"REGULATION OF THE ENVIRONMENTAL RECOGNITION SYSTEM (SIREA) AND REPEAL OF EXECUTIVE DECREE N° 33525-MINAE, REGULATION FOR GRANTING THE ECOLOGICAL FLAG CERTIFICATE OF NOVEMBER 27, 2006"

General Aspects of the Environmental Recognition System

The Environmental Recognition System (hereinafter SIREA) is created, which shall have as its objective to publicly recognize those organizations that have stood out for causing a significant change in the country's environmental field; contributing to the achievement of the objectives of the National Development Plan and to a long-term national sustainable development strategy.

The specific objectives of SIREA are the following:

• a)To constitute a state recognition system in environmental matters.
• b)To integrate the country's environmental recognitions in accordance with the requirements defined in this regulation.
• c)To contribute to preventing environmental pollution through the adoption of good practices of cleaner production, eco-efficiency, and social responsibility in the public and private sectors.
• d)To contribute to optimizing the use of resources through the promotion and implementation of actions for their reduction and efficient use, in public and private organizations.
• e)To promote the incorporation of the greatest number of organizations into SIREA, through the adoption of Voluntary Agreements that channel efforts towards eco-competitiveness.
• f)To issue general guidelines on environmental recognitions that allow new recognition initiatives promoted at the national level to comply with the requirements defined in SIREA.
• g)To publicize and promote innovative experiences with a positive impact on the environment.
• h)To promote in organizations the taking of decisive actions in environmental matters and responsible schemes in the production and consumption of goods and services.
• i)To encourage the increase of eco-competitiveness through voluntary instruments of environmental management and recognitions.
• j)To have an agile and clear system that includes an evaluation methodology with criteria, evaluation sub-criteria, and scopes for different recognitions, which are in close alignment with international parameters and that allows for gradual progress until achieving social responsibility.
• k)To consolidate an organizational platform that allows for the effective operation of SIREA in the long term.

The general management principles that frame and guide the operation of SIREA are the following:

• a)Accountability: responsibility of an Organization to provide answers to governing bodies, legal authorities, and other interested parties, regarding its decisions and actions.
• b)Ethical behavior: behavior that is consistent with the principles of good conduct generally accepted in the context of a given situation and that is consistent with national and international regulations related to the matter.
• c)Public-private cooperation: set of actions carried out between the public and private sectors to guarantee compliance with the legislation, the implementation of the National Development Plan (PND), and continuous improvement plans.
• d)Compliance with national legislation: action and effect of fulfilling the duties or obligations established in the legislation by an Organization.
• e)Social approach: orientation towards social matters as a continuous variable to be considered in the different stages of advancement of organizations to address the principles of sustainable development.
• f)Continuous improvement: quality strategy or methodology for organizations based on the continuous search for and application of improvement opportunities.
• g)Transparency: openness regarding decisions and activities that affect society and the environment and willingness to communicate these in a clear, accurate, and complete manner.

For the purposes of this regulation, the following shall be understood as:

• a)Voluntary Agreements on Cleaner Production: Voluntary agreement, carried out between the ministries with competence in the matter being addressed and a productive sector or entity that accepts a self-regulation mechanism, through the establishment of clear goals and mutually agreed commitments on the subject of cleaner production, which will lead to better economic and environmental performance.
• b)Public-private cooperation: Exchange of information and promotion of best practices promoted by the Ministry of Environment, Energy, and Telecommunications and other bodies with the aim of advancing as a country towards eco-competitiveness and being carbon neutral by 2021.
• c)Evaluation criteria: Quantitative parameters used to evaluate an Organization on a specific topic. The fulfillment of the criteria defined for a recognition category is a requirement to obtain that recognition, whether for the purpose of registering in SIREA or renewing its participation in it.
• d)Sustainable development: Development model that encompasses the social, economic, and environmental dimensions, in which the sustainable use and management of natural resources is promoted, so that it can satisfy the needs of present generations without compromising the possibilities of future generations to meet their own needs.
• e)Eco-competitiveness: Eco-competitiveness is a comprehensive strategy based on a life-cycle approach to the use of resources, which seeks the creation of competitive advantages for a company, Organization, or country, allowing them to obtain a benefit that brings about improvement in productive, social, and environmental terms. Said strategy is based, among other aspects, on: the use of technologies, innovations, more efficient production techniques, or the sustainable use of resources. All this with the aim of obtaining a better position in the market, a better image, a greater quantity and/or quality of products or services, having lower production costs per unit of product, reducing the negative impacts generated to society or the environment, and improving people's quality of life.
• f)Eco-efficiency: Creating more goods and services using fewer resources while reducing pollution and waste generation. Eco-efficiency is achieved through the distribution of "goods at competitive prices and services that satisfy human needs and provide greater quality of life, while progressively reducing the environmental impacts of goods and the intensity of resource use, through the life-cycle analysis of a product or service." g) Environmental entrepreneurship: It is an environmental recognition granted to organizations or communities for their achievements or innovations in a specific area of human endeavor that enhance environmental improvement and the quality of life of the country's inhabitants.
• h)Evaluator: Person designated by the Organizer of a recognition to carry out the evaluation of an Organization applying for a SIREA recognition or a voluntary agreement.
• i)Technical Expert: Person assigned by the Organizer to provide specific technical knowledge or experience in the evaluation of an Organization applying for a SIREA recognition or a voluntary agreement.
• j)Environmental Award: Environmental recognition granted to an Organization.
• k)Graduality of recognitions: It is the gradual and cumulative increase in evaluation criteria and scope when moving from one recognition category to another. It includes Environmental entrepreneurship and starts with cleaner production, then moving on to Eco-efficiency, to finally reach Social responsibility.
• l)Organization: An Organization shall be understood to mean all natural and legal persons, public and private, who opt for a recognition or a voluntary agreement.
• m)Organizer: It is a public entity in charge of managing the technical and logistical processes of some SIREA recognition.
• n)Eco-efficiency Recognition: Award granted to an Organization that applies a continuous process in which it maximizes the productivity of resources, minimizes waste and emissions, generating added value.
• o)Environmental Entrepreneurship Recognition: Award granted to an Organization that, through its achievements or innovations in a specific area of human endeavor, enhances environmental improvement and the quality of life of the country's society.
• p)Cleaner Production Recognition: Award granted to an Organization that continuously applies an environmental, preventive, and comprehensive strategy to processes, products, and services, with the objective of reducing risks to human beings and the environment.
• q)Social Responsibility Recognition: For the purposes of this regulation, the Social Responsibility recognition is an award that distinguishes an Organization that incorporates into its operation, in a comprehensive manner, a set of social, environmental, and economic criteria, which are fully met and are an integral part of its management.
• r)Recognition: Public recognition to which organizations can access voluntarily, with the purpose of demonstrating specific achievements that show they are making a systematic, sustained, and successful effort towards sustainable development, in accordance with the principles and requirements of SIREA. It is granted to an Organization that, having submitted to the evaluation system proposed by SIREA, obtains the score that makes it deserving of said award.
• s)Initial recognitions: Those contemplated in article 10° of this regulation.
• t)SIREA: State-run Environmental Recognition System that integrates the environmental recognitions indicated in this regulation, as well as others that may be incorporated in the future. It comprises an organizational and logistical structure that supports it.

