- Volunteer (Voluntario): refers to the natural person who, voluntarily and without financial remuneration, collaborates with the National System of Conservation Areas (SINAC), supporting the actions developed by SINAC personnel, both in Protected Wild Areas (ASP) and in the rest of the administrative offices of SINAC.

- Food (Alimentación): refers to the food that the volunteer requires daily during their stay in the ASP.

- Lodging (Hospedaje): refers to the service and facilities where the volunteer will spend the night during their stay within the ASP.

- Transport (Transporte): refers to the transfer of volunteers in official vehicles, whenever required and with the respective permit, according to resolution number R-184-2006-MINAE published in La Gaceta No. 172 of September 7, 2006.

- Necessary conditions offered by SINAC for the volunteer's stay within the ASP: refers to having lodging, a hygiene area, work equipment, identification, work instructions, and transport when required.

- Basic accident insurance policy (Póliza básica de accidentes): insurance policy that includes assistance for illness, accidents, and other risks.

• a)The Executive Director of the National System of Conservation Areas shall issue the guidelines to be applied in matters of volunteering within SINAC.
• b)The Directors of the Conservation Areas (Áreas de Conservación) shall be responsible for implementing the guidelines issued by the Executive Director of SINAC.
• c)The Administrators of the protected wild areas or those officials in charge shall have the responsibility to apply and observe this regulation and the guidelines issued by the Executive Director of SINAC and the Director of the Conservation Area.
• d)All those persons who hold a leadership position in the different administrative offices of SINAC shall have the responsibility to apply and observe this regulation and the guidelines issued by the Executive Director of SINAC and the Director of the Conservation Area, as applicable.

• a)Issue national guidelines on volunteering for SINAC.
• b)Coordinate with organizations, institutions, and national and international private companies that carry out volunteer actions in SINAC.
• c)Establish monitoring and evaluation mechanisms for volunteer actions carried out in SINAC.
• d)Keep an updated registry of all organizations, institutions, and national and international private companies that participate in the SINAC volunteer program.

• a)Permanently coordinate with organizations, institutions, and national and international private companies that carry out volunteer actions in the AC under their charge.
• b)Ensure the application of the monitoring and evaluation mechanisms defined at the national level and establish the control measures that may be necessary for the proper course of volunteer actions in the AC.
• c)Evaluate volunteer actions carried out in the AC, in accordance with the monitoring and evaluation mechanisms provided in the Volunteer Service Procedure in SINAC.
• d)Guarantee that the ASP where volunteers will be received have a current volunteer plan.

• a)Formulate and execute the volunteer plans for the protected wild areas under their charge.
• b)Evaluate the fulfillment of the volunteer plans in accordance with the provisions contained in the Volunteer Service Procedure of SINAC.
• c)Permanently coordinate with organizations, institutions, and national and international private companies that carry out volunteer actions in the ASP under their charge.
• d)Ensure that volunteers have the necessary conditions for their stay and optimal performance in the protected wild areas under their charge, specifically regarding lodging, work equipment, identification, work instructions, and transport, when they carry out activities related to the institutional objective and have the corresponding permit.
• e)Provide the necessary induction for the volunteers received in the Protected Wild Areas under their charge and supervise their performance.
• f)Keep updated records of the volunteers of the protected wild areas under their charge.
• g)Prepare annual reports of the actions carried out by volunteers in the protected wild areas under their charge and submit them to the corresponding Conservation Area Directorate.
• h)Notify the body designated in the Executive Secretariat of SINAC of the names of volunteers who have been expelled from the protected wild areas, in accordance with the provisions of article 18 of this Regulation, for its dissemination at the national level.

• a)Prepare the volunteer plans for the office under their charge.
• b)Evaluate the fulfillment of the volunteer plan in accordance with the provisions contained in the Volunteer Service Procedure of SINAC.
• c)Permanently coordinate with organizations, institutions, and national and international private companies that carry out volunteer actions in the office under their charge.
• d)Ensure that volunteers have the necessary conditions for their stay and optimal performance in the administrative office where they provide volunteer service; specifically regarding: work equipment, identification, work instructions, and transport when they carry out activities related to the institutional objective and have the corresponding permit.
• e)Provide the necessary induction for the volunteers received in the offices under their charge and supervise their performance.
• f)Keep updated the records of volunteers of the administrative offices under their charge.
• g)Prepare annual reports of the actions carried out by volunteers in the administrative offices under their charge and submit them to the Director of the AC or the person designated by them, in the corresponding Conservation Area.
• h)Notify the body designated by the Executive Director of SINAC of the names of volunteers who have been expelled from SINAC offices in accordance with the provisions of article 18 of this Regulation, for its dissemination at the national level.

