in the entirety of the text - Complete Text of Regulation 193 Establishes a closed season for the Gulf of Nicoya Complete Text of record: F14A8 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/193-2013.-Puntarenas, on the twenty-fourth day of the month of May, two thousand thirteen.

1. 1That in extraordinary session 28-2013, held on the past 17th of May, the Board of Directors adopted Agreement AJDIP/186-2013, by means of which the closed season (veda) for the Gulf of Nicoya is established, based on the presentation made by Lic. Antonio Porras Porras, Technical Director General, through official communication DGT-034-05-2013, which was based on the following considerations:

i- That through the present official communication, the recommendation of the Closed Season Commission (Comisión de Vedas) is submitted for the knowledge and analysis of the Board of Directors, for the implementation of the closed season in the Gulf of Nicoya, corresponding to the year 2013, in accordance with what was agreed in Record 03-2013 of the National Closed Season Commission (Comisión Nacional de Vedas).

ii- That after discussing the different proposals for the closed season for the year 2013 and considering the inputs provided by small-scale fishing organizations and the semi-industrial and longline sector, it is recommended that the closed season for the Gulf of Nicoya be established, if deemed pertinent, under the following terms and conditions:

A-The closed season zone for both small-scale commercial fishers and Tourist and Sport Fishing, shall be in the area defined by an imaginary line that goes from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Faro de la Isla Negritos out (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inland to the mouth of the Tempisque River and this fishing prohibition runs from July 1 to September 30, both dates inclusive.

B-A closed season is established for Semi-industrial shrimp trawl and sardine purse seine (cerco) fishing in the area comprised by an imaginary line that goes from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inland to the mouth of the Tempisque River, from July 1, 2013 until October 31, 2013. During the months of July, August, and September, sardine fishing with a purse seine net (red de cerco) is permitted in the area comprised by an imaginary line that goes from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Faro de la Isla Negritos out (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines to the Cruise Ship Pier (Muelle de Cruceros) in Puntarenas, provided that said fishing is carried out only by one sardine vessel, only one day per week, making a single landing (descarga) during the authorized day, which must be duly supervised by INCOPESCA and the product of the landing must be destined exclusively for sale for use as bait for the national fishing fleet. In the month of October, sardine fishing will not be permitted in the closed season area because it coincides with a reproductive peak of this species.

1. 2That having analyzed and reviewed the above Agreement, the Messrs. Directors consider it convenient and necessary to exclude sport and tourist fishing from the closed season, given the particularities and absolutely different conditions regarding commercial fishing, in association and based above all on the fishery resource that is targeted for closure (vedar), under the concept of sustainability and socioeconomic viability (sostenibilidad) and the potential socioeconomic harm that keeping sport and tourist fishing under a closed season (veda) during the established period represents.
2. 3That once the closed season ends on September 30, the Semi-Industrial fleet may enter to operate in the closed season zone, under the following conditions: The semi-industrial shrimp fleet may begin activities in the closed season zone established in the present Agreement, as of October sixteenth and the semi-industrial sardine fleet will do so as of November 1, 2013.

4º-Likewise, those fishers belonging to the small-scale artisanal fleet, whose center of operations includes any of the closed season areas and decide not to accept the closed season, in order to fish outside the closed season areas, will not be granted fuel at a competitive price; thus, the Board of Directors. Therefore, AGREES:

1º-To establish the closed season for the Gulf of Nicoya under the following terms and conditions:

A-The closed season zone for small-scale commercial fishers, shall be in the area defined by an imaginary line that goes from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Faro de la Isla Negritos out (84°49'35" West Longitude, 09°49'14" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inland to the mouth of the Tempisque River and this fishing prohibition runs from July 1 to September 30, both dates inclusive.

B-A closed season is established for Semi-industrial shrimp trawl and sardine purse seine (bolichera/cerco) fishing in the area comprised by an imaginary line that goes from Punta Torres known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula, from these lines inland to the mouth of the Tempisque River, from July 1, 2013 until September 30, 2013. C-The semi-industrial shrimp fleet may begin activities in the closed season zone established in the preceding subsection, as of October sixteenth and the sardine fleet as of November 1, 2013.

D-Those fishers who fall within the terms and conditions established in Article 2, of Decree N° 36043-MAG-SP-MS, published in the Official Gazette La Gaceta N° 115 of June 15, 2010, and who state, in accordance with said regulation, their decision to continue carrying out fishing activities outside the zones or conditions imposed by the closed season, shall be authorized by way of exception for fuel at a competitive price, provided that they have communicated this in writing to INCOPESCA before the start of the established closed season period.

(Subparagraph thus amended by agreement N° AJDIP/208-2013 of June 7, 2013) 2º-Leave Agreement AJDIP/186-2013 without effect.

3º-Publish, in effect as of July 1, 2013.

4º-Firm agreement.

