in the entirety of the text - Complete Text of Norm 37555 (SENARA), the budget expenditure set for 2013 Complete Text record: EF47C No. 37555-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law No. 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree No. 32988-H-MPPLAN of January 31, 2006 and its amendments; Law No. 6877 of July 18, 1983, Creation of the National Groundwater, Irrigation and Drainage Service (SENARA) and its amendments; Executive Decree No. 32452-H of June 29, 2005 and its amendments; and Executive Decree No. 37042-H of March 13, 2012 and its amendments.

1. 1That by Law No. 6877, published in La Gaceta No. 143 of July 29, 1983 and its amendments, the National Groundwater, Irrigation and Drainage Service (SENARA) was created, whose objectives, among others, are to promote the agricultural development of the country through the establishment and operation of irrigation, drainage, and flood protection systems, to contribute to preferentially developing those agricultural development projects that are based on a just distribution of land, and to seek to bring about a rational and democratic modification in land ownership in the territory benefited by the creation of irrigation and drainage districts.
2. 2That by official communication GG-OF-816-2012, the General Manager of SENARA requested to increase the maximum budget expenditure set for that body for the 2013 period, by an amount of ¢7,758,880,290.89 (seven thousand seven hundred fifty-eight million eight hundred eighty thousand two hundred ninety colones and eighty-nine céntimos), which shall be allocated to the payment of services, acquisition of durable goods, and for the payment of compensation for the acquisition of rights of way for the construction of the southern canal section II and the secondary network of irrigation canals in the Lajas and Abangares subdistricts in the province of Guanacaste, corresponding to the execution of the Integrated Water Resource Management Program (PROGIRH).
3. 3That of said amount, the sum of ¢346,886,214.86 (three hundred forty-six million eight hundred eighty-six thousand two hundred fourteen colones and eighty-six céntimos) is to be expanded via Executive Decree, in accordance with the provisions of article 7 of Executive Decree No. 37042-H, published in Digital Supplement No. 35 to La Gaceta No. 59 of March 22, 2012 and its amendments, since these are specific surplus (superávit específico) resources, which shall be allocated to financing expenses directly related to the substantive activity of SENARA.
4. 4That by the cited Executive Decree No. 37042-H, the General Budgetary Policy Guidelines for the year 2013 were issued, establishing in article 5º the maximum percentage by which the budget expenditure of public entities, ministries, and other bodies could be increased, with respect to that of the preceding year. In accordance with said provision, the resulting maximum budget expenditure amount for the National Groundwater, Irrigation and Drainage Service (SENARA) was established in the sum of ¢4,553,200,000.00 (four thousand five hundred fifty-three million two hundred thousand colones), which was communicated via official communication STAP-0897-2012 of April 26, 2012, a figure that does not contemplate the expenditure previously indicated in this decree.
5. 5That by Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005 and its amendments, the "Guideline for the application of article 6 of Law No. 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of income of the Public Sector called Financing" was issued.
6. 6That in relation to the specific surplus (superávit específico), section 9º of the referred Executive Decree No. 32452-H makes possible the use thereof for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.
7. 7That for the foregoing, it is necessary to expand the maximum budget expenditure set for the National Groundwater, Irrigation and Drainage Service for 2013, increasing it by the sum of ¢346,886,214.86 (three hundred forty-six million eight hundred eighty-six thousand two hundred fourteen colones and eighty-six céntimos). Therefore,

Considering:

DECREE:

en la totalidad del texto - Texto Completo Norma 37555 Amplia para el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), el gasto presupuestario fijado para el 2013 Texto Completo acta: EF47C N° 37555-H LA PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley N° 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley N° 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo N° 32988-H-MPPLAN de 31 de enero de 2006 y sus reformas; la Ley N° 6877 de 18 de julio de 1983, Creación del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) y sus reformas; el Decreto Ejecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo N° 37042-H de 13 de marzo de 2012 y sus reformas.

1. 1Que mediante la Ley N° 6877, publicada en La Gaceta N° 143 de 29 de julio de 1983 y sus reformas, se crea el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), cuyos objetivos, entre otros, son fomentar el desarrollo agropecuario del país, mediante el establecimiento y funcionamiento de sistemas de riego, avenamiento y protección contra inundaciones, contribuir a desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que se sustenten en una justa distribución de la tierra y procurar que en el territorio beneficiado por la creación de distritos de riego y avenamiento, se efectúe una modificación racional y democrática en la propiedad de la tierra.
2. 2Que por medio del oficio GG-OF-816-2012, el Gerente General del SENARA, solicitó incrementar el gasto presupuestario máximo fijado a ese órgano para el período 2013, por un monto de ¢7.758.880.290,89 (siete mil setecientos cincuenta y ocho millones ochocientos ochenta mil doscientos noventa colones con ochenta y nueve céntimos), los cuales se destinarán al pago de servicios, adquisición de bienes duraderos y para el pago de indemnizaciones por la adquisición de derechos de paso para la construcción del canal del sur tramo II y la red secundaria de canales para riego en los subdistritos Lajas y Abangares en la provincia de Guanacaste, correspondiente a la ejecución del Programa de Gestión Integrada del Recurso Hídrico (PROGIRH).
3. 3Que de dicho monto corresponde ampliar por la vía del Decreto Ejecutivo la suma de ¢346.886.214,86 (trescientos cuarenta y seis millones ochocientos ochenta y seis mil doscientos catorce colones con ochenta y seis céntimos), de conformidad con lo establecido en el artículo 7° del Decreto Ejecutivo No. 37042-H, publicado en el Alcance Digital N° 35 a La Gaceta N° 59 de 22 de marzo de 2012 y sus reformas, ya que son recursos de superávit específico, que se destinarán a financiar gastos directamente relacionados con la actividad sustantiva del SENARA.
4. 4Que mediante el Decreto Ejecutivo No. 37042-H citado, se emitieron las Directrices Generales de Política Presupuestaria para el año 2013, estableciéndose en el artículo 5°, el porcentaje máximo en que podría incrementarse el gasto presupuestario de las entidades públicas, ministerios y demás órganos, con respecto al del año precedente. En correspondencia con dicha disposición, el monto de gasto presupuestario máximo resultante para el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), fue establecido en la suma de ¢4.553.200.000,00 (cuatro mil quinientos cincuenta y tres millones doscientos mil colones), el cual fue comunicado mediante el oficio STAP-0897-2012 del 26 de abril de 2012, cifra que no contempla el gasto indicado previamente en este decreto.
5. 5Que mediante el Decreto Ejecutivo N° 32452-H, publicado en La Gaceta N° 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley N° 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
6. 6Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo N° 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
7. 7Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado para el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento para el 2013, incrementándolo en la suma de ¢346.886.214,86 (trescientos cuarenta y seis millones ochocientos ochenta y seis mil doscientos catorce colones con ochenta y seis céntimos). Por tanto,