Categories of volunteers, their rights, duties, and prohibitions

They shall render their services pro bono (ad-honorem), motivated by the goal of contributing to SINAC's management.

Volunteers who provide their services in SINAC shall be registered in the following categories:

• a)Category 1: Members of national organizations, national institutions, and national private companies that organize and execute volunteer actions in SINAC.
• b)Category 2: Members of international organizations, international institutions, and international private companies that organize and execute volunteer actions in SINAC.
• c)Category 3: Members of local organizations, local community groups, and local private companies that carry out volunteer actions in SINAC.
• d)Category 4: Individuals who carry out volunteer actions in SINAC on an individual basis.

• a)Receive induction and advice on their rights, duties, responsibilities, prohibitions, and general information about the place where they will provide volunteer service.
• b)Receive the necessary instructions to carry out the work assigned to them, according to the work plan.
• c)Request support and collaboration from the public officials of the place where they provide volunteer service, in order to perform their functions effectively.
• d)Obligatorily receive the corresponding identification upon entering the place where they will provide volunteer service.
• e)Have the necessary conditions for their stay and optimal performance, specifically regarding work equipment, work instructions, and transport, and in the case of ASP, also regarding lodging, when they carry out activities related to the institutional objective and have the corresponding permit.
• f)Receive courteous, kind, and respectful treatment from public officials, other volunteers, and private individuals during their stay in the place where they provide volunteer service.

• a)Comply with the current legal provisions, as well as with the guidelines issued for that purpose by the National System of Conservation Areas.
• b)Complete the volunteer entry form before the corresponding body of SINAC.
• c)Have a basic accident insurance policy, and in the case of foreign volunteers, the policy must also include coverage for repatriation.
• d)Collaborate with the competent public officials in the tasks assigned to them, based on the corresponding work plan.
• e)Follow the instructions given by the official in charge of the place where they will provide volunteer service, provided they conform to the legal system, this regulation, and the work plan.
• f)Notify the respective administrator of the protected wild area, or the head of the SINAC office, where they provide volunteer service, of any irregularity committed by public officials, other volunteers, or private individuals.
• g)Report any obstacles, limitations, or difficulties, if they occur, that have arisen in carrying out their work effectively.
• h)Maintain, during their stay at the place where they provide volunteer service, a permanent attitude of seriousness, prudence, and attentiveness, as well as courtesy and kindness towards other volunteers, SINAC officials, and the general public.
• i)If required, they must provide faithful testimony before the competent authority of everything they may have seen, heard, and done during the time they stayed at the place where they provided volunteer service within SINAC.
• j)Faithfully comply with the provisions of this Regulation and the related rules established by the legal system.
• k)Permanently carry the proper identification when they are providing volunteer service in SINAC.
• l)Be responsible for any damage, loss, or misplacement they cause to the facilities, equipment, and other State property during their period as a volunteer, in accordance with the applicable regulations. In cases where replacement must be made, a prior appraisal issued by the SINAC Heritage office of the good to be replaced shall be required.
• m)In the event that the volunteers are minors, they must be accompanied by the group leader or by the parent or guardian, who will also be a volunteer, for the time the volunteer service is provided, and these persons shall be responsible for ensuring compliance with the provisions of this regulation, as well as the safety of the minors.
• n)Present a health certificate issued no more than 3 months prior to entering the place where they will provide volunteer service, in English or Spanish.
• o)Present a criminal record or equivalent document, for the case of volunteers included in category 4, and for the case of categories 1, 2, and 3, comply with the provisions of subsection j) of article 14 of this regulation.

• a)Acting contrary to the provisions of current regulations, the guidelines issued by the National System of Conservation Areas, and this regulation.
• b)Assuming police authority functions or others that are reserved exclusively for public officials, in accordance with applicable regulations.
• c)Making use of State facilities, equipment, and other property without the proper authorization of the authorities where they provide volunteer service.
• d)Causing damage to State property or equipment.
• e)Using and consuming, within the ASP or administrative offices of SINAC where they provide volunteer service, toxic substances (alcohol, cigarettes, and psychotropic substances of unauthorized use).

