CONSIDERING:
THEY DECREE:
"Amendments to Executive Decree N° 33495-MAG-S-MINAE-MEIC, Regulation on the Registration, Use, and Control of Formulated Synthetic Pesticides, Technical Grade Active Ingredient, Adjuvants (Coadyuvantes), and Related Substances for Agricultural Use" of 31 October 2006, published in the Official Gazette La Gaceta N° 7 of 10 January 2007"
Therefore,
article 2 of Executive Decree N° 33495-MAG-S-MINAE-MEIC, "Regulation on the Registration, Use, and Control of Formulated Synthetic Pesticides, Technical Grade Active Ingredient, Adjuvants (Coadyuvantes), and Related Substances for Agricultural Use" of 31 October 2006, published in the Official Gazette La Gaceta N° 07 of 10 January 2007, so that it reads as follows:
"13. Registration Suspensions and Cancellations 13.1 Registration Suspension 13.1.1 Generalities of Registration Suspension The registration of a formulated synthetic pesticide, technical grade active ingredient, related substances, and physical vehicles containing them, and the authorizations derived therefrom, may be suspended through the administrative procedure established in the General Law of Public Administration, if any of the grounds for registration suspension indicated in numeral 13.1.2 is determined.
13.1.2 The registration of a technical grade active ingredient, formulated synthetic pesticide, related substance, and physical vehicles containing them, for agricultural use shall be subject to suspension when:
NOTE: Once the registration of a technical grade active ingredient, formulated synthetic pesticide, related substance, and physical vehicles containing them, for agricultural use, is suspended, the product may not be commercialized in the country. Nor may the products be formulated, reformulated, imported, exported, packaged, repackaged, or re-containerized, except when these actions are necessary to correct the cause for which the registration was suspended.
13.1.3 The suspension shall remain in effect until the reason for the suspension is corrected. However, if such correction has not been made within a period of three (3) months, from its notification, the cancellation of the registration shall proceed in accordance with numeral 13.2.2g), with the exception of those suspensions ordered by the judicial authority.
13.2. Registration Cancellations.
13.2.1 Generalities of Registration Cancellation The registration of a formulated synthetic pesticide, technical grade active ingredient, related substances, and physical vehicles containing them, and the authorizations derived therefrom, may be canceled, if any of the grounds for registration cancellation indicated in numeral 13.2.2 is determined, through the administrative procedure established in the General Law of Public Administration.
13.2.2 Grounds for Registration Cancellation.
The AC shall cancel, ex officio or at the request of the administered party, the registration of formulated synthetic pesticides, technical grade active ingredient, related substance, and physical vehicles containing them, when:
The provisions of the General Law of Public Administration regarding administrative procedure shall be of mandatory application; in case of absence of an express rule therein, this Regulation shall apply."

Sole Transitional Provision.— Registrations of a technical grade active ingredient as such or forming part of a formulated synthetic pesticide, which have no expiration date and were registered prior to the entry into force of Executive Decree N° 33495-MAG-S-MINAE.MEIC, Regulation on the Registration, Use, and Control of Formulated Synthetic Pesticides, Technical Grade Active Ingredient, Adjuvants (Coadyuvantes), and Related Substances for Agricultural Use, of 31 October 2006, published in La Gaceta N° 7 of 10 January 2007, shall have a validity of 10 years, from the approval of the information submitted in the revalidation process.

CONSIDERANDO:
"Modificaciones al Decreto Ejecutivo N° 33495-MAG-S-MINAE-MEIC, Reglamento sobre el Registro, Uso y Control de Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes y Sustancias Afines de Uso Agrícola" del 31 de octubre de 2006, publicado en el Diario Oficial La Gaceta N° 7 del 10 de enero de 2007"
Por tanto,
DECRETAN:
"13. Suspensiones y Cancelaciones de registros 13.1 Suspensión de registro 13.1.1 Generalidades de la suspensión del registro El registro de un plaguicida sintético formulado, ingrediente activo grado técnico, sustancias afines y vehículos físicos que los contengan, y las autorizaciones que de él se deriven, pueden ser suspendidos a través del procedimiento administrativo establecido en la Ley General de la Administración Pública, si se determina alguna de las causales de suspensión del registro indicadas en el numeral 13.1.2.
13.1.2 El registro de un ingrediente activo grado técnico, plaguicida sintético formulado, sustancia afín y vehículos físicos que los contengan, de uso agrícola serán objeto de suspensión cuando:
NOTA: Suspendido el registro de un ingrediente activo grado técnico, plaguicida sintético formulado, sustancia afín y vehículos físicos que los contengan, de uso agrícola, el producto no se podrá comercializar en el país. Tampoco se podrá formular, reformular, importar, exportar, envasar, reenvasar o reempacar los productos, a excepción que éstas acciones sean necesarias para corregir la causal por la cual se suspendió el registro.
13.1.3 La suspensión se mantendrá hasta tanto se corrija el motivo de la suspensión. No obstante, si tal corrección no se ha realizado dentro de un plazo de tres (3) meses, a partir de su notificación se procederá a la cancelación del registro de conformidad con el numeral 13.2.2g), a excepción de aquellas suspensiones ordenadas por la instancia judicial.
13.2. Cancelaciones de Registros.
13.2.1 Generalidades de la cancelación del registro El registro de un plaguicida sintético formulado, ingrediente activo grado técnico, sustancias afines y vehículos físicos que los contengan, y las autorizaciones que de él se deriven, pueden ser canceladas, si se determina alguna de las causales de cancelación del registro indicadas en el numeral 13.2.2, a través del procedimiento administrativo establecido en la Ley General de la Administración Pública.
13.2.2 Causales de cancelación de registro.
La AC cancelará, de oficio o a solicitud de parte del administrado, el registro de plaguicidas sintéticos formulados, ingrediente activo grado técnico, sustancia afín y vehículos físicos que los contengan, cuando:
Consecuentemente córrase la numeración a fin de que los artículos 3 y 4 antes de esta adición, pasen a conformar los artículos 4 y 5 respectivamente, para que se lea de la siguiente manera:
"Artículo 3º-Normas aplicables. Las disposiciones de la Ley General de Administración Pública sobre el procedimiento administrativo serán de aplicación obligatoria, en caso de ausencia de norma expresa en la misma, se aplicará este Reglamento."
Dado en la Presidencia de la República, a los seis días del mes de octubre del año dos mil once.
Transitorio Único.- Los registros de un ingrediente activo grado técnico como tal o formando parte de un plaguicida sintético formulado, que no tienen fecha de vencimiento y que fueron inscritos antes a la entrada en vigencia del Decreto Ejecutivo Nº 33495-MAG-S-MINAE.MEIC, Reglamento sobre Registro, Uso y Control de Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes y Sustancias Afines de Uso Agrícola, de 31 de octubre del 2006, publicado en La Gaceta Nº 7 del 10 de enero de 2007, tendrán una vigencia de 10 años, a partir de la aprobación de la información presentada en el proceso de reválida.
