1That the inhabitants of the Republic have the right to a healthy and ecologically balanced environment, and it is the duty of the State to guarantee that right, defend it, and preserve it, as provided in Article 50 of the Constitución Política and the Ley Orgánica del Ambiente.
2That consumers and users have the right to equitable treatment and to adequate and truthful information about the characteristics of the products they consume.
3That with the purpose of giving substance to the foregoing considerations, since 1997 the Ministerio del Ambiente y Energía has put into operation the Bandera Ecológica certification, as a means of recognizing the efforts of legal entities engaged in manufacturing or service activities and of public institutions that carry out their productive activities in compliance with environmental and sanitary regulations and whose actions contribute to sustainable human development.
4That the Dirección de la Sociedad Civil created by Decreto Ejecutivo N° 27485-MINAE of October 13, 1998, is responsible for coordinating the implementation of the Programa Bandera Ecológica. Therefore,

d)Stimulate balanced development between society and nature.
e)Promote or participate in outreach, education, or training programs that involve citizens in its activities.
f)Develop an Environmental Management System.

Categories of Bandera Ecológica

CHAPTER IV

The environmental evaluation processes carried out annually will allow the Comisión Nacional de Bandera Ecológica to grant the corresponding certifications:

a)Bandera Ecológica A. This certification will be granted to those private companies and public institutions or companies that comply with the environmental and labor regulations relevant to their productive activity.
b)Bandera Ecológica '41ª. This certification will be granted to those private companies and public institutions or companies that, in addition to complying with the previous subsection, have begun the process of establishing their Environmental Management System, defining at least their environmental policy, environmental goals, and environmental objectives; have begun the process of building their procedures and records; and whose process of operationalizing the Environmental Management System can be defined as advanced.
c)Sello Verde. This certification will be granted to those private companies and public institutions or companies that, in addition to complying with subsection a), have 100% of their Environmental Management System in operation, which must comply with all the parameters established by the Comisión Nacional de Bandera Ecológica. Additionally, the production or service standards achieved by these private companies or public institutions may be categorized as world-class.
d)Amigos del Ambiente. This certification will be granted to those private companies and public institutions or companies that have maintained the certification in the Sello Verde category for at least four consecutive annual periods. Additionally, there must be a unanimous criterion among all those who participated in the evaluations of those four periods that a continuous improvement of their environmental performance exists.

Publicity of the Certification

CHAPTER V

They will have a maximum period of ten business days from the date the changes occurred to do so. The failure to comply with this obligation empowers the Comisión Nacional to withdraw the obtained certification.

Applications

CHAPTER VI

a)Register at the headquarters of the Programa Bandera Ecológica.
b)Undergo the annual environmental evaluation process directed by the Comisión Nacional de Bandera Ecológica and cover the corresponding costs of the registration, preparation, evaluation, and granting of the certification process.
c)Complete the Application Form that will be provided once the company or public institution is registered. The information provided through the Initial Form will have the character of an environmental self-assessment of the company's environmental and sanitary performance and will additionally have the character of a Declaración Jurada, which must be endorsed by the corresponding highest administrative authority of the company and by a competent professional in the field.

The Comisión will refer the matter to the corresponding authorities so that they may proceed as stipulated by law.

Duties of the Programa Bandera Ecológica

CHAPTER VII

The report resulting from said inspection will be sent to the Comisión Nacional de Bandera Ecológica for its study and constitutes in itself the second criterion of the evaluation process.

The Comisión Nacional de Bandera Ecológica will assign one or more responsible auditors, as appropriate for the requested audit. The Audit Report emanating from the respective process will constitute the third evaluation criterion. This audit must be conducted solely and exclusively by an auditor duly accredited before the Comisión Nacional de Bandera Ecológica.

The agreements of the Comisión Nacional will be established by simple majority.