Elements of SIREA

SIREA shall be composed of the following bodies:

• a)Executive Secretariat (SE): It is a permanent body whose function shall be to advise and support the Minister of Environment, Energy, and Telecommunications (MINAET) for the monitoring of SIREA. The SE shall be composed of: the Minister of MINAET or a representative appointed by him and the following Directorates of MINAET, the Directorate of Environmental Quality Management (DIGECA), which shall coordinate the SE, the Directorate of Climate Change (DCC), and the Sectoral Directorate of Energy (DSE). The SE may be advised by technical experts in the required matters and form ad hoc committees.

The aforementioned bodies shall have fifteen days from the publication of this decree in the Official Gazette La Gaceta, to appoint their representatives and their respective alternates. Likewise, one month after said publication, the SE shall begin to meet once a month with the accredited representatives, and shall have an additional month to agree on its internal Organization, work procedures, call for meetings, and agreements in accordance with the provisions of Title II, Chapter Three of the General Law of Public Administration.

• b)Organizer: Public entity with experience in environmental matters and of recognized national standing. It shall be optional for the Ministry of Environment, Energy, and Telecommunications to agree with said entity on operational aspects of one or various recognitions as indicated in article 7° of this regulation; for this purpose, a cooperation agreement must be signed between the Ministry of Environment, Energy, and Telecommunications and the Organizer, which shall be of public knowledge. One or several organizers may participate in SIREA, according to the recognitions that are integrated.

The powers and responsibilities of the SE of SIREA are the following:

• a)To select the organizers for each of the initial recognitions created in article 10° of this regulation.
• b)To create and keep updated the following registries:

b.1) Registry of Environmental Recognitions incorporated into SIREA; b.2) Registry of Organizers of the Recognitions incorporated into SIREA; b.3) Registry of Recognized Organizations; b.4) Registry of organizations that are participating in Voluntary Agreements on Cleaner Production.

These registries shall be available on the MINAET website.

• c)To submit for the knowledge of the Minister of Environment, Energy, and Telecommunications:

c.1. The normative instruments required for the effective implementation of SIREA recognitions.

c.2. The recommendations for the incorporation of recognitions into SIREA.

c.3. The recommendations of the organizations that passed the evaluation process for the initial recognitions created in article 10° of the present regulation.

c.4. Studies on the costs of the services provided by the SIREA organizer or organizers, as applicable. The costs to be charged by the organizers shall be made official through an executive decree issued by the Executive Branch.

c.5. Cooperation agreements between MINAET and the organizer or organizers, in accordance with the provisions of articles 5° subsection b) and 7° subsection b) of this regulation.

• c)To follow up on legal appeals or claims that may be filed during the processing of any of the initial recognitions created in article 10° of the present regulation.
• d)To prepare and update the profile of the evaluators and technical experts for the initial SIREA recognitions created in article 10º of this regulation.
• e)To inform the organizations, in coordination with the organizers, of the result of the evaluations carried out by the evaluators and technical f) To coordinate with the organizer or organizers the logistics of the recognition award ceremonies.
• g)To verify that the recognitions that form part of SIREA comply with the requirements established in article 12° of this regulation.
• h)To select the SIREA insignia and recommend to the Minister of Environment, Energy, and Telecommunications the granting or withdrawal of these to the organizer or organizers or to the organizations that were recognized in accordance with the provisions of Chapter VI of this regulation. Likewise, to make public knowledge of the withdrawal of the commercial use of the insignia.
• i)To promote Voluntary Agreements on Cleaner Production within the framework of SIREA.
• j)To monitor and supervise the powers and responsibilities of the organizer or organizers of the initial SIREA recognitions, in accordance with the provisions of this regulation and the collaboration agreements that may arise as per subsection c.5. of this article and articles 5° subsection b) and 7° subsection b) of this regulation.
• k)To review the financial and operational reports issued by the Organizer of the recognitions contemplated in article 10° of this regulation.

The powers and responsibilities of the organizer of a recognition incorporated into SIREA are the following:

• a)To issue technical criteria at the request of the SE on matters related to the implementation of this regulation.
• b)To assume the general technical and logistical processes of the recognition under its charge. In the case of being an Organizer of one of the recognitions created in article 10° of this Regulation, it must sign an agreement with the Ministry of Environment, Energy, and Telecommunications.
• c)To verify compliance with the requirements presented by the organizations according to the corresponding recognition.
• d)To schedule and review the evaluations submitted by the evaluators and technical experts to verify they comply with the requirements established in this regulation.
• e)To have evaluators and technical experts who ensure compliance with the responsibilities attributed to them, according to article 8º of this regulation.
• f)To maintain a Registry of Recognized Organizations, as well as of Evaluators and Technical Experts. These registries must be updated and reported to the SE.
• g)To have a system for training, awareness-raising, and supervision of the evaluators and technical experts that guarantees compliance with legal, technical, and ethical standards.
• h)To recommend to the SE the granting of the recognition or recognitions to the organizations, based on a report of the evaluation results of these. In the case of existing recognitions that are incorporated into SIREA, they shall only submit to the SE the list of organizations to be recognized.
• i)To coordinate jointly with the SE the realization of the protocolary award ceremony for the recognitions.
• j)To document and record the results and information related to the recognition processes under its responsibility, for which it must submit an annual report to the SE on the implementation of the recognition or recognitions under its charge.
• k)To manage the collection and control of evaluation and registration costs.
• l)To assume the administrative, civil, and criminal liability for its acts, as applicable, before third parties, whether these are participating organizations or other natural or legal persons.
• m)To have mechanisms for control, record-keeping, custody, and safeguarding of confidentiality of all documentation linked to the evaluation processes of organizations, for purposes of transparency and monitoring by the SE.
• n)To attend to inquiries, appeals, or claims, as applicable, that may arise from the organizations during the evaluation process, evaluation results, and validity of the recognition.
• o)To issue, at the request of the SE, a technical report in the event of appeals, inquiries, or administrative claims, which may be filed on the occasion of the recognition process. The foregoing applies to the organizers of the initial recognitions created in article 10° of this Regulation.
• p)To comply with the frequency of awarding the recognition it organizes.
• q)To provide the information required by the SE for the monitoring and supervision of the requirements contained in article 12º of this regulation.
• r)To comply with all the provisions applicable to it in its function as organizer under this regulation.
• s)To submit an annual financial and operational report to the SE. The foregoing applies to the organizers of the initial recognitions created in article 10° of this regulation.

The powers and responsibilities of the evaluators and technical experts are:

• a)To participate in the training sessions scheduled by the Organizer of a SIREA recognition.
• b)To comply with the requirements related to the professional profile, procedures related to the evaluation process, qualification, and granting of the recognition.
• c)To carry out the scheduled evaluation visits at the facilities of the participating Organization assigned by the Organizer of a SIREA recognition.
• d)To apply the evaluation criteria assigned to them by the Organizer of the recognition.
• e)To present the results of the technical findings encountered to the Organizer of the recognition.
• f)To handle confidentially the information obtained as part of the technical evaluation process.

The evaluators and technical a. To be professionally pertinent to the evaluations to be carried out, according to the recognition and the subject to be evaluated.

b. To be registered with the respective professional associations.

c. To have at least 2 years of experience in the evaluation areas, according to the recognition.