Organizations

• a)Have a basic accident insurance policy, for the purpose of covering volunteers in case of accident or other event, for the time they provide volunteer service in SINAC, and in the case of foreign volunteers, the policy must include coverage for repatriation. For such purposes, the organization, private company, or institution must present a certification from the insurance entity specifying the type of policy that the volunteers of their organization have, or alternatively, the individual policy of each volunteer.
• b)In the event that the volunteers are minors, they must comply with the provisions of article 11, subsection m) of this regulation.
• c)Cover the costs of food and transport for the volunteers to the place where they will provide service, as well as any other cost that arises due to unforeseen circumstances.
• d)Inform volunteers, through the different advertising and dissemination media used by the organization, private company, or national or international institution, that SINAC provides lodging within the ASP to the volunteers during the volunteer service provision period in the ASP, at no cost.
• e)Maintain an updated internal record of all their volunteers.
• f)Train volunteers on the objectives and the nature of the work they will perform in the protected wild areas or in SINAC administrative offices, as well as regarding their rights, duties, and prohibitions, in accordance with the provisions of this regulation.
• g)Comply with the current provisions governing the protected wild areas and administrative offices of SINAC, in legal and administrative matters, as well as any other guideline issued in this matter by the respective authorities.
• h)Guarantee compliance with the work plan for the period of the volunteers' stay in the protected wild areas or in the administrative offices of SINAC.
• i)Certification of no employer-worker debts with the Caja Costarricense del Seguro Social.
• j)Sworn declaration (declaración jurada) in which the organization states that the volunteers have been subjected to its internal controls for their selection, in terms of conduct, criminal background, and other factors.

Faults and sanctions

In the case of minors, the parents or guardians shall be legally responsible for their actions before the State or third parties.

• a)Failure to comply with the duties, obligations, and prohibitions established in this regulation.
• b)Receiving gifts, rewards, favors, or payments of any kind during the time they remain at the place where they provide volunteer service.
• c)Acting under the influence of toxic substances (alcohol, cigarettes, and psychotropic substances of unauthorized use) during the performance of their volunteer duties.
• d)Assaulting any person physically, verbally, or psychologically.
• e)Illegally retaining, or failing to report to the competent authority, articles or objects belonging to visitors, other volunteers, SINAC officials, or third parties that have been misplaced or forgotten.
• f)Making use of State facilities, equipment, and other property without the proper authorization of the Administration.
• g)Any other fault that the Administration deems pertinent.

The Administration will analyze the cases in which the sanction to be imposed on the offending volunteers must consist of barring the volunteer from carrying out actions of this type, permanently or for a determined period, at the site where the fault was committed, or whether said sanction must be extended to the other ASP and administrative offices of SINAC.

The sanctions indicated in article 18 must be decreed by the Administration through a duly reasoned act, which must be notified to the responsible organization, institution, or private company, or to the individual volunteer, as applicable.

Donations, conditions provided by SINAC to volunteers, and supplementary provisions

• a)In the case of cash, the deposit must be made directly by the volunteer, organization, institution, or other entity into the special account of the National Parks Fund (Fondo de Parques Nacionales) of SINAC 100-01-000-041220-5 at the Banco Nacional de Costa Rica, specifying that it is for the volunteer program.
• b)For the case of in-kind donations, the procedure established in article 19 of the Regulation for the Registry and Control of Goods of the Central Administration, Executive Decree No. 30720-H of August 26, 2002, must be followed.

The foregoing, with the exception of the Isla del Coco Marine National Park (Parque Nacional Marino Isla del Coco), which, due to its special conditions of distance and the special handling required for food entering the ASP, the administration may provide food and water transport to the volunteers, in accordance with the provisions of the Directorate of the Isla del Coco Marine Conservation Area (Área de Conservación Marina Isla del Coco).

32443-MINAE of March 1, 2005, is repealed in its entirety.

Given at the Presidency of the Republic—San José, on the third day of the month of August of two thousand eleven.

Transitory Provision I.—Organizations and institutions that are currently carrying out actions, activities, or projects related to volunteering in protected wild areas shall have a period of three months from the publication of this regulation to adjust to the provisions contained in this executive decree.