CHAPTER VIII

In case of a tie vote in decision-making, the President of the Comisión Nacional may exercise the right to a double vote. Minutes will be kept of the matters dealt with in each session, and it will be composed as follows:

1)The Minister of Ambiente y Energía or their representative, who will preside.
2)The Director of the Oficina de Sociedad Civil of MINAE, who will act as Secretario Técnico.
3)A representative of Fundación Bandera Ecológica para la Gestión Ambiental y la Conservación de los Recursos Naturales, who will act exclusively as the executing entity of the Programa Bandera Ecológica.
4)A representative of the companies holding the Bandera Ecológica certification.
5)A representative of the group of auditors accredited before the Programa Bandera Ecológica.

a)Recommend to the Ministerio del Ambiente y Energía the policy to follow for the implementation of the Programa Bandera Ecológica.
b)Approve and put into operation, under the same operational scheme of the Programa Bandera Ecológica (Application, Inspection, Audit, and Dictamen), other environmental certification or environmental distinction systems relevant to sustainability, particular productive sectors, or others that share the philosophy and spirit of the Programa Bandera Ecológica. These new environmental certification systems must be c) Supervise and approve or disapprove the construction of technical tools to be used in the processes of the Programa Bandera Ecológica.
d)Evaluate and set guidelines to follow in the environmental evaluations to be carried out in the implementation of this Program.
e)Approve or deny the Bandera Ecológica certifications through resolutions that must be duly substantiated.
f)Publicize the list of certifications issued annually.
g)Establish the requirements for the accreditation of the Auditors of the Programa Bandera Ecológica.
h)Assign the auditors responsible for carrying out the Environmental Audit in each application from a company or institution, through the procedure that will be granted by Resolution.
i)Request collaboration or support from state institutions when deemed necessary, in order to reinforce their technical criteria before issuing their dictámenes.
j)Supervise and approve the implementation of a quality system in the certification process that the Programa Bandera Ecológica must establish.
k)Request the Fundación Bandera Ecológica to organize, hold, and manage a meeting every two years with the auditors accredited before the Programa Bandera Ecológica so that they may select their representatives to the Comisión Nacional de Bandera Ecológica.
1)The companies holding the certification will, every two years, provide the name of the person who will represent them before the Comisión Nacional. The Comisión Nacional will request the Fundación Bandera Ecológica to coordinate a meeting every two years with the companies holding the certification so that they may select their representatives to the Comisión Nacional de Bandera Ecológica.
m)Expand the certifications of the Programa Bandera Ecológica through the implementation of proposals and technical tools that have been developed by the Fundación Bandera Ecológica para la gestión ambiental y la conservación de los recursos naturales and approved by MINAE.
n)Any other function indicated by this Regulation or that stems from the assigned functions.

The Director of the Dirección General de Gestión Calidad Ambiental will be the person responsible for executing the guidelines and decisions of the Comisión Nacional de Bandera Ecológica and will act under its supervision. They will be appointed by the Ministerio del Ambiente y Energía; their responsibility also includes keeping the Consejo and the Ministerio del Ambiente y Energía informed about the application of this legislation and other laws whose application corresponds to the Programa Bandera Ecológica; likewise, they must supervise and monitor compliance with the regulations, policies, and guidelines on the matter.

(The amendment made to this article by Article 4 of Decreto Ejecutivo N° 34204 of November 23, 2007, was subsequently repealed by Article 20 of Decreto Ejecutivo N° 41594 of January 15, 2019, "Crea el Sistema de Reconocimientos Ambientales (SIREA)". However, since the legislator did not indicate that the amended text should revert to its previous state, the amendment remains in the present article)

The Fundación Bandera Ecológica will cooperate with the Programa Bandera Ecológica, to the extent of its technical and legal possibilities, in the implementation of its policies, objectives, and processes.

Use of the Bandera Ecológica Emblem and the Logo by Certified Entities

CHAPTER IX

It may also, during the period it is valid, publicly exhibit the granted Bandera Ecológica exclusively at the facilities or center where the production processes subject to the certification are carried out.

Companies or institutions that violate this provision are subject to the pertinent legal sanctions and the immediate withdrawal of the certification.

Transitory Provisions

1Que los habitantes de la República tienen derecho a un ambiente sano y ecológicamente equilibrado, siendo deber del Estado garantizar ese derecho, defenderlo y preservarlo, según lo dispone el artículo 50 de la Constitución Política y la Ley Orgánica del Ambiente.
2Que los consumidores y usuarios tienen derecho a un trato equitativo y a información adecuada y veraz, acerca de las características de los productos que consumen.
3Que con la finalidad de dar contenido a las consideraciones anteriores desde el año 1997 el Ministerio del Ambiente y Energía ha puesto en operación la certificación Bandera Ecológica, como un medio de reconocer el esfuerzo de personas jurídicas dedicadas a actividades manufactureras o de servicio y de instituciones públicas, que desarrollan sus actividades productivas atendiendo a la normativa ambiental y sanitaria y que con su accionar contribuyen al desarrollo humano sostenible.
4Que la Dirección de la Sociedad Civil creada mediante Decreto Ejecutivo N° 27485-MINAE del 13 de octubre de 1998, tiene la responsabilidad de coordinar la ejecución del Programa Bandera Ecológica. Por tanto,

