro, bajo el III.-Que los fines que persigue la Asociación, según el artículo tercero de sus Estatutos, son: "...promover la conservación, protección y desarrollo sostenible de los recursos naturales y humanos del cantón de Pérez Zeledón, incluyendo en específico la conservación, protección y desarrollo sostenible de los recursos naturales y humanos de la cuenca del Río Pedregoso de este cantón, así como la creación de una institución educativa experimental regional de carácter ecológico y conservacionista con sede en el cantón. Los fines específicos son: Primero: Promover en el cantón de Pérez Zeledón: a) la protección de los cerros, humedales y áreas de amortiguamiento, b) la creación y mantenimiento de corredores biológicos, y c) la regeneración natural de áreas con capacidad de usos forestales; Segundo: Desarrollar proyectos de carácter educativo destinados a capacitar a la población, en la protección, desarrollo, goce y uso adecuado de los recursos naturales, tanto en el cantón de Pérez Zeledón, como en específico del área abarcada por la cuenca del Río Pedregoso; Tercero: Vigilar por la protección, restauración y uso adecuado de los recursos Maricos y cuencas del Cantón de Pérez Zeledón, y en especial la cuenca del Río Pedregoso, y evitar su contaminación; Cuarto: Fomentar refugios privados y públicos para proteger e investigar la biodiversidad del cantón, y en especial la de la cuenca del Río Pedregoso; Quinto: Promover el turismo ecológico del área como actividad alternativa y sostenible que involucre a la comunidad; Sexto: Promover proyectos de reforestación y regeneración natural con especies endémicas; Sétimo: Hacer un estudio de los recursos del cantón (orientados hacia un ordenamiento territorial integral) y después una planificación participativa del cantón basado en este estudio, en especial lo relativo a la cuenca del Río Pedregoso..." IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