Transitory Provision II.—SINAC shall have three months from the publication of this decree to publish the Volunteer Service Procedure in the National System of Conservation Areas, referred to in article 23 of this regulation, and the Code of Ethics and basic principles on volunteer service in the National System of Conservation Areas.

- Voluntario: se refiere la persona física que de manera voluntaria y sin remuneración económica, colabora con el Sistema Nacional de Áreas de Conservación (SINAC), apoyando en las acciones desarrolladas por el personal del SINAC, tanto en las Áreas Silvestres Protegidas (ASP), como en el resto de las oficinas administrativas del SINAC.

- Alimentación: se refiere a los alimentos que el voluntario requiere diariamente durante su permanencia en el ASP.

- Hospedaje: se refiere al servicio y a las instalaciones donde pernoctará el voluntario durante su estadía dentro del ASP.

- Transporte: se refiere al traslado de los voluntarios en vehículos oficiales, siempre y cuando se requiera y cuenten con el permiso respectivo, según resolución número R-184-2006-MINAE publicada en La Gaceta Nº 172 del 07 de setiembre del 2006.

- Condiciones necesarias ofrecidas por el SINAC para la permanencia del voluntario dentro del ASP: se refiere a contar con hospedaje, área de aseo, equipo de trabajo, identificación, instrucciones de trabajo y transporte cuando se requiera.

- Póliza básica de accidentes: póliza de seguro que contemple asistencia por enfermedad, accidentes y además riesgos.

• a)El Director Ejecutivo del Sistema Nacional de Áreas de Conservación, será quien dicte las directrices a aplicar en materia de voluntariado en el SINAC.
• b)Los Directores (as) de las Áreas de Conservación se encargarán de implementar las directrices emanadas del Director Ejecutivo del SINAC.
• c)Los Administradores(as) de las áreas silvestres protegidas o aquellos funcionarios (as) a cargo, tendrán la responsabilidad de aplicar y observar este reglamento y las directrices dictadas por el Director Ejecutivo del SINAC y del Director del Área de Conservación.
• d)Todas aquellas personas que tengan a cargo una jefatura en las diferentes oficinas administrativas del SINAC, tendrán la responsabilidad de aplicar y observar este reglamento y las directrices dictadas por el Director Ejecutivo del SINAC y del Director del Área de Conservación, según corresponda.

• a)Emitir los lineamientos nacionales en materia de voluntariado para el SINAC.
• b)Coordinar con las organizaciones, instituciones y empresas privadas nacionales e internacionales, que realizan acciones de voluntariado en el SINAC.
• c)Establecer los mecanismos de seguimiento y evaluación de las acciones de voluntariado realizadas en el SINAC.
• d)Mantener actualizado el registro de todas las organizaciones, instituciones y empresas privadas nacionales e internacionales que participen en el programa de voluntariado del SINAC.

• a)Coordinar permanentemente con las organizaciones, instituciones y empresas privadas, nacionales e internacionales que realizan acciones de voluntariado en el en el Área de Conservación (AC) a su cargo.
• b)Velar por la aplicación de los mecanismos de seguimiento y evaluación definidos a nivel nacional y establecer las medidas de control que fueran necesarias para el buen curso de las acciones de voluntariado en el AC.
• c)Evaluar las acciones de voluntariado realizadas en el AC, de conformidad a los mecanismos de seguimiento y evaluación dispuestos en el Procedimiento del Servicio Voluntario en el SINAC.
• d)Garantizar que en las ASP donde se van a recibir voluntarios (as), cuenten con un plan de voluntariado vigente.

