in the entirety of the text - Complete Text of Norm 37011 Publishes Resolution No. 271-2011 (COMIECO-LXI) of December 2, 2011: Approval, by total substitution, of the modifications to the Central American Regulation on Sanitary and Phytosanitary Measures and Procedures Complete Text of record: E2316 No. 37011-COMEX-MEIC-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF FOREIGN TRADE, OF ECONOMY, INDUSTRY AND TRADE, AND OF AGRICULTURE AND LIVESTOCK In accordance with the powers and attributions granted to them by Articles 50, 140 subsections 3), 8), 10), 18) and 20); and 146 of the Political Constitution; the Articles 4, 25, 27 paragraph 1, 28 paragraph 2 subsection b) of the General Law of the Public Administration, Law No. 6227 of May 2, 1978; the Law of Creation of the Ministry of Foreign Trade and the Foreign Trade Promoter of Costa Rica, Law No. 7638 of October 30, 1996; the Organic Law of the Ministry of Economy, Industry and Trade, Law No. 6054 of June 14, 1977; the Law for the Promotion of Agricultural Production (FODEA) and Organic Law of the Ministry of Agriculture and Livestock (MAG), Law No. 7064 of April 29, 1987; the Law for the Promotion of Competition and Effective Defense of the Consumer, Law No. 7472 of December 20, 1994; Articles 7, 26, 36, 37, 38, 39, 46 and 55 of the Protocol to the General Treaty on Central American Economic Integration, Approval Law No. 7629 of September 26, 1996; and

I.- That the Council of Ministers of Economic Integration, through Resolution No. 271- 2011 (COMIECO-LXI) dated December 2, 2011, approved, by total substitution, the modifications to the Central American Regulation on Sanitary and Phytosanitary Measures and Procedures, in the form appearing in the Annex to said Resolution.

II.- That likewise, said resolution repealed only the relevant part pertaining to the Central American Regulation on Sanitary and Phytosanitary Measures and Procedures, Resolution No. 37 99 (COMIECO-XIII) of September 17, 1999, put into effect by the Republic of Costa Rica through Executive Decree No. 28222-MEIC-COMEX of September 30, 1999; which, in turn, was modified by Resolution No. 87-2002 (COMIECO-XXIII) of August 23, 2002; published through Executive Decree No. 30691-COMEX of September 5, 2002; which in turn, is expressly repealed by Resolution No. 271-2011 (COMIECO-LXI) dated December 2, 2011.

III.- That in compliance with what is indicated in said Resolution, its publication is hereby ordered.

Therefore; THEY DECREE:

Publication of Resolution No. 271-2011 (COMIECO-LXI) dated December 2, 2011 and its Annex: Approval, by total substitution, of the modifications to the Central American Regulation on Sanitary and Phytosanitary Measures and Procedures.

en la totalidad del texto - Texto Completo Norma 37011 Publica Resolución N° 271-2011 (COMIECO-LXI) del 2 de diciembre del 2011: Aprobación, por sustitución total, de las modificaciones al Reglamento Centroamericano de Medidas y Procedimientos Sanitarios y Fitosanitarios Texto Completo acta: E2316 Nº 37011-COMEX-MEIC-MAG LA PRESIDENTA DE LA REPÚBLICA Y LAS MINISTRAS DE COMERCIO EXTERIOR, DE ECONOMÍA, INDUSTRIA Y COMERCIO, Y DE AGRICULTURA Y GANADERÍA De conformidad con las facultades y atribuciones que les conceden los artículos 50, 140 incisos 3), 8), 10), 18) y 20); y 146 de la Constitución Política; los artículos 4, 25, 27 párrafo 1, 28 párrafo 2 inciso b) de la Ley General de la Administración Pública, Ley N° 6227 del 02 de mayo de 1978; la Ley de Creación del Ministerio de Comercio Exterior y de la Promotora del Comercio Exterior de Costa Rica, Ley N° 7638 del 30 de octubre de 1996; la Ley Orgánica del Ministerio de Economía, Industria y Comercio, Ley N° 6054 del 14 de junio de 1977; la Ley de Fomento a la Producción Agropecuaria (FODEA) y Orgánica del Ministerio de Agricultura y Ganadería (MAG), Ley N° 7064 del 29 de abril de 1987; la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, Ley N° 7472 del 20 de diciembre de 1994; los artículos 7, 26, 36, 37, 38, 39, 46 y 55 del Protocolo al Tratado General de Integración Económica Centroamericana, Ley de Aprobación N° 7629 del 26 de septiembre de 1996; y

I.- Que el Consejo de Ministros de Integración Económica, mediante la Resolución N° 271- 2011 (COMIECO-LXI) de fecha 02 de diciembre de 2011, aprobó, por sustitución total, las modificaciones al Reglamento Centroamericano sobre Medidas y Procedimientos Sanitarios y Fitosanitarios, en la forma que aparece en el Anexo dicha Resolución.

II.- Que asimismo, dicha resolución derogó únicamente en la parte conducente al Reglamento Centroamericano sobre Medidas y Procedimientos Sanitarios y Fitosanitarios, la Resolución N° 37 99 (COMIECO-XIII) del 17 de septiembre de 1999, puesta en vigencia por la República de Costa Rica mediante el Decreto Ejecutivo N° 28222-MEIC-COMEX del 30 de septiembre de 1999; la cual, a su vez fue modificada por la Resolución N° 87-2002 (COMIECO-XXIII) del 23 de agosto de 2002; publicada mediante Decreto Ejecutivo N° 30691-COMEX del 05 de septiembre de 2002; que a su vez, queda derogada expresamente por la Resolución N° 271-2011 (COMIECO-LXI) de fecha 02 de diciembre de 2011.

III.- Que en cumplimiento de lo indicado en dicha Resolución, se procede a su publicación.

Por tanto;

Publicación de la Resolución N° 271-2011 (COMIECO-LXI) de fecha 02 de diciembre de 2011 y su Anexo: Aprobación, por sustitución total, de las modificaciones al Reglamento Centroamericano sobre Medidas y Procedimientos Sanitarios y Fitosanitarios.