Objetivos

CAPÍTULO III

a)Garantizar la satisfacción del usuario con los servicios que presta.
b)Incorporar el concepto desarrollo sostenible en sus objetivos y procesos institucionales.
c)Propiciar y reglamentar el manejo ambiental de los insumos y productos en los servicios que presta a lo largo del ciclo de conservación, producción, distribución, consumo y desechos.
d)Estimular el desarrollo equilibrado entre la sociedad y la naturaleza.
e)Promover o participar en programas de extensión, educación o capacitación que involucren a la ciudadanía en sus actividades.
f)Desarrollar un Sistema de Gestión Ambiental.

Categorías de Bandera Ecológica

CAPÍTULO IV

Los procesos de evaluación ambiental que anualmente se realicen permitirán a la Comisión Nacional de Bandera Ecológica otorgar las certificaciones correspondientes:

a)Bandera Ecológica A. Se otorgará esta certificación a aquellas empresas privadas e instituciones o empresas públicas, que cumplan con las regulaciones ambientales y laborales atinentes a su actividad productiva.
b)Bandera Ecológica '41ª. Se otorgará esta certificación a aquellas empresas privadas e instituciones o empresas públicas, que además de cumplir con el inciso anterior, hayan iniciado el proceso del establecimiento de su Sistema de Gestión Ambiental, definiendo al menos su política ambiental, metas ambientales, objetivos ambientales, hayan iniciado el proceso de construcción de sus procedimientos y registros y que el proceso de operacionalización del Sistema de Gestión Ambiental pueda ser definido como avanzado.
c)Sello Verde. Se otorgará esta certificación a aquellas empresas privadas e instituciones o empresas públicas, que además de cumplir con el inciso a) tengan en funcionamiento el 100% de su Sistema de Gestión Ambiental el cual deberá cumplir con todos los parámetros establecidos por la Comisión Nacional de Bandera Ecológica. Adicionalmente los estándares de producción o de servicios que alcancen estas empresas o instituciones públicas podrán ser categorizados como de clase mundial.
d)Amigos del Ambiente. Se otorgará esta certificación a aquellas empresas privadas e instituciones o empresas públicas, que hayan mantenido al menos por cuatro períodos anuales consecutivos la certificación en la categoría Sello Verde. Adicionalmente deberá existir criterio unánime de todos los que hayan participado en las evaluaciones de esos cuatro períodos de la existencia de un mejoramiento continuo de su desempeño ambiental.

Publicidad de la certificación

CAPÍTULO V

Para ello contarán con un plazo máximo de diez días hábiles a la fecha en que se produjeron los cambios. El incumplimiento de esta obligación faculta a la Comisión Nacional a retirar la certificación obtenida.

Solicitudes

CAPÍTULO VI

a)Inscribirse en sede del Programa Bandera Ecológica.
b)Someterse anualmente al proceso de evaluación ambiental que dirigirá la Comisión Nacional de Bandera Ecológica y cubrir los costos correspondientes en el proceso de inscripción, confección, evaluación y otorgamiento de la certificación.
c)Completar el Formulario de Aplicación que le será entregado una vez inscrita la empresa o institución pública. La información proporcionada a través del Formulario Inicial tendrá el carácter de autoevaluación ambiental del desempeño ambiental y sanitario de la empresa y tendrá adicionalmente el carácter de Declaración Jurada, debiendo ser refrendada por la más alta autoridad administrativa correspondiente de la empresa y por un profesional competente en la materia.

La Comisión trasladará el asunto a las autoridades correspondientes a fin de que se proceda conforme la ley lo estipule.

Deberes del Programa Bandera Ecológica

CAPÍTULO VII

El informe resultante de dicha inspección será remitido a la Comisión Nacional de Bandera Ecológica para su estudio y constituye en sí mismo el segundo criterio del proceso de evaluación.

