in the entirety of the text - Complete Text of Norm 36563 Reform of Article 22 of the Regulation to the Law of the National Institute of Innovation and Transfer in Agricultural Technology Complete Text of act: DB82D No. 36563-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers conferred upon them by Article 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, Articles 25, 27.1, 28.2b, of the General Law of Public Administration, Law No. 6227 of May 2, 1978, the Law of the National Institute of Innovation and Transfer in Agricultural Technology, Law No. 8149 of November 5, 2001, and the Regulation to the Law of the National Institute of Innovation and Transfer in Agricultural Technology (INTA), Executive Decree number 31857-MAG published in La Gaceta number 146 of July 27, 2004, and;

1. 1That through Law No. 8149 of November 5, 2001, published on November 22, 2001, in La Gaceta No. 225, the National Institute of Innovation and Transfer in Agricultural Technology -INTA- was created.
2. 2That the National Institute of Innovation and Transfer in Agricultural Technology was created with the objective of contributing to the improvement and sustainability of the Agricultural Sector, through the generation, innovation, validation, research, and dissemination of technology, for the benefit of Costa Rican society; for which reason its efficient and effective functioning is of utmost importance for the development of the National Agricultural Sector.
3. 3That through Executive Decree number 31857-MAG published in La Gaceta number 146 of July 27, 2004, the Regulation to the Law of the National Institute of Innovation and Transfer in Agricultural Technology (INTA) was issued.
4. 4That Article 22 of the Regulation cited in the preceding paragraph establishes that the governing members of the Institute who are not public officials shall earn per diems (dietas) whose amount may not exceed that established for autonomous institutions that do not belong to the National Banking System, and the amount of the per diems (dietas) shall be set by the Executive Branch.
5. 5That per diems (dietas) correspond to the non-salary remuneration received by the members of boards of directors and collegial bodies created by law, on the occasion of attendance at sessions of the respective collegial body.
6. 6That for reasons of subject-matter jurisdiction, the amount that members of the Board of Directors of the National Institute of Innovation and Transfer in Agricultural Technology (INTA) should receive as per diems (dietas) must be consistent with the average of the amounts that the members of the Boards of Directors of the Institutions comprising the Agricultural Sector earn under that heading, among which are the Consejo Nacional de Producción (CNP), the Instituto de Desarrollo Agrario (IDA), the Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), the Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), and the Programa Integral de Mercadeo Agropecuario (PIMA).
7. 7That the indicated average shall be obtained from the sum of the amounts that the members of the Boards of Directors of the Institutions indicated in the preceding paragraph earn under that heading, divided by the same number of institutions.
8. 8That the members of the Board of Directors of the National Institute of Innovation and Transfer in Agricultural Technology, in accordance with the provisions of Article 10 of the Law of the National Institute of Innovation and Transfer in Agricultural Technology (INTA), shall be personally liable for their acts and their management, and the same regulatory body, in its Article 12, imposes upon them functions and duties not only of direction and policies of the Body, but also includes others of an administrative nature, such as the administration of the financial resources of the Institute and approving the Institute's policies on investment, among others. Therefore,

Considering:

en la totalidad del texto - Texto Completo Norma 36563 Reforma artículo 22 del Reglamento a la Ley del Instituto Nacional de Innovación y transferencia en Tecnología Agropecuaria Texto Completo acta: DB82D Nº 36563-MAG LA PRESIDENTA DE LA REPÚBLICA Y LA MINISTRA DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren el artículo 140 incisos 3), 8) 18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b, de la Ley General de la Administración Pública, Ley Nº 6227 de 2 de mayo de 1978, la Ley del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria, Ley Nº 8149 del 5 de noviembre del 2001, y el Reglamento a la Ley del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), Decreto Ejecutivo número 31857-MAG publicado en La Gaceta número 146 del 27 de julio del 2004, y;

1. 1Que mediante Ley Nº 8149 de fecha 5 de noviembre del 2001, publicada el 22 de noviembre del 2001, en La Gaceta N2 225, se creó el Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria -INTA-.
2. 2Que el Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria fue creado con el objetivo de contribuir al mejoramiento y la sostenibilidad del Sector Agropecuario, por medio de la generación, innovación, validación, investigación y difusión de tecnología, en beneficio de la sociedad costarricense; razón por la cual su funcionamiento eficiente y eficaz es de suma importancia para el desarrollo del Sector Agropecuario Nacional.
3. 3Que mediante Decreto Ejecutivo número 31857-MAG publicado en La Gaceta número 146 del 27 de julio del 2004, se emitió el Reglamento a la Ley del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA).
4. 4Que el artículo 22 del Reglamento citado en el párrafo anterior establece que los miembros directivos del Instituto que no sean funcionarios públicos, devengarán dietas cuyo monto no podrá ser superior al establecido para las instituciones autónomas, que no pertenezcan al Sistema Bancario Nacional y el monto de las dietas será fijado por el Poder Ejecutivo.
5. 5Que las dietas corresponden a la remuneración de tipo no salarial que reciben los miembros de juntas directivas y órganos colegiados creados por ley, con ocasión de la asistencia a las sesiones del órgano colegiado respectivo.
6. 6Que por razones de competencia por la materia, el monto que deben percibir los miembros de la Junta Directiva del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) por concepto de dietas, debe ser concordante con el promedio de los montos que por tal rubro devengan los miembros de las Juntas Directivas de las Instituciones que componen el Sector Agropecuario, entre las cuales se encuentran el Consejo Nacional de Producción (CNP), el Instituto de Desarrollo Agrario (IDA), el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), el Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) y el Programa Integral de Mercadeo Agropecuario (PIMA).
7. 7Que el promedio indicado se obtendrá de la sumatoria de los montos que por tal concepto devengan los miembros de las Juntas Directivas de las Instituciones indicadas en el párrafo anterior y dividido entre igual número de instituciones.
8. 8Que los miembros de la Junta Directiva del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria, de conformidad en lo establecido en el artículo 10 de la Ley del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), responderán personalmente por sus actos y su gestión y el mismo cuerpo normativo, en su artículo 12, les impone funciones y deberes no solo de dirección y políticas del Órgano, sino que también se incluyen otras de índole administrativa, tales como la administración de los recursos financieros del Instituto y aprobar las políticas del Instituto en materia de inversión, entre otras. Por tanto,