• a)Formular y ejecutar los planes de voluntariado de las áreas silvestres protegidas a su cargo.
• b)Evaluar el cumplimiento de los planes de voluntariado de conformidad a las disposiciones contenidas en el Procedimiento del Servicio Voluntario del SINAC.
• c)Coordinar permanentemente con las organizaciones, instituciones y empresas privadas, nacionales e internacionales que realizan acciones de voluntariado en las ASP a su cargo.
• d)Procurar que los voluntarios (as) cuenten con las condiciones necesarias para su permanencia y óptimo desempeño en las áreas silvestres protegidas a su cargo, específicamente lo relacionado con hospedaje, equipo de trabajo, identificación instrucciones de trabajo y transporte, cuando realicen actividades relacionadas con el objetivo institucional y cuenten con el permiso correspondiente.
• e)Brindar la inducción necesaria para los voluntarios (as) que se reciben en las Áreas Silvestres Protegidas a su cargo y supervisar el desempeño de los mismos.
• f)Mantener actualizados los registros de voluntarios (as) de las áreas silvestres protegidas a su cargo.
• g)Elaborar los informes anuales de las acciones realizadas por los voluntarios (as) en las áreas silvestres protegidas, a su cargo y presentarlos a la Dirección del Área de Conservación correspondiente.
• h)Comunicar a la instancia designada en la Secretaría Ejecutiva del SINAC, los nombres de los voluntarios (as) que han sido expulsados de las áreas silvestres protegidas, de conformidad con lo establecido en el artículo 18 de este Reglamento, para su divulgación a nivel nacional.

• a)Elaborar los planes de voluntariado de la oficina a su cargo.
• b)Evaluar el cumplimiento del plan de voluntariado de conformidad a las disposiciones contenidas en el Procedimiento del Servicio Voluntariado del SINAC.
• c)Coordinar permanentemente con las organizaciones, instituciones y empresas privadas, nacionales e internacionales que realizan acciones de voluntariado en la oficina a su cargo.
• d)Procurar que los voluntarios (as) cuenten con las condiciones necesarias para su permanencia y óptimo desempeño en la oficina administrativa donde preste el servicio de voluntariado; específicamente lo relacionado con: equipo de trabajo, identificación, instrucciones de trabajo y transporte cuando realicen actividades relacionadas con el objetivo institucional y cuenten con el permiso correspondiente.
• e)Brindar la inducción necesaria para los voluntarios (as) que se reciben en las oficinas a su cargo y supervisar el desempeño de los mismos.
• f)Mantener actualizados los registros de voluntarios (as) de las oficinas administrativas a su cargo.
• g)Elaborar los informes anuales de las acciones realizadas por los voluntarios (as) en las oficinas administrativas a su cargo y presentarlos al Director del AC o la persona designada por éste, en el Área de Conservación correspondiente.
• h)Comunicar a la instancia designada por el Director Ejecutivo del SINAC los nombres de los voluntarios (as) que han sido expulsados de las oficinas del SINAC de conformidad con lo establecido en el artículo 18 de este Reglamento, para su divulgación a nivel nacional.

De las categorías de voluntarios (as), sus derechos, deberes y prohibiciones

Prestarán sus servicios ad-honorem, motivados por el fin de coadyuvar en la gestión del SINAC.

Los voluntarios (as) que brinden sus servicios en el SINAC, se enlistaran en las siguientes categorías:

• a)Categoría 1: Miembros de organizaciones nacionales, instituciones nacionales y empresas privadas nacionales que organizan y ejecutan acciones de voluntariado en el SINAC.
• b)Categoría 2: Miembros de organizaciones internacionales, instituciones internacionales y empresas privadas internacionales que organizan y ejecutan acciones de voluntariado en el SINAC.
• c)Categoría 3: Miembros de organizaciones locales, grupos comunitarios locales y empresas privadas locales que realizan acciones de voluntariado en el SINAC.
• d)Categoría 4: Particulares que realizan acciones de voluntariado en el SINAC, de manera individual.

• a)Recibir inducción y asesoría sobre sus derechos, deberes, responsabilidades, prohibiciones y la información general del lugar donde prestará el servicio de voluntariado.
• b)Recibir las instrucciones necesarias para llevar a cabo el trabajo que se le asigne, de acuerdo al plan de trabajo.
• c)Solicitar apoyo y colaboración a los funcionarios (as) públicos del lugar donde preste el servicio voluntario, para poder desempeñar eficazmente sus funciones.
• d)Recibir de forma obligatoria, la identificación que corresponde, al ingresar al lugar donde prestará el servicio de voluntariado.
• e)Contar con las condiciones necesarias para su permanencia y óptimo desempeño, específicamente lo relacionado con equipo de trabajo, instrucciones de trabajo y transporte, para el caso de ASP además lo relacionado con hospedaje, cuando realicen actividades relacionadas con el objetivo institucional y cuenten con el permiso correspondiente.
• f)Recibir un trato cortés, amable y respetuoso por parte de los funcionarios (as) públicos, otros voluntarios (as) y particulares, durante su permanencia en el lugar donde preste el servicio de voluntario.