Recognitions of SIREA

The following are created as initial recognitions of SIREA:

a. Cleaner production.

b. Eco-efficiency.

c. Social Responsibility.

d. Environmental entrepreneurship.

The recognitions existing in the country at the time of publication of this regulation may be incorporated into SIREA, and to do so they must comply with the requirements indicated in article 16° of this regulation.

Each SIREA recognition must:

• a)Have an Organizer with the capacity to fulfill the functions described in this regulation.
• b)Address environmental matters.
• c)Have a transparent and objective evaluation system in which there are clear, verifiable, and quantifiable criteria.

Those recognitions incorporated into SIREA shall have the following benefits:

Incorporation of Existing Recognitions into SIREA

Throughout the year, the SE of SIREA shall receive applications from those organizers who wish to incorporate their environmental recognitions into the system through the form indicated in article 16° subsection b) of this regulation.

The organizers who aspire to incorporate the recognition under their charge into SIREA must:

• a)Comply with the basic requirements contemplated in article 12° of this regulation.
• b)Fill out the official registration form available on the MINAET website.
• c)Undergo an evaluation process by the SE, through which its capacity to serve as Organizer of a SIREA recognition shall be verified.

The Minister of MINAET, within a period of 30 business days from the submission of the requirements set out in article 16° of this regulation, shall provide a response to the applications for incorporation of existing recognitions into SIREA, prior to the recommendation issued by the SE.

The organizers in disagreement with the evaluation results may file administrative appeals or claims with the Minister of Environment, Energy, and Telecommunications, in accordance with the provisions of the General Law of Public Administration.

Once the recognition has been incorporated into SIREA, its term of permanence within the system shall be indefinite, as long as it complies with the provisions of this regulation. In the event of non-compliance, the recognition shall be excluded from the system, after fulfillment of due process.

Registration and Evaluation Procedures for Organizations Opting for the Initial Recognitions.

The SE of SIREA, in conjunction with the Organizer of each initial recognition, shall summon organizations to participate in the initial recognitions indicated in article 10° of this regulation. The registration period shall begin on the first business day of the month of January and shall end on the last business day of the month of February of each year.

The organizations that wish to apply for a SIREA recognition must comply with the current legal regulations pertaining to the activity for which it submits the recognition.

Registration by the Organization in the initial recognitions is voluntary. The Organization must fulfill the following requirements before the Organizer:

• a)To complete, within the period established in article 20° of this regulation, the registration form that shall be published in the first two weeks of the month of December of each year on the website of the Ministry of Environment, Energy, and Telecommunications.

This information must be provided by the legal representative of the Organization in the case of a legal entity, and in the case of a natural person, it shall be this person who fills out the form. The information provided through the form shall have the character of a sworn statement.

• b)To pay the corresponding amount for the registration fee.
• c)To undergo the evaluation process in the event that its registration has been approved.

The Organizer shall have a period of fifteen business days to approve the Organization's registration, a period that shall be computed from the time the Organization completes the requirements for its registration. In the event that the registration is incomplete or clarifications are needed, the Organization, at the request of the Organizer, within a period of 10 business days, must complete it or clarify the existing doubts; otherwise, the application shall be archived.

Once the registration has been reviewed and approved, the Organizer shall designate the evaluator or evaluators, who shall be in charge of carrying out the documentary and on-site evaluation of the Organization; subsequently, the Organization must pay the Organizer the amount corresponding to the evaluation costs in accordance with the provisions of article 25° of this regulation. The Organization shall have a period of fifteen business days to pay the total cost of the evaluation, which shall be computed from the time the Organizer informs the Organization of the costs of its evaluation.

The evaluation to be carried out on the applicant Organization must be based on the methodology of evaluation defined by MINAET through an administrative resolution.

During the evaluation process, the Organization must participate actively and transparently and openly provide the required information.

The Organizer must send to the SE the results of the evaluations carried out as indicated in Article 7, subsection h) of this regulation, no later than the last business day of the month of September.

In the event that an Organization holds an environmental certification or recognition, granted by an entity that is accredited to grant such certification under an internationally or nationally recognized certification system, it may request from the Organizer, within the period stipulated in Article 20 of this regulation, the acceptance of the evaluation criteria, provided that they coincide with those established in the respective initial recognitions.

The criteria for establishing the registration and evaluation costs will be defined by the Executive Branch through an executive decree.

The evaluation costs for each Organization will depend on the scope of that Organization; for this purpose, the Organizer of a recognition will determine the required evaluation time, as well as the profile and number of required evaluators, and based on this, will calculate the total amounts payable by the organizations for evaluation and follow-up according to the established costs.

The Organizer shall be empowered to exclude the participating Organization that supplies false, inaccurate, or adulterated information, for the purpose of inducing the evaluation team to erroneous conclusions; in addition, the Organization will lose the opportunity to opt for the environmental recognition in which it is participating, without prejudice to any applicable criminal, civil, and administrative liabilities. The same sanction shall be applied to the Organization that seeks to obtain a recognition without complying with the established procedures, without agreeing to undergo the technical evaluation, or through an improper payment. In this case, the Organization will forfeit the amounts paid for registration and evaluation.

The Minister of Environment, Energy, and Telecommunications, through the organizers, will communicate the results of the evaluation to the organizations in the month of September. The list of recognized organizations will be disseminated through mass media and published on the MINAET website; additionally, a public ceremony will be held in the month of December of each year where the recognition will be officially awarded.

Organizations disagreeing with the evaluation results may file administrative appeals or complaints with the Minister of Environment, Energy, and Telecommunications, in accordance with the provisions of the General Public Administration Law (Ley General de la Administración Pública).

The recognitions included in this chapter shall have a validity of two years.

The Organization awarded a recognition shall be subject to follow-up visits by the Organizer of the recognition or by the SE to verify the maintenance of the criteria under which the recognition was granted.

An Organization may apply to the Organizer for the renewal of the granted recognition for another equal period, as long as it maintains the same scope as the initial recognition. The Organization interested in renewing its recognition must pay the corresponding amount for the renewal process in accordance with the registration and evaluation costs defined in Article 25 of this regulation and which will be published through an executive decree issued by the Executive Branch. The renewal application to the Organizer must be made ninety business days prior to the expiration date of its recognition, through an application containing the following information:

• a)Renewal application form published on the website of the Ministry of Environment, Energy, and Telecommunications, which will be available during the second semester of the year. b) Payment receipt corresponding to the renewal. c) Undergo the evaluation process stipulated in Article 23 of this regulation.

The Organizer will receive renewal applications during the month of July of each year.

The approval of the renewal application shall be subject to compliance with the evaluation methodology defined by the Minister of MINAET through an administrative resolution. For the foregoing, the Organizer of the recognition must appoint a technical team responsible for the evaluation process. The Organizer shall have a period of sixty business days to approve said renewal application, which shall be calculated from the moment the renewal application by the Organization is complete.

