I.-That the Ministers of Economic Integration of Central America, in resolution number 250-2010 (COMIECO-LVIII) dated September 3, 2010, approved the tariff reductions of the tariff subheadings required for the implementation of the Multilateral Environmental Agreements that require appropriate control by the corresponding authorities, which become an integral part of Annex "A" of the Central American Agreement on the Tariff and Customs Regime, a resolution published by means of Decree No. 36315-COMEX, in La Gaceta No. 6 of January 10, 2011.

II.-That under the protection of Law 7293 of March 31, 1992, Articles 4 and 5, the Exemptions Department of the General Directorate of Finance granted the generic tax exemption benefit for the importation of various products.

III.-That the generic tax exemption authorizations must be applied at the respective customs office under the terms in which it was granted, including the tariff subheading stated therein.

IV.-That as of the effective date of Resolution 250-2010 (COMIECO-LVIII), the Directorate of Finance, through the Exemptions Department, had already issued generic tax exemption authorizations with the tariff subheadings prior to the modifications made by the cited resolution, and which in turn were transmitted to the TICA computer application for their application; making it complex to update such authorizations. Therefore, The General Directorate of Finance and the General Customs Directorate, with the purpose of streamlining the formalities and procedures in customs administration due to the change generated in the tariff subheadings, by reason of the approval of the tariff reductions of the tariff subheadings for the implementation of the Multilateral Environmental Agreements, agree to allow the application of the current generic tax exemption authorizations transmitted to the TICA computer application, issued prior to the date on which the tariff reductions for the implementation of the Multilateral Environmental Agreements (Resolution No. 250-2010) entered into force, with the subheading noted in each authorization. This provision is applicable until April 10, 2011. Effective as of January 10, 2011. To be published in the official gazette La Gaceta.

Considering:

I.-Que los Ministros de Integración Económica de Centroamérica en resolución número 250-2010 (COMIECO-LVIII) de fecha 03 de setiembre de 2010, aprobó las aperturas arancelarias de los incisos arancelarios que se requieren para la implementación de los Convenios Ambientales Multilaterales que requieren de un apropiado control por parte de las autoridades correspondientes, los cuales pasan a formar parte integral del Anexo "A" del Convenio sobre el Régimen Arancelario y Aduanero Centroamericano, resolución publicada mediante el Decreto Nº 36315-COMEX, en La Gaceta Nº 6 de 10 de enero de 2011.

II.-Que al amparo de la Ley 7293 de 31 de marzo de 1992, artículos 4 y 5, el Departamento de Exenciones de la Dirección General de Hacienda, concedió el beneficio de exención fiscal genérica a la importación de diversos productos.

III.-Que las autorizaciones de exención fiscal genéricas debe ser aplicadas ante la aduana respectiva en los términos en que la misma fue otorgada, incluyendo el inciso arancelario consignado en ellas.

IV.-Que a la fecha de entrada en vigencia la Resolución 250-2010 (COMIECO-LVIII), la Dirección de Hacienda a través del Departamento de Exenciones, ya había emitido autorizaciones de exención fiscal genéricas con los incisos arancelarios anteriores a las modificaciones por la resolución citada y las cuales a su vez fueron transmitidas a la aplicación informática TICA, para su aplicación; resultando complejo realizar actualizaciones de tales autorizaciones. Por tanto, La Dirección General de Hacienda y la Dirección General de Aduanas con el propósito de agilizar los trámites y procedimientos en la administración aduanera por el cambio generado en los incisos arancelarios, en razón de la aprobación de las aperturas arancelarias de los incisos arancelarios para la implementación de los Convenios Ambientales Multilaterales, acuerdan permitir la aplicación de las autorizaciones de exención fiscal genéricas vigentes y transmitidas a la aplicación informática TICA, emitidas con anterioridad a la fecha en que entró en vigencia las aperturas para la implementación de los Convenios Ambientales Multilaterales (Resolución Nº 250-2010), con el inciso anotado en cada autorización. Esta disposición es aplicable hasta el 10 de abril de 2011. Rige a partir del 10 de enero del 2011. Publíquese en el diario oficial La Gaceta.