• a)Cumplir con las disposiciones jurídicas vigentes, así como con las directrices que al efecto dicte el Sistema Nacional de Áreas de Conservación.
• b)Completar la boleta de ingreso de voluntarios (as) ante la instancia correspondiente del SINAC.
• c)Contar con una póliza básica de accidentes y para el caso de los extranjeros la póliza debe contener además, la cobertura para el caso de repatriación.
• d)Colaborar con los funcionarios (as) públicos competentes en las labores que se les asignen, con base en el plan de trabajo correspondiente.
• e)Acatar las instrucciones que gire el funcionario (a) a cargo del lugar donde prestará el servicio voluntario, siempre y cuando se ajusten al ordenamiento jurídico, a este reglamento y al plan de trabajo.
• f)Notificar al respectivo administrador (a) del área silvestre protegida, o al jefe de la oficina del SINAC, donde preste el servicio de voluntariado, de cualquier irregularidad cometida por funcionarios (as) públicos, otros voluntarios (as), o particulares.
• g)Reportar los obstáculos, limitaciones o dificultades, en caso de darse, que se hayan presentado para realizar su labor de manera efectiva.
• h)Mantener durante su estadía en el lugar donde preste el servicio voluntario una actitud permanente de seriedad, prudencia y atención, así como de cortesía y amabilidad con otros voluntarios, con los funcionarios (as) del SINAC y el público en general.
• i)En caso de requerirse, deberán brindar testimonio fiel ante la autoridad competente de todo cuanto hubieren visto, escuchado y actuado durante el tiempo que permanecieron, en el lugar donde prestaron el servicio de voluntariado, dentro del SINAC.
• j)Cumplir fielmente las disposiciones de este Reglamento y las normas conexas que disponga el ordenamiento jurídico.
• k)Portar permanentemente la debida identificación cuando se encuentren prestando servicio de voluntariado en el SINAC.
• l)Responder por cualquier daño, pérdida o extravío que ocasionen a las instalaciones, equipo y otros bienes del Estado durante su periodo como voluntario, de conformidad con lo que establezca la normativa aplicable. En casos en que deba darse la reposición, se contará de previo, con un avalúo emitido por la oficina de Patrimonio del SINAC del bien a reponer.
• m)En caso de que los voluntarios (as) sean menores de edad, deberán ser acompañados por el encargado de grupo o por el padre o tutor, quien será voluntario también; por el tiempo que se preste el servicio voluntario, y éstos serán responsables de velar por el cumplimiento de lo expuesto en este reglamento, como de la seguridad de los menores.
• n)Presentar un certificado de salud con no más de 3 meses de expedido antes de ingresar al lugar donde prestará el servicio de voluntariado, en idioma inglés o español.
• o)Presentar hoja de delincuencia o documento equivalente, para el caso de voluntarios incluidos en la categoría 4 y para el caso de las categorías 1, 2 y 3 cumplir con lo dispuesto en el inciso j) del artículo 14 del presente reglamento.

• a)Actuar de manera contraria a las disposiciones de la normativa vigente, de las directrices que dicte el Sistema Nacional de Áreas de Conservación y del presente reglamento.
• b)Asumir funciones de autoridad de policía u otras que estén reservadas en forma exclusiva para los funcionarios (as) públicos, de conformidad con la normativa aplicable.
• c)Hacer uso de instalaciones, equipo y otros bienes del Estado sin contar con la debida autorización de las autoridades donde preste el servicio de voluntariado.
• d)Causar daños a la propiedad o equipo del Estado.
• e)Utilizar y consumir dentro de las ASP u oficinas administrativas del SINAC donde preste el servicio de voluntario sustancias tóxicas (alcohol, cigarro y sustancias psicotrópica de uso no autorizado).

