Considering:
8495 of April 6, 2006, establishes as the competence of SENASA the administration, planning, direction, and taking of pertinent veterinary or sanitary measures regarding the control of safety and wholesomeness (inocuidad) of products and by-products of animal origin, in the stages of capture, production, industrialization, and marketing, considering food additives, veterinary drug residues, pesticides, and other chemical, biological, or biotechnological contaminants.
8495, the document granted by SENASA, by which authorization shall be recorded so that the requesting natural or legal person may engage in one or several of the activities mentioned in Article 56 of Law 8495, and which shall not need to be renewed as long as the sanitary requirements demanded at the time of its issuance are constantly met, and may be withdrawn if it is determined, after inspection, that the establishment does not meet the sanitary requirements set for the authorized activity.
8436 of March 1, 2005, the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura), defines the vessels comprising the National Fishing Fleet and dedicated to commercial fishing as small-scale (artisanal) vessels, medium-scale vessels, advanced vessels, semi-industrial vessels, and industrial vessels, all of which make up a very broad universe, and therefore it is considered necessary to establish priority criteria based on their importance due to the sanitary impact they may cause by introducing fishery products into the human and animal consumption chain and to the country's compliance with commercial sanitary obligations established with our trading partners.
Javier Flores Galarza, in his capacity as Minister of Agriculture and Livestock at that time, through Directive DM-SENASA-DIR-0002-2008 of September 9, 2008, which is in force, established that ".the matter of wholesomeness (inocuidad) of food of animal origin is the exclusive competence of the National Animal Health Service, in its capacity as Sanitary Authority, and therefore the different bodies that make up the Agricultural Sector must adjust their actions, mandatory agreements, procedures, and concrete actions to this sectoral definition, and especially INCOPESCA, which must adjust its actions in this matter to what is strictly established in Article 120 of the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura)."
