in the entirety of the text - Full Text of Regulation 36773 Declares of Public Utility for the interests of the State the Administrative Association of the Matapalo Aqueduct and Sanitary Sewer System Full Text of record: 177059 No. 36773-JP (This executive decree was rendered without effect by article 1 of executive decree No. 45030 of February 26, 2025) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, on article 32 of the Law of Associations and on articles 27 and following of its Regulation.
I.-That article 32 of the Law of Associations number 218 of August eight, nineteen hundred thirty-nine and its amendments, confers upon the Executive Branch the power to declare of Public Utility simple, federated or confederated Associations, whose development and activities are particularly useful for the interests of the State, and which thereby contribute to addressing a social need.
II.-That the Administrative Association of the Matapalo Aqueduct and Sanitary Sewer System, Savegre District, Aguirre Canton, Puntarenas Province, legal entity identification number: 3-002-357597, was registered in the Associations Registry of the Public Registry since January thirteen, two thousand six, under case file number 15891, entry 32.
III.-That the purposes pursued by the Association, according to its articles of incorporation, are transcribed as follows: ".Article Three "the purposes of the Association are the following: ". A) Manage, operate, maintain, develop and keep in good condition the aqueduct, in accordance with the provisions and regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), which shall be of mandatory compliance. B) Secure the effective participation of the community in the construction, operation, maintenance and development of the aqueduct. C) Secure the effective participation of the community in the construction and maintenance of the aqueduct. D) Collaboration in educational programs and campaigns that are undertaken. E) Help to explain and disseminate the provisions and regulations of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados). F) Cooperate with the plans, projects and works undertaken by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados). G) Participate in matters relating to the management, conservation and rational exploitation of waters; control of their contamination or alteration, definition of measures and actions necessary for the protection of hydrographic basins and ecological stability. H) Ensure that all systems, their aqueduct or sanitary sewer installations, comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, cost rationalization, etc. I) Provide public services, in an efficient, equal and timely manner to all its users, without distinctions of any nature".
IV.-That such purposes address a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore, THEY DECREE:

I.-Que el artículo 32 de la Ley de Asociaciones número 218 del ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo, Distrito Savegre, Cantón de Aguirre, Provincia de Puntarenas, cédula de Persona Jurídica número: 3-002-357597, se inscribió en el Registro de Asociaciones del Registro Público desde el día trece de enero del dos mil seis, bajo el expediente número 15891, asiento 32.
III.-Que los fines que persigue la Asociación, según su acta constitutiva son los que se transcriben: ".Artículo Tercero "los fines de la Asociación son los siguientes: ". A) Administrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto, de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio. B) Obtener la participación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo del acueducto. C) Obtener la participación efectiva de la comunidad en la construcción y mantenimiento del acueducto. D) Colaboración en los programas y campañas de índole educativo que se emprendan. E) Ayudar a explicar y divulgar las disposiciones y reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. F) Cooperar con los planes, proyectos y obras que emprenda el Instituto Costarricense de Acueductos y Alcantarillados. G) Participar en asuntos relativos a la administración, conservación y explotación racional de las aguas; control de su contaminación o alteración, definición de medidas y acciones necesarias para la protección de las cuencas hidrográficas y estabilidad ecológica. H) Velar porque todos los sistemas, sus instalaciones acueductos o alcantarillados sanitario, cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc. I) Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza".
IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