La Comisión Nacional de Bandera Ecológica asignará uno o varios auditores responsables, según corresponda a la auditoría solicitada. El Informe de Auditoría que emane del proceso respectivo constituirá el tercer criterio de evaluación. Esta auditoría deberá realizarla única y exclusivamente por un(a) auditor(a) debidamente acreditado(a) ante la Comisión Nacional de Bandera Ecológica.

Los acuerdos de la Comisión Nacional se establecerán por mayoría simple.

De la Comisión Nacional de Bandera Ecológica

CAPÍTULO VIII

Se levantará un acta de los asuntos tratados en cada sesión y estará integrada de la siguiente forma:

1)El Ministro de Ambiente y Energía o su representante; quien presidirá.
2)El Director de la Oficina de Sociedad Civil del MINAE; quien fungirá como Secretario Técnico.
3)Un representante de Fundación Bandera Ecológica para la Gestión Ambiental y la Conservación de los Recursos Naturales, que fungirá con carácter exclusivo como ente ejecutor del Programa Bandera Ecológica.
4)Un representante de las empresas poseedoras de la certificación Bandera Ecológica.
5)Un representante del grupo de auditores acreditados ante el Programa Bandera Ecológica.

a)Recomendar al Ministerio del Ambiente y Energía, la política a seguir para la implementación del Programa Bandera Ecológica.
b)Aprobar y poner en funcionamiento bajo el mismo esquema de operación del Programa Bandera Ecológica (Aplicación, Inspección, Auditoría y Dictamen) otros sistemas de certificación ambiental o de distinciones ambientales atinentes a sostenibilidad, sectores productivos particulares u otros que compartan la filosofía y el espíritu del Programa Bandera Ecológica. Estos nuevos sistemas de certificación ambiental deberán ser c) Supervisar y aprobar o improbar la construcción de herramientas técnicas que deban utilizarse en los procesos del Programa Bandera Ecológica.
d)Evaluar y fijar pautas a seguir en las evaluaciones ambientales a realizarse en la implementación de este Programa.
e)Aprobar o denegar las certificaciones Bandera Ecológica mediante resoluciones que deberán ser debidamente fundamentadas.
f)Dar publicidad a la lista de certificaciones emitidas anualmente.
g)Establecer los requisitos para la acreditación de los Auditores del Programa Bandera Ecológica.
h)Asignar los (as) auditores (as) responsables de realizar Auditoría Ambiental en cada aplicación empresa o institución, mediante el procedimiento que se otorgará por medio de Resolución.
i)Solicitar, colaboración o apoyo a las instituciones estatales cuando se considere necesario, con el fin de reforzar sus criterios técnicos antes de emitir sus dictámenes.
j)Supervisar y aprobar la implantación de un sistema de calidad en el proceso de certificación que deberá establecer el Programa Bandera Ecológica.
k)Solicitar a la Fundación Bandera Ecológica la organización, realización y manejo de una reunión cada dos años con los auditores acreditados ante el Programa Bandera Ecológica a fin de que escojan a sus representantes ante la Comisión Nacional de Bandera Ecológica.
1)Las empresas poseedoras de la certificación cada dos años entregarán el nombre de la persona que los representará ante la Comisión Nacional. La Comisión Nacional le solicitará a la Fundación Bandera Ecológica la coordinación de una reunión cada dos años con las empresas poseedoras de la certificación a fin de que las mismas escojan a sus representantes ante la Comisión Nacional de Bandera Ecológica.
m)Ampliar las certificaciones del Programa Bandera Ecológica a través de la puesta en operación de propuestas y herramientas técnicas que hayan sido elaboradas por la Fundación Bandera Ecológica para la gestión ambiental y la conservación de los recursos naturales y aprobados por el MINAE.
n)Cualquier otra, que señale este Reglamento o que se desprenda de las funciones que se les asigna.

El Director de la Dirección General de Gestión Calidad Ambiental será el responsable de ejecutar las directrices y decisiones de la Comisión Nacional de Bandera Ecológica y actuará bajo su supervisión. Será nombrado por el Ministerio del Ambiente y Energía, su responsabilidad incluye además mantener informado al Consejo y al Ministerio del Ambiente y Energía sobre la aplicación de esta legislación y de otras leyes cuya aplicación le corresponde al Programa Bandera Ecológica; asimismo deberá supervisar y dar seguimiento al cumplimiento de los reglamentos, las políticas y las directrices en la materia.