An Organization shall lose its right to renew the recognition granted through this mechanism when:

• a)It fails to comply with the current regulations applicable to its activity, at the time of applying for the renewal of the recognition. b) It fails to comply with the provisions of Article 32 of this regulation. c) Any environmental authority has imposed urgent application measures derived from a situation that caused or could have caused damage to the environment or the population, which are in effect at the time of applying for the renewal of the recognition. d) It has been subject to a sanction by any environmental, health, or labor authority in the year immediately preceding the call for this recognition and/or which is in effect at the time of applying for the renewal of the environmental recognition. e) It has not submitted the renewal application with the advance notice indicated in this regulation.

The Organization holding any of the recognitions shall be obligated to report in writing to the Organizer any change or non-compliance with the commitments undertaken during the recognition process and validity period, within a period of fifteen business days following the occurrence of the change or non-compliance, the foregoing, when said change is detrimental to the improvement of environmental performance. In the event of non-compliance with this obligation, the SE may withdraw the recognition obtained by the participating Organization.

Within the framework of SIREA, the Minister of Environment, Energy, and Telecommunications shall grant the following distinctions:

• a)A distinction identifying those recognitions that have been incorporated into SIREA. b) A distinction identifying each of the initial recognitions stipulated in Article 10 of this regulation.

The right and use of the aforementioned distinctions and their scope shall be established through an administrative resolution issued by the Minister of MINAET.

Recognized organizations may use the distinction of the recognition to advertise or commercialize their products and services, as long as it is valid, the type of recognition obtained is specified, as well as the physical scope and the processes evaluated for the recognition. The participating Organization that violates the provisions of this article may be subject to an administrative procedure for the immediate withdrawal of the distinction and any other sanction established in national legislation.

All those legal entities, public or private, that comply with current regulations and that are not yet eligible for the initial SIREA recognitions, may register and participate in the Program of Voluntary Agreements on Cleaner Production (Acuerdos Voluntarios de Producción más Limpia).

For legal entities, public or private, to participate in the Voluntary Agreements on Cleaner Production, they must meet the following requirements:

• a)Compliance with the national regulations pertaining to the activity carried out by the Organization. b) Complete the registration form available on the MINAET website. This information must be provided by the legal representative of the Organization and shall be in the nature of a sworn statement (declaración jurada). c) Formalize a Voluntary Agreement on Cleaner Production with the Ministry of Environment, Energy, and Telecommunications and other competent institutions, according to the productive sector involved. d) Pay the registration and evaluation amounts, in accordance with the provisions of Article 25 of this regulation. e) Undergo an initial diagnostic process and intermediate and final evaluations of compliance with the goals set in the Voluntary Agreement on Cleaner Production.

All technical and logistical processes of the Voluntary Agreements on Cleaner Production shall be the responsibility of the Organizer of the recognition in Cleaner Production, when so agreed in the respective agreement.

Those organizations that achieve the goals established in their Voluntary Agreements on Cleaner Production shall be made public knowledge.

Executive Decree No. 33525-MINAE "Regulation for Granting the Bandera Ecológica Certificate" (Reglamento para otorgar el certificado Bandera Ecológica) of November 27, 2006, is hereby repealed.

Issued at the Presidency of the Republic on the thirteenth day of February, two thousand twelve.

Likewise, within this period, the Ministry of Environment, Energy, and Telecommunications must secure the human and logistical resources necessary to make the SE operational.

"REGLAMENTO DEL SISTEMA DE RECONOCIMIENTOS AMBIENTALES (SIREA) Y DEROGATORIA DEL DECRETO EJECUTIVO N° 33525-MINAE, REGLAMENTO PARA OTORGAR EL CERTIFICADO BANDERA ECOLÓGICA DEL 27 DE NOVIEMBRE DE 2006"

Aspectos generales del Sistema de Reconocimientos Ambientales

Créase el Sistema de Reconocimientos Ambientales (en adelante SIREA), que tendrá como objetivo reconocer públicamente a aquellas organizaciones que se han destacado por provocar un cambio significativo en el campo ambiental del país; contribuyendo al logro de los objetivos del Plan Nacional de Desarrollo y a una estrategia nacional de desarrollo sostenible a largo plazo.

Los objetivos específicos del SIREA son los siguientes:

• a)Constituirse en un sistema de reconocimiento estatal en materia ambiental.
• b)Integrar los reconocimientos ambientales del país de acuerdo con los requerimientos definidos en este reglamento.
• c)Contribuir a prevenir la contaminación ambiental mediante la adopción de buenas prácticas de producción más limpia, eco-eficiencia y responsabilidad social en los sectores público y privado.
• d)Contribuir a optimizar el uso de los recursos mediante la promoción y puesta en práctica de acciones de reducción y uso eficiente de éstos, en las organizaciones públicas y privadas.
• e)Promover la incorporación del mayor número de organizaciones al SIREA, mediante la adopción de Acuerdos Voluntarios que canalicen esfuerzos hacia la eco-competitividad.
• f)Dictar los lineamientos generales en materia de reconocimientos ambientales que permitan a las nuevas iniciativas de reconocimientos que se promuevan a nivel nacional cumplir los requisitos definidos en el SIREA.
• g)Dar a conocer e impulsar las experiencias novedosas y de impacto positivo en el ambiente.
• h)Promover en las organizaciones la toma de acciones en forma decidida en materia ambiental y esquemas responsables en la producción y el consumo de bienes y servicios.
• i)Fomentar el aumento de la eco-competitividad a través de instrumentos voluntarios de gestión ambiental y reconocimientos.
• j)Contar con un sistema ágil y claro que contemple una metodología de evaluación con criterios, sub-criterios de evaluación y alcances para distintos reconocimientos, que estén en estrecha coincidencia con parámetros internacionales y que permita avanzar gradualmente hasta alcanzar la responsabilidad social.
• k)Consolidar una plataforma organizativa que permita la operación efectiva del SIREA a largo plazo.

Los principios generales de gestión que enmarcan y orientan la operación del SIREA son los siguientes:

• a)Rendición de cuentas: responsabilidad de una Organización de ofrecer respuestas a los órganos de gobierno, autoridades legales y a otras partes interesadas, respecto a sus decisiones y acciones.
• b)Comportamiento ético: comportamiento que es coherente con los principios de buena conducta generalmente aceptados en el contexto de una situación determinada y que es coherente con la normativa nacional e internacional relacionada con el tema.
• c)Cooperación público-privada: conjunto de acciones realizadas entre los sectores público y privado para garantizar el cumplimiento de la legislación, la implementación del Plan Nacional de Desarrollo (PND) y los planes de mejora continua.
• d)Cumplimiento de la legislación nacional: acción y efecto de cumplir con los deberes u obligaciones establecidos en la legislación por parte de una Organización.
• e)Enfoque social: orientación hacia el tema social como variable continua a considerar en los distintos estadíos de avance de las organizaciones para atender los principios del desarrollo sostenible.
• f)Mejora continua: estrategia o metodología de la calidad de las organizaciones basada en la búsqueda y aplicación continua de oportunidades de mejora.
• g)Transparencia: apertura en cuanto a las decisiones y actividades que afectan a la sociedad y al medioambiente y voluntad de comunicar éstas de manera clara, exacta y completa.

