"Article 1.- The Mixed National Technical Advisory Commission of the National Environmental Technical Secretariat (SETENA), known in this decree as the Commission, is hereby created, which shall be attached to the Ministry of Environment, Energy and Telecommunications, to provide support to SETENA in the development, updating and modernization of the technical instruments and procedures of the country's Environmental Impact Assessment system.
The Commission shall be composed of one principal representative and their respective alternate, from the following institutions and entities:
1. National Environmental Technical Secretariat, which shall preside over the Commission.
2. National System of Conservation Areas (SINAC) 3. Ministry of Economy, Industry and Commerce.
4. Costa Rican Association of Environmental Consultants.
5. Federation of Professional Associations of Costa Rica.
6. Costa Rican Federation for Environmental Conservation (FECON).
7. Costa Rican Chamber of Construction (CCC).
8. Chamber of Industries of Costa Rica (CICR), and 9. National Chamber of Agriculture (CNA).
10. National Museum.
11. Costa Rican Union of Chambers and Associations of Private Enterprise (UCCAEP) However, the Commission may convene specialized organizations and technicians to act as consultative bodies, who may participate in the sessions as special guests, with voice but without vote.
The Secretary General of SETENA may appoint an external facilitator, who shall support and provide specific technical information to the Commission." "Article 8.- The Commission shall meet on an ordinary basis twice a month and extraordinarily when convened by the President, at the headquarters of the Secretariat, unless by a simple majority the members of the Commission agree to meet in another location.
The Commission may validly meet with the presence of half plus one of its members.
The agreements of the Commission shall be adopted by a simple majority vote of those present. In the event of a tie, the President shall exercise the casting vote. The agreements related to modifications to the Environmental Impact Assessment procedure shall be submitted to the knowledge of the Plenary Commission of SETENA, for the respective observations, corrections and final approval." "Article 9.- Any principal member who does not attend the ordinary and extraordinary sessions, nor is represented by their alternate, for two consecutive sessions or three alternate sessions, within a period of six months, shall lose their status as a member of the Commission.
The Secretariat shall communicate this situation to the institution or sector in question, in order for the irregularity to be rectified, or failing that, for the corresponding measures to be taken, proceeding with the change or substitution of the representative."