(La reforma practicada al presente artículo por el artículo 4° del decreto ejecutivo N° 34204 del 23 de noviembre de 2007 posteriormente fue derogada por el artículo 20 del decreto ejecutivo N° 41594 del 15 de enero del 2019 "Crea el Sistema de Reconocimientos Ambientales (SIREA)". No obstante al no indicar el legislador que el texto reformado debe volver a su estado anterior se mantiene la reforma en el presente numeral)

La Fundación Bandera Ecológica, cooperará con el Programa Bandera Ecológica, en la medida de sus posibilidades técnicas y legales, en la implementación de sus políticas y objetivos y procesos.

Utilización del emblema Bandera Ecológica y del logotipo por parte de los entes certificados

CAPÍTULO IX

También podrá, durante el tiempo en que esté vigente, exhibir públicamente la Bandera Ecológica otorgada exclusivamente en las instalaciones o centro donde lleva a cabo los procesos de producción objeto de la certificación.

Las empresas o instituciones que incurran en violación a la presente disposición se certificación.

Disposiciones transitorias

Dado en la Presidencia de la República.-San José, a los veintisiete días del mes de noviembre del dos mil seis.

Regulation for Granting the "Ecological Flag" CertificateReglamento para Otorgar el Certificado "Bandera Ecológica"

Artículo 3 — The Bandera Ecológica certification is created, which will be granted to private companies and public institutions or companies that comply with current environmental, occupational health, and sanitary legislation, as well as with the requirements established in this Regulation.

Artículo 5 — Private companies and public institutions or companies that, in their policies, guidelines, agreements, and management, in addition to fulfilling their purpose, comply with the following requirements may obtain the certification:

Artículo 6 — The Comisión Nacional de Bandera Ecológica may establish other requirements, according to the nature of the activity carried out by the applicant, in compliance with national and international environmental standards recognized by the country.

Artículo 7 — Four categories of the Bandera Ecológica certification are established.

Artículo 8 — Once a year, the Comisión Nacional de Bandera Ecológica will give public recognition to the awarded companies and institutions, indicating the date on which they were granted the Bandera Ecológica certification and the category they obtained.

Artículo 9 — The companies or institutions that have been certified by Bandera Ecológica acquire the commitment to maintain and improve the environmental and sanitary conditions under which they obtained the certification.

Artículo 11 — The certification obligates the certified entities to inform the Comisión Nacional of any change or modification to the evaluated processes or the Environmental Management System that made it deserving of such distinction.

Artículo 12 — Those seeking to be certified by Bandera Ecológica must:

Artículo 13 — Companies and institutions that, in the Application Form or at any other phase of the process, provide false, inaccurate, or adulterated information in order to induce the Comisión Nacional de Bandera Ecológica to erroneous conclusions will lose the certification.

Artículo 15 — The Programa Bandera Ecológica, through the Comisión Nacional, will request, once the Inspection Report is known, an Environmental Audit for the applying private company, institution, or public company.

Artículo 16 — Once the three criteria necessary for issuing any certification are gathered and expressed through the Application Form, the Inspection Report, and the Audit Report, the Comisión Nacional de Bandera Ecológica will resolve the Application by issuing the corresponding Dictamen.

Artículo 17 — The Comisión Nacional de Bandera Ecológica will be responsible for establishing any additional mechanism for the processing, audit, and inspection of companies and institutions.

Artículo 18 — The Comisión Nacional de Bandera Ecológica is created, which will meet quarterly, or failing that, when the Secretario Técnico convenes it.

Artículo 19 — The functions of the Comisión Nacional de Bandera Ecológica are as follows:

Artículo 20 — Dirección General de Gestión Calidad Ambiental.

Artículo 21 — Of the Fundación Bandera Ecológica.

Artículo 22 — Once the certified entity has been officially notified of the respective dictamen, it may make the received certification known to the public through any means of communication.

Artículo 23 — For the use of the logo, emblems, and designs of the Bandera Ecológica, the certified companies must sign an Agreement with the Comisión Nacional de Bandera Ecológica.

Artículo 24 — Decreto Ejecutivo N° 26405-MINAE of July 14, 1997, published in La Gaceta N° 209, of October 30, 1997, "Reglamento para otorgar el Galardón Bandera Ecológica", is repealed.

Artículo 25 — It takes effect upon its publication.

Transitorio I — As of the publication of this Decreto Ejecutivo, the governing Environmental Management System of the Programa Bandera Ecológica corresponds to version 3.0.

