in the entirety of the text - Complete Text of Standard 37314 Reform of the Regulation for the Quality of Water for Human Consumption in Health Establishments Complete Text record: E8167 No. 37314-S THE SECOND VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF HEALTH By virtue of the powers conferred upon them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; 28 subsection 2 literal b) Law No. 6227 of May 2, 1978 "General Law of Public Administration"; 1, 2, 348 and 355 Law No. 5395 of October 30, 1973 "General Health Law".

1. That the health of the population is both a fundamental human right and a public interest asset protected by the State.

2. That it is the competence of the Ministry of Health to define the policy, regulation, planning, and coordination of all public and private activities related to health.

3. That protecting water for human consumption is protecting the health of people and life on Earth, a substantial element for achieving the sustainable development of the country.

4. That through epidemiological studies it has been demonstrated that the consumption of high amounts of arsenic in water for human consumption could be related to the development of diseases.

5.- That it is the criterion of this Ministry not to allow an arsenic value greater than 10 ug/L, as the contrary could put the health of the population at risk, since no technical studies are available to support this variation.

6.- That due to the foregoing, it is necessary and timely to modify Table No. 3 of Annex No. 1 of Executive Decree No. 37083-S of March 22, 2012, published in La Gaceta No. 87 of May 7, 2012, scope No. 59, "Regulation for the quality of water for human consumption in health establishments".

THEY DECREE:

AMENDMENT TO THE "REGULATION FOR THE QUALITY OF WATER FOR HUMAN CONSUMPTION IN HEALTH ESTABLISHMENTS"

CONSIDERING:

THEREFORE,

37083-S of March 22, 2012, published in La Gaceta No. 87 of May 7, 2012, scope No. 59, "Regulation for the quality of water for human consumption in health establishments," so that henceforth they read as follows:

"Article 3.- This regulation applies to hospital health establishments, public, private, mixed, and NGOs dedicated to the direct care of persons that have inpatient services for more than 24 hours." (.)

1. Que la salud de la población es tanto un derecho humano fundamental, como un bien de interés público tutelado por el Estado.

2. Que es competencia del Ministerio de Salud definir la política, la regulación, la planificación y la coordinación de todas las actividades públicas y privadas relacionadas con la salud.

3. Que proteger el agua para consumo humano es proteger la salud de las personas y la vida sobre la Tierra, elemento sustancial para alcanzar el desarrollo sostenible del país.

4. Que a través de estudios epidemiológicos se ha demostrado, que el consumo de cantidades elevadas de arsénico en el agua para consumo humano, podría estar relacionado con el desarrollo de enfermedades.

5.- Que es criterio de este Ministerio, no permitir un valor de arsénico superior a 10 ug/L, pues lo contrario podría poner en riesgo la salud de la población, pues no se cuentan con estudios técnicos que sustenten esta variación.

6.- Que por lo anterior se hace necesario y oportuno, modificar el Cuadro N° 3, del Anexo No. 1 del Decreto Ejecutivo No. 37083-S del 22ade marzo del 2012, publicado en La Gaceta No. 87 del 07ade mayo del 2012, alcance N° 59, "Reglamento para la calidad del agua para consumo humano en establecimientos de salud".

MODIFICACIÓN AL "REGLAMENTO PARA LA CALIDAD DEL AGUA PARA CONSUMO HUMANO EN ESTABLECIMIENTOS DE SALUD"

CONSIDERANDO:

POR TANTO,

DECRETAN:

37083-S del 22ade marzo del 2012, publicado en La Gaceta No. 87 del 7ade mayo del 2012, alcance N° 59, "Reglamento para la calidad del agua para consumo humano en establecimientos de salud", para que en lo sucesivo se lean así:

"Artículo 3.- Este reglamento se aplica a los establecimientos de salud hospitalarios, públicos, privados, mixtos y ONG´s dedicados a la atención directa de las personas que cuentan con servicio de internamiento mayor de 24 horas." (.)

Artículo 1 — Amend article 3 and Annex I, Tables 1 and 3, of Executive Decree No.

Artículo 2 — It shall be effective upon its publication.

Artículo 1 — Refórmense el artículo 3 y el Anexo I, Cuadros 1 y 3, del Decreto Ejecutivo No.

Artículo 2 — Rige a partir de su publicación.