Para efectos de este reglamento se entenderá por:

• a)Acuerdos Voluntarios de Producción más Limpia: Acuerdo voluntario, que se lleva a cabo entre los ministerios con competencia en el tema del cual se trata éste y un sector o ente productivo que se acoge a un mecanismo de autorregulación, mediante el establecimiento de metas claras y compromisos de mutuo acuerdo en el tema de producción más limpia, que les llevarán a un mejor desempeño económico y ambiental.
• b)Cooperación pública-privada: Intercambio de información y promoción de mejores prácticas promovidas por el Ministerio de Ambiente, Energía y Telecomunicaciones y otras instancias con el fin de avanzar como país hacia la eco-competitividad y ser carbono neutral en el 2021.
• c)Criterios de evaluación: Parámetros de carácter cuantitativo utilizado para evaluar a una Organización en un tema específico. El cumplimiento de los criterios definidos para una categoría de reconocimiento, son un requisito para obtener ese reconocimiento, ya sea con el fin de inscribirse en el SIREA o renovar su participación en éste.
• d)Desarrollo sostenible: Modelo de desarrollo que comprende la dimensión social, económica y ambiental, en la cual se impulsa un uso y manejo sostenible de los recursos naturales, de tal manera que pueda satisfacer las necesidades de las generaciones presentes sin comprometer las posibilidades de las generaciones futuras para atender sus propias necesidades.
• e)Eco-competitividad: La eco-competitividad es una estrategia integral basada en un enfoque de ciclo de vida en la utilización de los recursos, que busca la creación de ventajas competitivas para una empresa, Organización o país, que le permitan obtener un beneficio que provoque una mejora en términos productivos, sociales y ambientales. Dicha estrategia se basa entre otros aspectos en: la utilización de tecnologías, innovaciones, técnicas de producción más eficientes o el uso sostenible de los recursos. Todo ello con el fin de obtener una mejor posición en el mercado, una mejor imagen, una mayor cantidad y/o calidad de productos o servicios, tener costos de producción menores por unidad de producto, reducir los impactos negativos generados a la sociedad o al medio ambiente y mejorar la calidad de vida de las personas.
• f)Eco-eficiencia: Crear más bienes y servicios utilizando menos recursos mientras se reduce la polución y la generación de residuos. La eco-eficiencia se alcanza mediante la distribución de "bienes con precios competitivos y servicios que satisfagan las necesidades humanas y brinden mayor calidad de vida, a la vez que reduzcan progresivamente los impactos medioambientales de bienes y la intensidad de uso de los recursos, a través del análisis del ciclo de vida de un producto o servicio".
• g)Emprendedurismo ambiental: Es un reconocimiento ambiental que se otorga a organizaciones o comunidades, por sus logros o innovaciones en un área específica del quehacer humano que potencien la mejora del ambiente y la calidad de vida de los pobladores del país.
• h)Evaluador: Persona designada por el Organizador de un reconocimiento para realizar la evaluación de una Organización que aplica a un reconocimiento o a un acuerdo voluntario del SIREA.
• i)Experto Técnico: Persona asignada por el Organizador para aportar conocimientos técnicos específicos o experiencia en la evaluación de una Organización que aplica a un reconocimiento o a un acuerdo voluntario del SIREA.
• j)Galardón Ambiental: Reconocimiento ambiental otorgado a una Organización.
• k)Gradualidad de los reconocimientos: Es el incremento gradual y acumulativo de criterios de evaluación y alcance al pasar de una categoría de reconocimiento a otra. Se incluye el Emprendedurismo ambiental y se inicia con la producción más limpia, pasando luego a la Eco-eficiencia, para llegar por último a la Responsabilidad social.
• l)Organización: Se entenderá por Organización a todas las personas físicas y jurídicas, públicas y privadas que opten por un reconocimiento o un acuerdo voluntario.
• m)Organizador: Es un ente público encargado de gestionar los procesos técnicos y logísticos de algún reconocimiento del SIREA.
• n)Reconocimiento en Eco-eficiencia: Galardón que se otorga a una Organización que aplica un proceso continuo en el que maximiza la productividad de los recursos, minimiza desechos y emisiones, generando valor agregado.
• o)Reconocimiento en Emprendedurismo ambiental: Galardón que se otorga a una Organización que por sus logros o innovaciones en un área específica del quehacer humano potencie la mejora del ambiente y la calidad de vida de la sociedad del país.
• p)Reconocimiento en Producción más limpia: Galardón que se otorga a una Organización que aplica de forma continúa una estrategia ambiental, preventiva e integral, a los procesos, productos y servicios, con el objetivo de reducir riesgos al ser humano y al medio ambiente.
• q)Reconocimiento en Responsabilidad Social: Para efectos de este reglamento, el reconocimiento en Responsabilidad Social es un galardón que distingue a una Organización que incorpora en su funcionamiento de forma integral un conjunto de criterios sociales, ambientales y económicos, los cuales se cumplen en su totalidad y son parte integral de su gestión.
• r)Reconocimiento: Reconocimiento público al cual las organizaciones pueden acceder de manera voluntaria, con el objeto de evidenciar logros específicos que demuestren que están realizando un esfuerzo sistemático, sostenido y exitoso en procura del desarrollo sostenible, de acuerdo con los principios y requerimientos del SIREA. Se otorga a una Organización que habiéndose sometido al sistema de evaluación propuesto por el SIREA, obtiene el puntaje que la hace merecedora de dicho galardón.
• s)Reconocimientos iniciales: Aquellos contemplados en el artículo 10° de este reglamento.
• t)SIREA: Sistema de Reconocimientos Ambientales de carácter estatal que integra los reconocimientos ambientales indicados en el presente reglamento, así como otros que se incorporen en el futuro. Comprende una estructura organizativa y logística que le da soporte.

Elementos del SIREA

El SIREA estará conformado por las siguientes instancias:

• a)Secretaría Ejecutiva (SE): Es un órgano permanente que tendrá como función asesorar y apoyar al Ministro de Ambiente, Energía y Telecomunicaciones (MINAET) para el seguimiento del SIREA. La SE estará integrada por: el Ministro del MINAET o un representante nombrado por él y las siguientes Direcciones del MINAET, la Dirección de Gestión de Calidad Ambiental (DIGECA), quien coordinará la SE, la Dirección de Cambio Climático (DCC) y la Dirección Sectorial de Energía (DSE). La SE podrá ser asesorada por expertos técnicos en las materias que se requieran y constituir comisiones ad hoc.

Las instancias anteriores contarán con quince días a partir de la publicación de este decreto en el Diario Oficial la Gaceta, para realizar el nombramiento de sus representantes y sus respectivos suplentes. Así mismo, transcurrido un mes a partir de dicha publicación, la SE empezará a sesionar una vez por mes con los representantes acreditados, y contarán con un mes adicional para acordar su Organización interna, procedimientos de trabajo, convocatoria y acuerdos de conformidad con lo establecido en el Titulo II, Capítulo Tercero de la Ley General de la Administración Pública.

• b)Organizador: Ente público con experiencia en la materia ambiental y de reconocida trayectoria nacional. Será facultativo para el Ministerio de Ambiente, Energía y Telecomunicaciones convenir con éste aspectos operativos de uno o de diversos reconocimientos tal y como se indica en el artículo 7° de este reglamento, para ello deberá firmarse un convenio de cooperación entre el Ministerio de Ambiente, Energía y Telecomunicaciones y el Organizador, el cual será de conocimiento público. En el SIREA podrán participar uno o varios organizadores, de acuerdo a los reconocimientos que se integren.