Transitorio II — As of the publication of this Decreto Ejecutivo, the current Application Form corresponds to version 3.0.

Transitorio III — As of the publication of this Decreto Ejecutivo, the current Audit Protocol of the Programa Bandera Ecológica corresponds to version 2.0.

Artículo 3 — Se crea la certificación Bandera Ecológica, que se otorgará a empresas privadas e instituciones o empresas públicas que cumplan con la legislación ambiental, de salud ocupacional y sanitaria vigente, así como con los requisitos establecidos en el presente Reglamento.

Artículo 5 — Podrán obtener la certificación empresas privadas e instituciones o empresas públicas, que en sus políticas, directrices, acuerdos y gestión, además de cumplir con su razón de ser, cumplan con los siguientes requerimientos:

Artículo 6 — La Comisión Nacional de Bandera Ecológica podrá establecer otros requerimientos, de acuerdo a la naturaleza de la actividad que realice el solicitante, atendiendo a la normativa ambiental nacional e internacional reconocido por el país.

Artículo 7 — Se establecen cuatro categorías de la certificación Bandera Ecológica.

Artículo 8 — Una vez al año, la Comisión Nacional de Bandera Ecológica, hará un reconocimiento público a las empresas e instituciones galardonadas, indicando la fecha en que les fue otorgada la certificación Bandera Ecológica y la categoría que obtuvieron.

Artículo 9 — Las empresas o instituciones que han sido certificadas por Bandera Ecológica, adquieren el compromiso de mantener y mejorar las condiciones ambientales y sanitarias bajo las cuales obtuvieron la certificación.

Artículo 11 — La certificación obliga a los entes certificados comunicar a la Comisión Nacional, cualquier cambio o modificación a los procesos o al Sistema de Gestión Ambiental evaluados y que le hicieran merecedor de tal distinción.

Artículo 12 — Quienes pretendan ser certificados por Bandera Ecológica deberán:

Artículo 13 — Las empresas e instituciones, que en el Formulario de Aplicación o en alguna otra fase del proceso, brinden información falsa, inexacta o adulterada, a efecto de inducir a la Comisión Nacional de Bandera Ecológica a conclusiones erróneas, perderá la certificación.

Artículo 15 — El Programa Bandera Ecológica a través de la Comisión Nacional solicitará una vez conocido el Informe de Inspección, una Auditoría Ambiental para la empresa privada, institución o empresa pública solicitante.

Artículo 17 — La Comisión Nacional de Bandera Ecológica será responsable de establecer cualquier mecanismo adicional para la tramitación, auditoría e inspección a las empresas e instituciones.

Artículo 18 — Se crea la Comisión Nacional de Bandera Ecológica, la cual se reunirá trimestralmente o en su defecto cuando el Secretario Técnico los convoque, en caso de un empate de votos en la toma de decisiones, el Presidente de la Comisión Nacional podrá ejercer derecho a doble voto.

Artículo 19 — Son funciones de la Comisión Nacional de Bandera Ecológica las siguientes:

Artículo 21 — De la Fundación Bandera Ecológica.

Artículo 22 — El ente certificado una vez que ha sido oficialmente notificado del dictamen respectivo, podrá hacer del conocimiento público la certificación recibida, a través de cualquier medio de comunicación.

Artículo 23 — Para la utilización de logotipo, emblemas y diseños de la Bandera Ecológica las empresas certificadas, deberán suscribir un Convenio con la Comisión Nacional de Bandera Ecológica.

Artículo 24 — Se deroga el Decreto Ejecutivo N° 26405-MINAE del 14 julio de 1997, publicado en La Gaceta N° 209, del 30 de octubre de 1997, "Reglamento para otorgar el Galardón Bandera Ecológica".

Artículo 25 — Rige a partir de su publicación.

Transitorio I — A partir de la publicación del presente Decreto Ejecutivo, el Sistema de Gestión Ambiental del Programa Bandera Ecológica que rige corresponde a la versión 3.0.

Transitorio II — A partir de la publicación del presente Decreto Ejecutivo el Formulario de Aplicación vigente corresponde a la versión 3.0.

Transitorio III — A partir de la publicación del presente Decreto Ejecutivo el Protocolo de Auditoría del Programa Bandera Ecológica vigente corresponde a la versión 2.0.
