I.-That organic agricultural activity benefits human, animal, and plant health, together with the development of public policies aimed at the conservation of biodiversity and the environment.
II.-That it is necessary to ensure the fulfillment of the objectives of development, promotion, fostering, and management of organic agricultural activity in an efficient manner through control and promotion mechanisms.
III.-That by means of Law No. 8591 of June 28, 2007, published in La Gaceta number 155 of August 14, 2007, organic agricultural activity was declared of public interest and is recognized as a provider of environmental services and subject to remuneration for this concept.
IV.-That by means of Executive Decree No. 35242-MAG-H-MEIC of November 18, 2008, published in La Gaceta No. 107 of June 4, 2009, the Regulation for the Development, Promotion and Fostering of Organic Agricultural Activity was issued.
V.-That it is necessary to guarantee access, under conditions of equality and in an efficient manner, to the benefits granted by the cited Law No. 8591 to persons engaged in organic agricultural activity.
VI.-That the current wording of article 34 of Executive Decree No. 35242-MAG-H-MEIC, establishes as a requirement the communication, by means of an Executive Decree, of the amounts assigned for the recognition of environmental benefits under Law No. 8591, which is unnecessary given that said amounts are defined by agreement of the Technical Unit (Unidad Técnica, UT), in accordance with the functions that have been normatively assigned to it and formalized by means of agreements signed between the Ministry of Agriculture and Livestock and the organic producer. In addition, the fact that transferring the payment to the month of January of each year causes a budgetary problem when approving a credit act that must be paid the following year. Therefore,

I.-Que la actividad agropecuaria orgánica beneficia la salud humana, animal y vegetal, en conjunto con el desarrollo de políticas públicas orientadas a la conservación de la biodiversidad y el medio ambiente.
II.-Que es necesario asegurar el cumplimiento de los objetivos de desarrollo, promoción, fomento y gestión de la actividad agropecuaria orgánica de manera eficiente a través de mecanismos de control y promoción.
III.-Que mediante Ley Nº 8591 del 28 de junio del 2007, publicada en La Gaceta número 155 del 14 de agosto del 2007, se declaró de interés público la actividad agropecuaria orgánica y se le reconoce como prestadora de servicios ambientales y sujeto de remuneración por este concepto.
IV.-Que mediante Decreto Ejecutivo Nº 35242-MAG-H-MEIC del 18 de noviembre del 2008, publicado en La Gaceta Nº 107 del 4 de junio del 2009 se emitió el Reglamento para el Desarrollo, Promoción y Fomento de la Actividad Agropecuaria Orgánica.
V.-Que es necesario garantizar el acceso en condiciones de igualdad y de manera eficiente, a los beneficios otorgados por la citada Ley Nº 8591 a las personas dedicadas a la actividad agropecuaria orgánica.
VI.-Que la redacción actual del artículo 34 del Decreto Ejecutivo Nº 35242-MAG-H-MEIC, establece como requisito la comunicación, mediante Decreto Ejecutivo, de los montos asignados por concepto de reconocimiento de beneficios ambientales al amparo de la Ley Nº 8591, lo cual resulta innecesario toda vez que dichos montos son definidos mediante acuerdo de la Unidad Técnica, de conformidad con las funciones que normativamente le han sido asignadas y formalizados mediante convenios suscritos entre el Ministerio de Agricultura y Ganadería y el productor orgánico. Además de que el trasladar el pago para el mes de enero de cada año ocasiona un problema de índole presupuestaria al aprobar un acto crediticio que debe cancelarse al año siguiente. Por tanto,