Son potestades y responsabilidades de la SE del SIREA las siguientes:

• a)Seleccionar a los organizadores de cada uno de los reconocimientos iniciales que se crean en el artículo 10° de este reglamento.
• b)Crear y mantener actualizados los siguientes registros:

b.1) Registro de Reconocimientos Ambientales incorporados al SIREA; b.2) Registro de Organizadores de los Reconocimientos incorporados al SIREA; b.3) Registro de Organizaciones reconocidas; b.4) Registro de organizaciones que están participando en Acuerdos Voluntarios de Producción más Limpia.

Estos registros estarán disponibles en el sitio web del MINAET.

• c)Someter a conocimiento del Ministro de Ambiente, Energía y Telecomunicaciones:

c.1. Los instrumentos normativos que se requieran para la efectiva implementación de los reconocimientos del SIREA.

c.2. Las recomendaciones de incorporación de reconocimientos al SIREA.

c.3. Las recomendaciones de las organizaciones que aprobaron el proceso de evaluación para los reconocimientos iniciales creados en el artículo 10° del presente reglamento.

c.4. Estudios de los costos de los servicios prestados por el o los organizadores del SIREA según corresponda. Los costos a cobrar por parte de los organizadores serán oficializados a través de un decreto ejecutivo emitido por parte del Poder Ejecutivo.

c.5. Convenios de cooperación entre el MINAET y el o los organizadores, de conformidad con lo establecido en los artículos 5° inciso b) y 7° inciso b) de este reglamento.

• c)Dar seguimiento a los recursos legales o reclamaciones que se puedan presentar en el trámite de cualquiera de los reconocimientos iniciales creados en el artículo 10° del presente reglamento.
• d)Elaborar y actualizar el perfil de los evaluadores y expertos técnicos de los reconocimientos iniciales del SIREA creados en el artículo 10º de este reglamento.
• e)Informar a las organizaciones, en coordinación con los organizadores, el resultado de las evaluaciones realizadas por los evaluadores y expertos técnicos.
• f)Coordinar con el o los organizadores, la logística de los actos de entrega de reconocimientos.
• g)Verificar que los reconocimientos que formen parte del SIREA cumplan los requisitos establecidos en el artículo 12° de este reglamento.
• h)Seleccionar los distintivos del SIREA y recomendar al Ministro de Ambiente, Energía y Telecomunicaciones el otorgamiento o retiro de éstos al o los organizadores o a las organizaciones que fueron reconocidas de conformidad con lo establecido en el Capítulo VI de este reglamento. Así mismo, hacer de conocimiento público el retiro del uso comercial del distintivo.
• i)Promover los Acuerdos Voluntarios en Producción más Limpia en el marco del SIREA.
• j)Dar seguimiento y fiscalización a las facultades y responsabilidades del o los organizadores de los reconocimientos iniciales del SIREA, de conformidad con lo contemplado en este reglamento y en los convenios de colaboración que puedan surgir de acuerdo a lo consignado en el inciso c.5. de este artículo y los artículos 5° inciso b) y 7° inciso b) de este reglamento.
• k)Revisar los informes financieros y de operación emitidos por parte del Organizador de los reconocimientos contemplados en el artículo 10° de este reglamento.

Son facultades y responsabilidades del organizador de un reconocimiento incorporado al SIREA las siguientes:

• a)Emitir criterio técnico a solicitud de la SE en los temas vinculados con la implementación de este reglamento.
• b)Asumir los procesos técnicos y logísticos generales del reconocimiento a su cargo. En el caso de ser un Organizador de uno de los reconocimientos creados en el artículo 10° de este Reglamento deberá suscribir un convenio con el Ministerio de Ambiente, Energía y Telecomunicaciones.
• c)Verificar el cumplimiento de requisitos presentados por las organizaciones de acuerdo al reconocimiento que corresponda.
• d)Programar y revisar las evaluaciones presentadas por los evaluadores y el presente reglamento.
• e)Contar con evaluadores y expertos técnicos que aseguren el cumplimiento de las responsabilidades que se le atribuyan a éstos, según artículo 8º de este reglamento.
• f)Mantener un Registro de Organizaciones reconocidas, así como de Evaluadores y Expertos Técnicos. Estos registros deberán ser actualizados y reportados a la SE.
• g)Contar con un sistema de capacitación, sensibilización y supervisión de los evaluadores y expertos técnicos que garantice el cumplimiento de las normas legales, técnicas y éticas.
• h)Recomendar a la SE el otorgamiento del o los reconocimientos a las organizaciones, con base en un informe de resultados de la evaluación de éstas. En el caso de los reconocimientos existentes que se incorporen al SIREA únicamente deberán remitir a la SE el listado de las organizaciones a reconocer.
• i)Coordinar en conjunto con la SE la realización del acto protocolario de entrega de reconocimientos.
• j)Documentar y registrar los resultados y la información relativa a los procesos de reconocimiento bajo su responsabilidad, para lo cual deberá presentar un informe anual a la SE sobre la implementación del o los reconocimientos a su cargo.
• k)Realizar la gestión de cobro y control de costos de evaluación y de inscripción.
• l)Asumir la responsabilidad administrativa, civil y penal de sus actos según corresponda, ante terceros, sean éstos organizaciones participantes u otras personas físicas o jurídicas.
• m)Contar con mecanismos de control, registro, custodia y resguardo de confidencialidad de toda la documentación vinculada con los procesos de evaluación de las organizaciones, para efectos de transparencia y seguimiento por parte de la SE.
• n)Atender las consultas, recursos o reclamos según correspondan, que puedan surgir por parte de las organizaciones durante el proceso de evaluación, resultados de evaluación y vigencia del reconocimiento.
• o)Emitir a solicitud de la SE un informe técnico en caso de recursos, consultas o reclamos administrativos, los cuales se pueden presentar con ocasión del proceso de reconocimiento. Lo anterior para el caso de los organizadores de los reconocimientos iniciales creados en el artículo 10° de este Reglamento.
• p)Cumplir con la frecuencia de entrega del reconocimiento que organiza.
• q)Brindar la información requerida por la SE para el seguimiento y fiscalización de los requisitos contenidos en el artículo 12º de este reglamento.
• r)Cumplir con todas las disposiciones que le sean aplicables en su función de organizador en este reglamento.
• s)Presentar de manera anual a la SE un informe financiero y de operación. Lo anterior para el caso de los organizadores de los reconocimientos iniciales creados en el artículo 10° de este reglamento.

Son facultades y responsabilidades de los evaluadores y expertos técnicos:

• a)Participar en las capacitaciones programadas por el Organizador de un reconocimiento del SIREA.
• b)Cumplir con los requisitos relacionados con el perfil profesional, procedimientos relacionados al proceso de evaluación, calificación y otorgamiento del reconocimiento.
• c)Realizar las visitas de evaluación programadas en las instalaciones de la Organización participante que le asigne el Organizador de un reconocimiento del SIREA.
• d)Aplicar los criterios de evaluación que le sean asignados por el Organizador del reconocimiento.
• e)Presentar los resultados de los hallazgos técnicos encontrados al Organizador del reconocimiento.
• f)Manejar de forma confidencial la información obtenida como parte del proceso de evaluación técnica.

