in the entirety of the text - Full Text of Norm 37113 Declares of Public Utility for the interests of the State the Association La Gallega and Estero Azul Sierpe de Osa Full Text of act: 171BBC N° 37113-JP (This executive decree was repealed by article 1 of executive decree N° 44854 of September 3, 2024) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions set forth in articles 140, subsection 18) and 146 of the Political Constitution, in article 32 of the Law of Associations No. 218 of August eighth, nineteen hundred thirty-nine, and in articles 27 and following of the Regulation to the Law of Associations No. 29496-J published in La Gaceta No. 96 of May twenty-first, two thousand one.

I.That article 32 of the Law of Associations number 218 of August eighth, nineteen hundred thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.

II.That the ASOCIACIÓN LA GALLEGA Y ESTERO AZUL SIERPE DE OSA, legal entity identification number: 3-002-542576, was registered in the Registry of Associations of the Public Registry since July twenty-third, two thousand eight, under volume number 576, entry 16522.

III.That the purposes pursued by the Association, according to its articles of incorporation and in accordance with the provisions of article three of its Bylaws, are the following:

• a)To administer, operate, maintain, develop, and conserve in good condition the aqueduct, in accordance with the provisions and regulations issued on the matter by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), which shall be mandatory.
• b)To obtain the effective participation of the community in the construction, operation, maintenance, and development of the aqueduct.
• c)Collaboration in educational programs and campaigns that are undertaken.
• d)To help explain and disseminate the provisions and regulations of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados) in the community.
• e)To cooperate with the plans, projects, and works undertaken by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados) in the community.
• f)To participate in matters related to the administration, conservation, and rational exploitation of waters; control of their pollution or alteration, definition of measures and actions necessary for the protection of hydrographic basins and ecological stability.
• g)To ensure that all systems, their aqueduct or sanitary sewer installations, comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, rationalization of expenses, etc.
• h)To grant public services in an efficient, equal, and timely manner to all its users, without distinctions of any nature.

IV.That such purposes solve a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore,

en la totalidad del texto - Texto Completo Norma 37113 Declara de Utilidad Pública para los intereses del Estado la Asociación La Gallega y Estero Azul Sierpe de Osa Texto Completo acta: 171BBC N° 37113-JP (Este decreto ejecutivo fue derogado por el artículo 1° del decreto ejecutivo N° 44854 del 3 de setiembre del 2024) LA PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículo 140, inciso 18) y 146 de la Constitución Política,en el artículo 32 de la Ley de Asociaciones Nº 218 del ocho de agosto de mil novecientos treintay nueve y en los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-Jpublicada en La Gaceta N° 96 del veintiuno de mayo del dos mil uno.

I.Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.Que la ASOCIACIÓN LA GALLEGA Y ESTERO AZUL SIERPE DE OSA, cédula de Persona Jurídica número: 3-002-542576, se inscribió en el Registro de Asociaciones del Registro Público desde el día veintitrés de julio de dos mil ocho, bajo el tomo número 576, asiento 16522.

III.Que los fines que persigue la Asociación, según su acta constitutiva y de acuerdo a lo establecido en el artículo tercero de sus Estatutos son los siguientes:

• a)Administrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto, de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio.
• b)Obtener la participación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo del acueducto.
• c)Colaboración en los programas y campañas de índole educativo que se emprendan.
• d)Ayudar a explicar y divulgar las disposiciones y reglamentos del Instituto Costarricense de Acueductos y Alcantarillados en la comunidad.
• e)Cooperar con los planes, proyectos y obras que emprenda el Instituto Costarricense de Acueductos y Alcantarillados en la comunidad.
• f)Participar en asuntos relativos a la administración, conservación y definición de medidas y acciones necesarias para la protección de las cuencas hidrográficas y estabilidad ecológica.
• g)Velar porque todos los sistemas, sus instalaciones acueductos o alcantarillados sanitario, cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc.
• h)Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza.

IV.Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
