Financial Cooperation Agreement — Northern Huetar Forestry ProjectConvenio de Cooperación Financiera — Proyecto Forestal Huetar Norte

The text is as follows:

"AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY AND THE GOVERNMENT OF THE REPUBLIC OF COSTA RICA ON FINANCIAL COOPERATION - HUETAR NORTE FORESTRY PROJECT The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica, in the spirit of the friendly relations existing between the Federal Republic of Germany and the Republic of Costa Rica, desiring to consolidate and intensify these friendly relations through financial cooperation between both Parties, aware that the maintenance of these relations constitutes the basis of this present Agreement, with the purpose of contributing to the social and economic development of the Republic of Costa Rica, with reference to the commitment assumed by the German Embassy in San José on December 16, 1992, have agreed as follows:

(1) The Government of the Federal Republic of Germany shall grant the Government of the Republic of Costa Rica and/or other recipients that both Governments designate by mutual agreement the possibility of obtaining from the Kreditanstalt für Wiederaufbau (Credit Institute for Reconstruction), Frankfurt/Main, a financial contribution (aportación financiera) for a total value of up to 10,225,838,-EUR (in words: ten million two hundred twenty-five thousand eight hundred thirty-eight euros) for the Huetar Norte forestry project, if said project, after being examined, proves worthy of support and it is confirmed that, as an environmental protection project, it meets the special conditions necessary to be promoted through a financial contribution (aportación financiera).

(Note from Sinalevi: Through Article 2 of the International Treaty "Approval of the Agreement between the Government of the Federated Republic of Germany and the Government of the Republic of Costa Rica on Financial Cooperation Huetar Norte Forestry Project", No. 8355 of May 28, 2003, the Government of Costa Rica interpreted the following: "... The Government of the Republic of Costa Rica interprets that, for the purposes of Article 1 of this present Agreement, it is understood that, if the project indicated in subsection 1) of Article 1 is modified, the Government of Costa Rica must comply with the internal procedures for the approval of the loans, in accordance with subsection 15) of Article 121 of the Political Constitution...") (2) The project mentioned in paragraph 1 may be replaced by other projects related to tropical forests if the Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica so agree, by exchange of notes. In the event that the project mentioned in paragraph 1 is replaced by an environmental protection or social infrastructure project or a self-help measure aimed at combating poverty or a measure aimed at improving the social position of women or a credit guarantee fund for small and medium-sized enterprises, which meets the special conditions necessary to be promoted through a financial contribution (aportación financiera), a financial contribution (aportación financiera) may be granted; otherwise, a loan may be granted.

(3) In the event that the Government of the Federal Republic of Germany grants at a later time to the Government of the Republic of Costa Rica the possibility of obtaining from the Kreditanstalt für Wiederaufbau new financial contributions (aportaciones financieras) for the preparation of the project mentioned in paragraph 1 or for necessary related measures for the realization and servicing of the project mentioned in paragraph 1, the present Agreement shall apply.

(4) The financial contributions (aportaciones financieras) for preparatory or related measures under paragraph 3 shall become loans if they are not used for such measures. The conditions under which these loans would be granted shall be those customary for this type of loan that the Kreditanstalt für Wiederaufbau grants. The granting of these loans shall be negotiated by mutual agreement between the Parties, in accordance with their internal legal framework.

(1) The use of the sum mentioned in Article 1, the conditions of its granting, and the procedure for the awarding of contracts shall be set forth in the financing contracts to be concluded between the Kreditanstalt für Wiederaufbau and the recipients of the financial contribution (aportación financiera), contracts that shall be subject to the legal provisions in force in the Federal Republic of Germany.

(2) The Government of the Republic of Costa Rica, if it is not the recipient of the financial contributions (aportaciones financieras), shall guarantee to the Kreditanstalt für Wiederaufbau any potential claims for reimbursement based on the financing contracts to be concluded according to paragraph 1.

The Kreditanstalt für Wiederaufbau is exempt from all taxes and other public levies.

Regarding maritime and air transport of persons and goods resulting from the granting of the financial contributions (aportaciones financieras), the Government of the Republic of Costa Rica shall permit the passengers and suppliers to choose freely among the transport companies authorized to operate in Costa Rica, and shall not adopt measures that exclude or hinder the equal participation of transport companies headquartered in the Federal Republic of Germany.

This present Agreement shall enter into force on the day on which the Government of the Republic of Costa Rica notifies the Government of the Federal Republic of Germany that the necessary internal requirements on the part of the Republic of Costa Rica have been fulfilled.