Los evaluadores y expertos técnicos deberán cumplir los siguientes requisitos:

a. Ser profesionalmente atinentes a las evaluaciones a realizar según sea el reconocimiento y el tema a evaluar.

b. Estar inscritos ante los colegios profesionales respectivos.

c. Contar como mínimo con 2 años de experiencia en las áreas de evaluación según sea el reconocimiento.

Reconocimientos del SIREA

Se crean como reconocimientos iniciales del SIREA los siguientes:

a. Producción más limpia.

b. Eco-eficiencia.

c. Responsabilidad Social.

d. Emprendedurismo ambiental.

Los reconocimientos existentes en el país al momento de publicación del presente reglamento podrán incorporarse al SIREA, para ello deberán cumplir con los requisitos señalados en el artículo 16° de este reglamento.

Cada reconocimiento del SIREA deberá de:

• a)Contar con un Organizador con capacidad para cumplir las funciones descritas en el presente reglamento.
• b)Tratar sobre la temática ambiental.
• c)Tener un sistema de evaluación transparente y objetivo en el cual existan criterios claros, verificables y cuantificables.

Aquellos reconocimientos incorporados al SIREA contarán con los siguientes beneficios:

1. Un distintivo para uso comercial que los destaca como parte del SIREA.

2. Ser parte del Registro de Reconocimientos Ambientales.

3. La promoción e información que pueda realizar el Ministerio de Ambiente, Energía y Telecomunicaciones por medios oficiales.

Energía y Telecomunicaciones Todos aquellos reconocimientos creados a futuro por parte del Ministerio de Ambiente, Energía y Telecomunicaciones, deberán incorporarse al SIREA.

Incorporación de reconocimientos existentes al SIREA

Durante todo el año la SE del SIREA recibirá solicitudes de aquellos organizadores que deseen incorporar sus reconocimientos ambientales al sistema a través del formulario indicado en el artículo 16° inciso b) de este reglamento.

Los organizadores que aspiren incorporar al SIREA el reconocimiento a su cargo deberán:

• a)Cumplir con los requisitos básicos contemplados en el artículo 12° de este reglamento.
• b)Llenar el formulario oficial de inscripción disponible en el sitio web del MINAET.
• c)Someterse a un proceso de evaluación por parte de la SE, por medio de la cual se verificará su capacidad para fungir como Organizador de un reconocimiento del SIREA.

existentes al SIREA.

El Ministro del MINAET, en un plazo de 30 días hábiles a partir de la presentación de los requisitos consignados en el artículo 16° de este reglamento, otorgará respuesta a las solicitudes de incorporación de reconocimiento existentes al SIREA, previa recomendación emitida por la SE.

Los organizadores en desacuerdo con los resultados de la evaluación podrán presentar los recursos o reclamos administrativos al Ministro de Ambiente, Energía y Telecomunicaciones, de conformidad con lo establecido en la Ley General de la Administración Pública.

Una vez que el reconocimiento se haya incorporado al SIREA, el plazo de permanencia de éste dentro del sistema será indefinido, siempre y cuando cumpla con lo establecido en el presente reglamento. En caso de incumplimiento se excluirá el reconocimiento del sistema, previo cumplimiento del debido proceso.

Procedimientos de inscripción y evaluación de las organizaciones que opten por los reconocimientos iniciales.

La SE del SIREA en conjunto con el Organizador de cada reconocimiento inicial, convocará a las organizaciones a participar en los reconocimiento iniciales indicados en el artículo 10° de este reglamento. El período de inscripción iniciará el primer día hábil del mes enero y finalizará el último día hábil del mes de febrero de cada año.

Las organizaciones que deseen postularse por un reconocimiento del SIREA deberán cumplir con la normativa jurídica vigente que sea atinente a la actividad para la cual somete el reconocimiento.

La inscripción por parte de la Organización en los reconocimientos iniciales es voluntaria. La Organización deberá cumplir ante el Organizador los siguientes requisitos:

• a)Completar en el plazo establecido en el artículo 20° de este reglamento, el formulario de inscripción que será publicado en la primera quincena del mes de diciembre de cada año en el sitio web del Ministerio de Ambiente, Energía y Telecomunicaciones.

Esta información debe ser brindada por el representante legal de la Organización en caso de una persona jurídica y en el caso de una persona física, será esta la que llene el formulario. La información brindada por medio del formulario tendrá carácter de declaración jurada.

• b)Pagar el monto correspondiente por concepto de inscripción.
• c)Someterse al proceso de evaluación en caso de haber sido aprobada su inscripción.

El Organizador contará con un plazo de quince días hábiles para aprobar la inscripción de la Organización, plazo que se computará a partir del momento en que la Organización complete los requisitos para su inscripción. En el caso de que la inscripción esté incompleta o se necesiten aclaraciones, la Organización, a solicitud del Organizador, en el plazo de 10 días hábiles, deberá completarla o aclarar las dudas existentes; caso contrario se procederá al archivo de la solicitud.

Una vez revisada y aprobada la inscripción, el Organizador designará el o los evaluadores, los cuales serán los encargados de realizar la evaluación documental y presencial a la Organización, posteriormente ésta deberá cancelar al Organizador el monto correspondiente a los costos de evaluación de conformidad con lo establecido en el artículo 25° de este reglamento. La Organización tendrá un plazo de quince días hábiles para cancelar la totalidad del costo de la evaluación, los cuales se computarán a partir del momento en que el Organizador le comunica a la Organización los costos de su evaluación.

La evaluación a realizar a la Organización solicitante, deberá tomar como base la metodología de evaluación definida por el MINAET a través de resolución administrativa.

Durante el proceso de evaluación la Organización deberá participar activamente y facilitar con transparencia y apertura la información requerida.

El Organizador deberá remitir a la SE los resultados de las evaluaciones realizadas según lo indicado en el artículo 7°, inciso h) de este reglamento, a más tardar el último día hábil del mes de setiembre.

En el caso que una Organización cuente con una certificación o reconocimiento de carácter ambiental, otorgada por un ente que esté acreditado para otorgar dicha certificación bajo un sistema de certificación internacional o nacionalmente reconocido, podrá solicitar al Organizador en el plazo contemplado en el artículo 20° de este reglamento la aceptación de los criterios de evaluación, siempre y cuando sean coincidentes con los establecidos en los respectivos reconocimientos iniciales.

Los criterios para el establecimiento de los costos de inscripción y de evaluación serán definidos por el Poder Ejecutivo mediante decreto ejecutivo.

Los costos de evaluación para cada Organización dependerán del alcance de ésta, para ello el Organizador de un reconocimiento determinará el tiempo requerido de evaluación, así como el perfil y número de evaluadores requeridos y con base en esto, calculará los montos totales a pagar por las organizaciones por evaluación y seguimiento según los costos establecidos.

El Organizador estará facultado para excluir a la Organización participante que suministre información falsa, inexacta, adulterada, a efecto de inducir al equipo evaluador a conclusiones erróneas; además la Organización perderá la oportunidad de optar por el reconocimiento ambiental en el que participa, sin perjuicio de las responsabilidades penales, civiles y administrativas que correspondan. Igual sanción se le aplicará a la Organización que pretenda obtener un reconocimiento, sin cumplir con los procedimientos establecidos, sin que acepte realizar la evaluación técnica o a través de un pago indebido. En este caso, la Organización perderá los montos cancelados para la inscripción y evaluación.

