Furthermore, it exercises a special jurisdiction over the seas adjacent to its territory for a distance of two hundred miles, in order to protect, conserve and exploit with exclusivity all the resources and natural wealth existing in the waters, the soil and the subsoil of those zones.

Creation and Operation of the National Council for the Development of the Sea(*)

a. Articulate, integrate and reconcile the policies and planning instruments issued on marine matters; promoting their implementation through the governing institutions.
b. Prepare and propose the National Marine Policy.
c. Recommend guidelines that ensure compliance with the National Marine Policy and integrated and effective management of marine spaces.
d. Approve the work plans of the Technical Secretariat of CONAMAR (*).

e. Coordinate the process of compliance and evaluation of the National Marine Policy.
f. Periodically review and adapt the guidelines and the action plan of the National Marine Policy, once the achievements in land-use planning (ordenamiento) and sustainable use of marine and coastal spaces and their impact on the well-being of people and their communities have been assessed.

It shall be convened by the Minister of the Presidency or whoever represents him/her. It shall have an Executive Secretary who shall be appointed by CONAMAR within three months of the publication of this decree, who shall have the right to attend the Council sessions with voice but no vote. Its operation shall be governed by the provisions of the General Law of Public Administration regarding collegiate bodies.
Furthermore, those determined by CONAMAR may attend the Council sessions with the right to voice but no vote.

It shall also have the technical support of the organizations that comprise it, which are authorized to designate personnel for this purpose. The Secretariat shall meet mandatorily once a month. Each of its members shall be responsible for communicating the decisions and operational guidelines to their respective institutions at the central, regional and subregional levels.

Furthermore, representatives of specialized bodies may attend the sessions depending on the topic being discussed, at the express invitation of the Technical Secretariat.
All representatives shall be technicians trained in the specific subject matter of their institutions and shall be appointed by the governing Ministers of each of their organizations. In the same act of their appointment, a substitute shall be designated, also an employee of each of the institutions comprising the Secretariat, who must meet the same technical-professional characteristics as the principal members. A recording secretary shall be appointed from among its representatives.

The Technical Secretariat may grant hearings during sessions to those who formally request them in writing and shall notify its decision to the interested party in writing. In the same manner, it shall receive public or private organizations, officials or persons whom it formally invites to make consultations, or any other request within its scope of competencies.
Shall take effect from its publication in the Official Gazette La Gaceta.

Considerando:
Además, ejerce una jurisdicción especial sobre los mares adyacentes en su territorio en una extensión de doscientas millas, a fin de proteger, conservar y explotar con exclusividad todos los recursos y riquezas naturales existentes en las aguas, el suelo y el subsuelo de esas zonas.
Que las actividades pesquera y acuícola, contribuyen en forma decidida a la garantía de seguridad alimentaria del país, resultando positivo y consistente el aporte de la industria Pesquera y Acuícola a la meta

DECRETAN:

a. Articular, integrar y conciliar las políticas e instrumentos de planificación emitidos en materia marina; impulsando su implementación a través de las instituciones rectoras.
b. Elaborar y proponer la Política Nacional Marina.
c. Recomendar directrices que aseguren el cumplimiento de la Política Nacional Marina y una gestión integrada y efectiva de los espacios marinos.
d. Aprobar los planes de trabajo de la Secretaría Técnica de la CONAMAR (*).

e. Coordinar el proceso de cumplimiento y evaluación de la Política Nacional del Mar.
f. Revisar y adecuar en forma periódica, los lineamientos y el plan de acción de la Política Nacional del Mar, una vez valorados los logros en el ordenamiento y aprovechamiento sostenible de los espacios marinos y costeros y su impacto en el bienestar de las personas y sus comunidades.

Será convocada por el Ministro de la Presidencia o quien lo represente. Contará con un Secretario Ejecutivo que será nombrado por el CONAMAR en el plazo de tres meses a partir de la publicación del presente decreto, que tendrá derecho a asistir a las sesiones del Consejo con voz pero sin voto. Para su funcionamiento se regirá por lo dispuesto en la Ley General de Administración Pública en lo que respecta a órganos colegiados.
Podrán además asistir a las sesiones del Consejo, con derecho a voz pero sin voto quienes determinen el CONAMAR.

Además contará con el apoyo técnico de las organizaciones que la integran, quienes están autorizados a designar personal para tal efecto. La Secretaría sesionará obligatoriamente una vez al mes. Cada uno de sus miembros será responsable de comunicar las decisiones y orientaciones operativas a sus respectivas instituciones a nivel central, regional y subregional.

Podrán además asistir a las sesiones representantes de los órganos especializados según el tema que se trate, bajo convocatoria expresa de la Secretaría Técnica.
Todos los representantes serán técnicos capacitados en la materia propia del giro de sus instituciones y serán nombrados por los Ministros rectores de cada una de sus organizaciones. En el mismo acto de su nombramiento se designará un suplente, también funcionaria de cada una de las instituciones que integran la Secretaría, que debe reunir las mismas características técnico-profesionales de los titulares. Se nombrará entre sus representantes un secretario de actas.

La Secretaría Técnica podrá dar audiencias durante las sesiones a quienes lo soliciten formalmente por escrito y notificará por escrito su acuerdo al interesado. Del mismo modo recibirá a organizaciones públicas o privadas, funcionarios o personas a quienes convoque formalmente para realizar consultas, o cualquier otro requerimiento dentro de su marco de competencias.
Rige a partir de su publicación en el Diario Oficial La Gaceta.