1. 1Que en la sesión extraordinaria 28-2013, celebrada el pasado 17 de mayo, la Junta Directiva adoptó el Acuerdo AJDIP/186-2013, por medio del cual se establece la veda para el Golfo de Nicoya, sustentado en la presentación realizada por el Lic. Antonio Porras Porras, Director General Técnico, a través del oficio DGT-034-05-2013, el cual se sustentó en las siguientes consideraciones:

i- Que mediante el presente oficio, se remite a conocimiento y análisis de la Junta Directiva la recomendación de la Comisión de Vedas, para la implementación de la veda en el Golfo de Nicoya, correspondiente al año 2013, conforme a lo acordado en el Acta 03-2013 de la Comisión Nacional de Vedas.

ii- Que luego de discutidas las diferentes propuestas de veda para el año 2013 y considerando los insumes aportados por organizaciones de pesca en pequeña escala y del sector semi-industrial y palangrero, se recomienda que la veda para el Golfo de Nicoya se establezca de considerarlo pertinente bajo los siguientes términos y condiciones:

A-La zona de veda tanto para los pescadores comercial en pequeña escala como la pesca Turística y Deportiva, será en el área definida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) al Faro de la Isla Negritos afuera (84°49'35" Longitud Oeste, 09°49'14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del Río Tempisque y esta prohibición de pesca va desde el 1 de julio hasta el 30 de setiembre, ambas fechas incluidas.

B-Se establece para pesca Semi-industrial camaronera de arrastre y sardinera bolichera (cerco) una veda en el área comprendida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del Río Tempisque, desde el 1 de julio del 2013 hasta el 31 de octubre del 2013. Durante los meses de julio, agosto y setiembre, se permite la pesca de sardina con red de cerco en el área comprendida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) al Faro de la Isla Negritos afuera (84°49'35" Longitud Oeste, 09°49'14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas hasta el Muelle de Cruceros en Puntarenas, siempre y cuando dicha pesca sea realizada únicamente por una embarcación sardinera, sólo un día por semana, realizando una única descarga durante el día autorizado, misma que deberá ser debidamente supervisada por el INCOPESCA y el producto del desembarque deberá ser destinado exclusivamente para venta para uso de carnada para la flota pesquera nacional. El mes de octubre no se permitirá la pesca de sardina en el área vedada por coincidir con un pico de reproducción de esta especie.

1. 2Que analizado y revisado el Acuerdo supra, estiman los Sres. Directores que resulta conveniente y necesario excluir de la veda a la veda para la pesca deportiva y turística, dadas las particularidades y condiciones absolutamente diferentes respecto a la pesca comercial, en asocio y fundamento sobre todo al recurso pesquero que se tiene como meta vedar, bajo el concepto de sustentabilidad y sostenibilidad y al potencial perjuicio socioeconómico que representa mantener a la pesca deportiva y turística en veda durante el período establecido.
2. 3Que finalizada la veda el 30 de setiembre, la flota Semi-Industrial podrá ingresar a faenar en la zona vedada, bajo las siguientes condiciones: La flota semi-industrial camaronera podrá iniciar actividades en la zona de veda establecida en el presente Acuerdo, a partir del dieciséis de octubre y la flota semi-industrial sardinera lo hará a partir del 1° de noviembre de 2013.

4º-De igual manera aquellos pescadores pertenecientes a la flota artesanal en pequeña escala, cuyo centro de operación comprende alguna de las áreas vedadas y decidan no acogerse a la veda, para pescar fuera de las áreas vedadas, no se les reconocerá el combustible a precio competitivo, así las cosas, la Junta Directiva. Por tanto, ACUERDA:

1º-Establecer la veda para el Golfo de Nicoya bajo los siguientes términos y condiciones:

A-La zona de veda para los pescadores comercial en pequeña escala, será en el área definida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) al Faro de la Isla Negritos afuera (84°49'35" Longitud Oeste, 09°49'14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del Río Tempisque y esta prohibición de pesca va desde el 1 de julio hasta el 30 de setiembre, ambas fechas incluidas.

B-Se establece para pesca Semi-industrial camaronera de arrastre y sardinera bolichera (cerco) una veda en el área comprendida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas aguas adentro hasta la desembocadura del Río Tempisque, desde el 1 de julio del 2013 hasta el 30 de setiembre del 2013. Durante los meses de julio, agosto y setiembre, se permite la pesca de sardina con red de cerco en el área comprendida por una línea imaginaria que parte de Punta Torres conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) al Faro de la Isla Negritos afuera (84°49'35" Longitud Oeste, 09°49'14" Latitud Norte) y desde ahí hasta la parte este de Punta Cuchillo en la Península de Nicoya, de estas líneas hasta el Muelle de Cruceros en Puntarenas, debiendo dicha pesca ser realizada únicamente por una embarcación sardinera, sólo un día por semana, realizando una única descarga durante el día autorizado, misma que deberá ser debidamente supervisada por el INCOPESCA y el producto del desembarque deberá ser destinado exclusivamente para venta para uso de carnada para la flota pesquera nacional.

C-La flota semi-industrial camaronera podrá iniciar actividades en la zona de veda establecida en el acápite anterior, a partir del dieciséis de octubre y la sardinera a partir del 1° de noviembre de 2013.

D-Aquellos pescadores que se encuentren dentro de los términos y condiciones establecidas en el Artículo 2°, del Decreto N° 36043-MAG-SP-MS, publicado en el Diario Oficial La Gaceta N° 115 del 15 de junio de 2010, y que manifiesten de conformidad con dicha normativa, su decisión de continuar realizando actividades de pesca fuera de las zonas o condiciones impuestas en la veda, se les autorizará por vía de excepción el combustible a precio competitivo, siempre y cuando, así lo hayan comunicado por escrito al INCOPESCA antes del inicio del período de veda establecido.

(Así reformado el inciso anterior mediante acuerdo N° AJDIP/208-2013 del 7 de junio del 2013) 2º-Déjese sin efecto el Acuerdo AJDIP/186-2013.

3º-Publíquese, rige a partir del 1° de julio de 2013.

4º-Acuerdo firme.