El Ministro de Ambiente, Energía y Telecomunicaciones, a través de los organizadores, comunicará a las organizaciones en el mes de setiembre los resultados de la evaluación. El listado de organizaciones reconocidas se divulgará en los medios de comunicación masivos y se publicarán en el sitio web del MINAET, además se realizará un acto público en el mes de diciembre de cada año en donde se hará entrega oficial del reconocimiento.

Las organizaciones en desacuerdo con los resultados de la evaluación podrán presentar los recursos o reclamos administrativos al Ministro de Ambiente, Energía y Telecomunicaciones, de conformidad con lo establecido en la Ley General de la Administración Pública.

Los reconocimientos incluidos en este capítulo tendrán una vigencia de dos años.

La Organización galardonada con algún reconocimiento estará sujeta a visitas de seguimiento por parte del Organizador del reconocimiento o de la SE para verificar el mantenimiento de los criterios bajo los cuales se le otorgó el reconocimiento.

Una Organización podrá solicitar ante el Organizador la renovación del reconocimiento otorgado por otro período igual, siempre y cuando se mantenga con el mismo alcance del reconocimiento inicial. La Organización interesada en renovar su reconocimiento deberá pagar el monto correspondiente para el proceso de renovación de acuerdo a los costos de inscripción y de evaluación definidos en el artículo 25º de este reglamento y que serán publicados por decreto ejecutivo emitido por el Poder Ejecutivo. La solicitud de renovación ante el Organizador deberá realizarse con noventa días hábiles previos a la fecha de vencimiento de su reconocimiento, a través de una solicitud que contendrá la siguiente información:

• a)Formulario de solicitud de renovación publicado en el sitio web del Ministerio de Ambiente, Energía y Telecomunicaciones el cual se encontrará disponible durante el segundo semestre del año.
• b)Comprobante de pago correspondiente a la renovación.
• c)Someterse al proceso de evaluación contemplado en el artículo 23º de este reglamento.

El Organizador recibirá las solicitudes de renovación durante el mes de julio de cada año.

La aprobación de la solicitud de renovación quedará sujeta al cumplimiento de la metodología de evaluación definida por el Ministro del MINAET vía resolución administrativa. Para lo anterior, el Organizador del reconocimiento deberá nombrar un equipo técnico responsable del proceso de evaluación. El Organizador contará con un plazo de sesenta días hábiles para aprobar dicha solicitud de renovación, los cuales se computarán a partir del momento de que la solicitud de renovación por parte de la Organización se encuentre completa.

Una Organización perderá su derecho de renovación del reconocimiento otorgado por este mecanismo cuando:

• a)Incumpla la normativa vigente que le sea atinente a su actividad, al momento de solicitar la renovación del reconocimiento.
• b)Incumpla lo establecido en el artículo 32° de este reglamento.
• c)Alguna autoridad ambiental le establezca medidas de urgente aplicación derivadas de una situación que provocó o pudo haber provocado daños al medio ambiente o a la población, que estén vigentes al momento de solicitar la renovación del reconocimiento.
• d)Haya sido objeto de sanción por parte de cualquier autoridad ambiental, sanitaria o laboral en el año inmediato anterior al de la convocatoria del concurso de este reconocimiento y/o que esté vigente al momento de solicitar la renovación del reconocimiento ambiental.
• e)No haya presentado la solicitud de renovación con la antelación indicada en el presente reglamento.

La Organización que cuente con alguno de los reconocimientos estará obligada a reportar por escrito al Organizador cualquier cambio o incumplimiento con los compromisos asumidos durante el proceso y vigencia del reconocimiento en el plazo de quince días hábiles con posterioridad a la ocurrencia del cambio o incumplimiento, lo anterior, cuando dicho cambio vaya en detrimento de la mejora del desempeño ambiental. En caso de incumplir con esta obligación, la SE podrá retirar el reconocimiento obtenido por la Organización participante.

Utilización de los distintivos del SIREA

En el marco del SIREA, el Ministro de Ambiente, Energía y Telecomunicaciones otorgará los siguientes distintivos:

• a)Un distintivo que identifique a aquellos reconocimientos que han sido incorporados en el SIREA.
• b)Un distintivo que identifique a cada uno de los reconocimientos iniciales contemplados en el artículo 10º de este reglamento.

El derecho y uso de los distintivos anteriores y su alcance se establecerán vía resolución administrativa emitida por el Ministro del MINAET.

Las organizaciones reconocidas podrán hacer uso del distintivo del reconocimiento para hacer publicidad o comercializar sus productos y servicios, siempre y cuando éste se encuentre vigente, se especifique el tipo de reconocimiento obtenido, el alcance físico y los procesos evaluados para el reconocimiento. La Organización participante que incurra en la violación de lo dispuesto en este artículo podrá ser objeto de un procedimiento administrativo para el retiro inmediato del distintivo y a cualquier otra sanción establecida en la legislación nacional.

Acuerdos Voluntarios en Producción más Limpia

Todas aquellas personas jurídicas, públicas o privadas que cumplan con la normativa vigente y que aún no puedan optar por los reconocimientos iniciales del SIREA, podrán inscribirse y participar en el Programa de Acuerdos Voluntarios de Producción más Limpia.

Para que las personas jurídicas, públicas o privadas puedan participar en los Acuerdos Voluntarios en Producción más Limpia deben cumplir con los siguientes requisitos:

• a)Cumplimiento de la normativa nacional atinente a la actividad que realiza la Organización.
• b)Completar el formulario de inscripción que se encuentra en el sitio web del MINAET. Esta información debe ser brindada por el representante legal de la Organización y tendrá carácter de declaración jurada.
• c)Formalizar un Acuerdo Voluntario en Producción más Limpia con el Ministerio de Ambiente, Energía y Telecomunicaciones y otras instituciones competentes, de acuerdo con el sector productivo del que se trate.
• d)Pagar los montos de inscripción y de evaluación, de acuerdo con lo establecido en el artículo 25º de este reglamento.
• e)Someterse a un proceso de diagnóstico inicial y evaluaciones intermedia y final de cumplimiento de metas fijadas en el Acuerdo Voluntario en Producción más Limpia.

Todos los procesos técnicos y logísticos de los Acuerdos Voluntarios en Producción más Limpia, será responsabilidad del Organizador del reconocimiento en Producción más Limpia, cuando así se acuerde en el convenio respectivo.

Voluntario de Producción más Limpia.

Aquellas organizaciones que alcancen las metas establecidas en sus Acuerdos Voluntarios de Producción más Limpia, se harán de conocimiento público.

Derogaciones y disposiciones transitorias

Deróguese el Decreto Ejecutivo N° 33525-MINAE "Reglamento para otorgar el certificado Bandera Ecológica" del 27 de noviembre de 2006.

Dado en la Presidencia de la República a los trece días del mes de febrero de dos mil doce.

Así mismo, dentro de este plazo, el Ministerio de Ambiente, Energía y Telecomunicaciones deberá asegurar los recursos humanos y logísticos que permitan poner en funcionamiento la SE.