De las organizaciones

• a)Contar con una póliza básica de accidentes, a efectos de cubrir a los voluntarios en caso de accidente u otro, por el tiempo que presten el servicio de voluntariado en el SINAC y en el caso de extranjeros la póliza debe contener la cobertura para repatriación. Para tales efectos la organización, empresa privada o institución debe presentar una certificación de la entidad aseguradora donde especifique el tipo de póliza que tienen los voluntarios de su organización o en su defecto, la póliza individual de cada voluntario.
• b)En caso de que los voluntarios (as) sean menores de edad, deberán cumplir con lo establecido en el artículo 11, inciso m) del presente reglamento.
• c)Cubrir los costos de alimentación y transporte de los voluntarios al lugar donde prestarán el servicio, así como cualquier otro costo que surja en razón de circunstancias no previstas.
• d)Mantener informado a los voluntarios por los diferentes medios de publicidad y divulgación que utilice la organización, empresas privadas o institución nacional o internacional, que el SINAC brinda el hospedaje dentro de las ASP a los voluntarios durante el periodo de prestación del servicio de voluntariado en el ASP, sin costo alguno.
• e)Mantener un registro interno actualizado de todos sus voluntarios (as).
• f)Capacitar a los voluntarios (as) sobre los objetivos y la naturaleza de las labores que desempeñarán en las áreas silvestres protegidas o en las oficinas administrativas del SINAC, así como en lo relativo a sus derechos, deberes y prohibiciones, de acuerdo con lo establecido en este reglamento.
• g)Acatar las disposiciones vigentes que rigen en las áreas silvestres protegidas y oficinas administrativas del SINAC, en materia jurídica y administrativa, así como cualquier otra directriz que dicten en esta materia, las autoridades respectivas.
• h)Garantizar el cumplimiento del plan de trabajo para el período de permanencia de los voluntarios (as) en las áreas silvestres protegidas o en las oficinas administrativas del SINAC.
• i)Constancia de no deudas obrero patronales con la Caja Costarricense del Seguro Social.
• j)Declaración jurada en la cual la organización manifieste que los voluntarios han sido sometidos a controles internos de la misma para su selección, en términos de conducta, antecedentes penales y otros.

De las faltas y sanciones

Para el caso de los menores de edad, los padres o tutores serán los responsables legales de sus acciones, ante el Estado o ante terceros.

• a)Incumplir con los deberes, obligaciones y prohibiciones establecidas en el presente reglamento.
• b)Recibir dádivas, recompensas, favores o pagos de cualquier tipo, durante el tiempo que permanezcan en el lugar donde prestan el servicio de voluntariado.
• c)Actuar bajo los efectos de sustancias tóxicas (alcohol, cigarro y sustancias psicotrópica de uso no autorizado), durante el desempeño de sus funciones de voluntariado.
• d)Agredir en forma física, verbal o psicológica a cualquier persona.
• e)Retener ilegalmente o no reportar a la autoridad competente, artículos u objetos pertenecientes a los visitantes, a otros voluntarios (as), a los funcionarios (as) del SINAC o terceras personas, que hayan quedado perdidos u olvidados.
• f)Hacer uso de instalaciones, equipo y otros bienes del Estado sin contar con la debida autorización de la Administración.
• g)Cualquier otra que la Administración estime pertinente.

La Administración analizará los casos en que la sanción a imponer a los voluntarios infractores, deba consistir en el impedimento para que le voluntario realice acciones de este tipo, en forma permanente o por un plazo determinado, en el sitio donde cometió la falta o si dicha sanción debe ser extienda a las demás ASP y oficinas administrativas del SINAC.

Las sanciones indicadas en el artículo 18, deberá decretarse por la Administración mediante acto debidamente fundamentado, mismo que deberá notificarse a la organización, institución o empresa privada responsable o al voluntario individual, según corresponda.

Donaciones, condiciones dadas por el SINAC a los voluntarios y disposiciones supletorias

• a)En caso de dinero en efectivo el depósito deberá ser realizado directamente por el voluntario, organización, institución u otra, en la cuenta especial del Fondo de Parques Nacionales del SINAC 100-01-000-041220-5 en el Banco Nacional de Costa Rica, especificando que es para el programa de voluntariado.
• b)Para el caso de donaciones en especie, se deberá seguir el trámite previsto en el artículo 19 del Reglamento para el Registro y Control de Bienes de la Administración Central Decreto Ejecutivo Nº 30720-H del 26 de agosto del 2002.

Lo anterior, con excepción del Parque Nacional Marino Isla del Coco, que por sus condiciones especiales de distancia y manejo especial que debe darse a los alimentos a ingresar al ASP, la administración podrá brindar la alimentación a los voluntarios y el transporte acuático, de acuerdo a las disposiciones de la Dirección del Área de Conservación Marina Isla del Coco.
