29794-MP-TUR of August 30, 2001, called "Regulation for the Granting of Security Interests Encumbering the Concessions of the Papagayo Tourism Hub," so that they shall henceforth read as follows:
"Article 1.— This Regulation governs the procedure for the authorization of security interests (garantías reales) that encumber the concessions of the Papagayo Gulf Tourism Hub, as backing for credits granted to the concessionaires. These may be granted by state or private banks that form part of the National Banking System or by State Institutions, in accordance with what is indicated in Article 4 of Law No. 6758 of May 6, 1982, the Law Regulating the Development and Execution of the Papagayo Gulf Tourism Project, as well as by first-rate foreign financial entities, accredited by the Central Bank of Costa Rica, or duly accredited with the financial control entities of their country of origin. The Costa Rican Tourism Institute may gather all the information it deems necessary to support said accreditation in the cases of foreign financial entities accredited with the financial control entities of their country of origin.
When the credits are granted by foreign entities, a place within the national territory must be accredited for receiving any notifications from the Costa Rican Tourism Institute.
It is the responsibility of the Board of Directors of the Costa Rican Tourism Institute to authorize the subjection of a concession within the Papagayo Gulf Tourism Hub to a security interest. The credits intended to be requested, placing the real right (derecho real) as security, may only be invested or used in the same concession, and this must be accredited by the concessionaire in the application submitted to this Institute.