"CONVENIO ENTRE EL GOBIERNO DE LA REPÚBLICA FEDERAL DE ALEMANIA Y EL GOBIERNO DE LA REPÚBLICA DE COSTA RICA SOBRE COOPERACIÓN FINANCIERA - PROYECTO FORESTAL HUETAR NORTE El Gobierno de la República Federal de Alemania y el Gobierno de la República de Costa Rica, en el espíritu de las relaciones amistosas existentes entre la República Federal de Alemania y la República de Costa Rica, deseando consolidar e intensificar estas relaciones amistosas por medio de una cooperación financiera entre ambas Partes, conscientes de que el mantenimiento de estas relaciones constituye la base del presente Convenio, con el propósito de contribuir al desarrollo social y económico de la República de Costa Rica, con referencia al compromiso asumido por la Embajada Alemana en San José el 16 de diciembre de 1992, han convenido en lo siguiente:

(1) El Gobierno de la República Federal de Alemania otorgará al Gobierno de la República de Costa Rica y/o a otros receptores que ambos Gobiernos designen de común acuerdo la posibilidad de obtener de la Kreditanstalt für Wiederaufbau (Instituto de Crédito para la Reconstrucción), Frankfurt/Main, una aportación financiera por un valor total de hasta 10.225.838,-EUR (en letras: diez millones doscientos veinticinco mil ochocientos treinta y ocho euros) para el proyecto forestal Huetar Norte, si dicho proyecto, después de examinado, resulta digno de apoyo y se confirma que, en cuanto proyecto de protección ambiental, reúne las condiciones especiales necesaria para ser fomentado a través de una aportación financiera.

(Nota de Sinalevi: Mediante el artículo 2° del Tratado Internacional "Aprueba el Convenio entre el Gobierno de la República Federada de Alemania y el Gobierno de la República de Costa Rica sobre Cooperación Financiera Proyecto Forestal Huetar Norte" , N° 8355 del 28 de mayo del 2003, el Gobierno de Costa Rica interpretó lo siguiente: "... El Gobierno de la República de Costa Rica interpreta que, para los efectos del artículo 1 del presente Convenio se entiende que, de modificarse el proyecto señalado en el inciso 1) del artículo 1, el Gobierno de Costa Rica deberá cumplir los trámites internos de aprobación de los empréstitos, de conformidad con el inciso 15) del artículo 121 de la Constitución Política...") (2) El proyecto mencionado en el párrafo 1 podrá ser reemplazado por otros proyectos relacionados con los bosques tropicales si el Gobierno de la República Federal de Alemania y el Gobierno de la República de Costa Rica así lo conviene, por intercambio de notas. En caso de que el proyecto mencionado en el párrafo 1 sea sustituido por un proyecto de protección medioambiental o de infraestructura social o una medida de autoayuda orientada a combatir la pobreza o una medida orientada a mejorar la posición social de la mujer o un fondo de garantía de crédito para pequeñas y medianas empresas, que reúna las condiciones especiales necesarias para ser fomentado a través de una aportación financiera, podrá concederse una aportación financiera; de no ser así, podrá concederse un préstamo.

(3) En caso de que el Gobierno de la República Federal de Alemania otorgue en un momento posterior al Gobierno de la República de Costa Rica la posibilidad de obtener de la Kreditanstalt für Wiederaufbau nuevas aportaciones financieras para la preparación del proyecto mencionado en el párrafo 1 o para medidas conexas necesarias destinadas a la realización y atención del proyecto mencionado en el párrafo 1, se aplicará el presente Convenio.

(4) Las aportaciones financieras para medidas preparatorias o conexas conforme al párrafo 3 se convertirán en préstamos si no utilizan para tales medidas. Las condiciones en que se otorgarían estos préstamos serán las habituales para este tipo de préstamos que otorga a la Kreditanstalt für Wiederaufbau. La concesión de estos préstamos será negociada de común acuerdo entre las Partes, de conformidad con su marco jurídico interno.

(1) El empleo de la suma mencionada en el Artículo 1, las condiciones de su concesión y el procedimiento de adjudicación de encargos se fijarán en los contratos de financiación que habrán de concertarse entre la Kreditanstalt für Wiederaufbau y los receptores de la aportación financiera, contratos que estarán sujetos a las disposiciones legales vigentes en la República Federal de Alemania.

(2) El Gobierno de la República de Costa Rica, si no es el mismo el receptor de las aportaciones financieras, garantizará ante la Kreditanstalt für Wiederaufbau las eventuales reclamaciones de devolución basadas en los contratos de financiación que habrán de concertarse según el párrafo 1.

La Kreditanstalt für Wiederaufbau está exento de todos los impuestos y demás gravámenes públicos.

Respecto a los transportes marítimos y aéreos de personas y mercancías resultantes de la concesión de las aportaciones financieras, el Gobierno de la República de Costa Rica permitirá a los pasajeros y proveedores elegir libremente entre las empresas de transporte, autorizados para funcionar en Costa Rica, no adoptará medidas que excluyan o dificulten la participación en pie de igualdad de las empresas de transporte con sede en la República Federal de Alemania.

El presente Convenio entrará en vigor el día en que el Gobierno de la República de Costa Rica comunique al Gobierno de la República Federal de Alemania que se han cumplido los requisitos internos necesarios por parte de la República de Costa Rica.

Hecho en Bonn, el dieciocho de octubre 2002, en dos ejemplares, en alemán y español, siendo ambos textos igualmente auténticos.
