in the entirety of the text - Complete Text of Norm 37198 Declares of Public Utility for the interests of the State the Administrative Association of the Aqueduct and Sanitary Sewer of El Yas Complete Text record: E5F1E No. 37198-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Law No. 218 of August eighth, nineteen thirty-nine, and articles 27 and following of the Regulations to the Associations Law No. 29496-J published in La Gaceta No. 96 of May twenty-first, two thousand one.
I.That article 32 of the Associations Law No. 218 of August eighth, nineteen thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.That the ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT AND SANITARY SEWER OF EL YAS, SECOND DISTRICT SANTIAGO, SECOND CANTON PARAÍSO, PROVINCE OF CARTAGO, legal identification number 3-002-330522, was registered in the Associations Registry of the Public Registry since September sixteenth, two thousand two, under file No. 14660, under Volume 506, Entry 8554.
"a) Administer, operate, maintain, develop, and preserve in good condition the aqueduct, in accordance with the provisions and regulations issued for that purpose by the Instituto Costarricense de Acueductos y Alcantarillados, which shall be mandatory; b) Obtain the effective participation of the community in the construction, operation, maintenance, and development of the aqueduct.
IV.That such objectives solve a social need of first order, for which they deserve the support of the Costa Rican State. Therefore,

I.Que el artículo 32 de la Ley de Asociaciones N° 218 del ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.Que la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE EL YAS DISTRITO SEGUNDO SANTIAGO CANTÓN SEGUNDO PARAÍSO DE LA PROVINCIA DE CARTAGO, cédula jurídica número 3-002-330522, se inscribió en el Registro de Asociaciones del Registro Público desde el día dieciséis de setiembre del dos mil dos, bajo el expediente Nº 14660, bajo el Tomo 506, Asiento 8554.
III.Que entre los fines que persigue la asociación, según el artículo Tercero de sus Estatutos, se encuentran los siguientes:
"a) Administrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto, de conformidad con las disposiciones y reglamentos que al respecto emita el Instituto Costarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio; b) Obtener la participación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo del acueducto.
IV.Que tales objetivos solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,

Dado en la Presidencia de la República. San José, a las nueve horas treinta minutos del dieciséis de marzo del dos mil doce.
