1That it is an essential function of the State to protect plants from the damages caused by pests, as well as to regulate the use and management of chemical, biological and related substances in order to protect plant health, human health and the environment.
2That for the national economy and food security, the phytosanitary protection of products of plant origin is fundamental, which obliges the State to adopt all necessary prevention, surveillance and control measures to avoid the entry and dissemination of pests that endanger or may cause harm to people or the national agricultural heritage.
3That the State, based on the framework of the agreement for the application of sanitary and phytosanitary measures, must adopt those that are necessary to protect the health and life of people, animals and plants, basing these measures on an assessment appropriate to the circumstances and the eventual risks involved, ensuring that these measures do not constitute obstacles to international trade.
4That technical evidence has demonstrated that one of the main pathways for the dissemination of pests is through the movement of material of plant origin whose means of transport is baggage such as: suitcases, briefcases, backpacks, among others, used by people entering or leaving the country. Therefore, in order to protect the agricultural heritage, the scanning of baggage is established to reduce the risk of introducing new regulated pests.
5That it is a requirement of the banking entity that will carry out the collection of the money, for the payment of the scanning service provided, that the regulation be clear and that it stipulate within it, that it refers to entries into and exits from the country.
6That it is necessary to update the operating costs of the baggage inspection system, with the objective of maintaining an efficient and effective system.
7That given the lack of clarity in the wording of some items of article 2 of Executive Decree No. 27763-MAG of March 10, 1999, published in Supplement No. 26 to La Gaceta No. 68 of April 9, 1999, corresponding to the Setting of Tariffs of the Ministry of Agriculture, it is necessary to make the pertinent modification for an adequate reading of the same. Therefore,

They decree:

Reform of article 2, subsections 5.c, 6.b, 6.c, and 17 of Executive Decree No. 27763-MAG of March 10, 1999, published in Supplement No. 26 to La Gaceta No. 68 of April 9, 1999, corresponding to the Setting of Tariffs of the Ministry of Agriculture and Livestock and Reform of article 3, of Executive Decree No. 35753-MAG, published in La Gaceta No. 43 of March 3, 2010, denominated "Reform of articles 2, 6 and 8 of Executive Decree No. 27763- MAG of March 10, 1999, corresponding to the setting of tariffs for the services of the Ministry of Agriculture and Livestock

Considering:

35753 MAG, published in La Gaceta No. 43 of March 3, 2010, is hereby modified to read as follows:

"Article 3º-The services of X-ray scanning or baggage inspection shall have a cost of $2.00 per person. Said charge shall be made upon entry or upon exit of persons, as is convenient to the administration."

2Que para la economía nacional y la seguridad alimentaria, la protección fitosanitaria de los productos de origen vegetal resulta fundamental, lo que obliga al Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para evitar el ingreso y diseminación de plagas que pongan en peligro o puedan causar daño a las personas o al patrimonio agrícola nacional.
3Que el Estado con base en el marco del acuerdo para la aplicación de las medidas sanitarias y fitosanitarias, debe adoptar aquellas que resulten necesarias para proteger la salud y la vida de las personas, de los animales y vegetales, basando estas medidas en una evaluación adecuada a las circunstancias y a los riesgos eventuales que ello conlleve, asegurando que estas medidas no constituyan obstáculos para el comercio internacional.
4Que la evidencia técnica ha demostrado que una de las principales vías de diseminación de plagas es mediante el traslado de material de origen vegetal cuyo medio de transporte son los equipajes como: valijas, maletines, salveques, entre otros, empleados por las personas que ingresan o salen del país. Por lo tanto, en aras de proteger el patrimonio agrícola, se establece el escaneo de equipajes para disminuir el riesgo de introducción de nuevas plagas reglamentarias.
5Que es requisito de la entidad bancaria que realizará la recaudación del dinero, por el pago del servicio que se brinda de escaneo, que la normativa sea clara y que se estipule en la misma, que se refiere a entradas y salidas del país.
6Que es necesario la actualización de los costos de operación del sistema de inspección de equipaje, con el objetivo de mantener un sistema eficiente y eficaz.
7Que ante la poca claridad de la redacción de algunos ítems del artículo 2º del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 a La Gaceta Nº 68 del 9 de abril de 1999, correspondiente a la Fijación de Tarifas del Ministerio de Agricultura, se hace necesario realizar la modificación pertinente para una adecuada lectura del mismo. Por tanto,

Reforma al artículo 2º, incisos 5.c, 6.b, 6.c, y 17 del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 de La Gaceta Nº 68 del 9 de abril de 1999, correspondiente a la Fijación de Tarifas del Ministerio de Agricultura y Ganadería y Reforma al artículo 3º, del Decreto Ejecutivo Nº 35753-MAG, publicado en La Gaceta Nº 43 del 3 de marzo de 2010 denominado "Reforma a los artículos 2º, 6º y 8º del Decreto Ejecutivo Nº 27763- MAG del 10 de marzo de 1999, correspondiente a la fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería

Considerando:

Decretan:

6.c.1. Para los envíos en importaciones de granos que se descargarán a granel (ya sea en sacos o grano suelto) en medios de transporte marítimo se aplica únicamente lo dispuesto en el ítem 6.c, esta tarifa incluye los servicios de inspección, muestreo, exámenes de laboratorio (residuos y diagnóstico), y transmisión al TIC@

"Artículo 3º-Los servicios de escaneo por rayos X o inspección de equipajes, tendrán un costo de $2,00 por persona. Dicho cobro se realizará al ingreso o a la salida de las personas, según convenga a la administración."

Esta tarifa incluye los servicios de inspección, muestreo, exámenes de laboratorio (residuos y diagnóstico), y transmisión al TIC@.

Artículo 2 — Subsection 6.c.1 is hereby added to article 2 of Executive Decree No. 27763-MAG of March 10, 1999, published in Supplement No. 26 to La Gaceta No. 68 of April 9, 1999, to read as follows:

Artículo 3 — Article 3 of Executive Decree No.

Artículo 4 — Imports of rice shall be governed exclusively by the provisions of decree No.

Artículo 5 — For import shipments of bulk oranges for industry, a charge of ¢ 130.00 shall be collected for each metric ton of the shipment inspected. This tariff includes the services of inspection, sampling, laboratory tests (residues and diagnosis), and transmission to TIC@.

Artículo 6 — Shall take effect upon its publication.

Artículo 2 — Adiciónese al artículo 2º del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 a La Gaceta Nº 68 del 9 de abril de 1999, el inciso 6.c.1, que en lo consiguiente se lea así:

Artículo 3 — Modifíquese el artículo 3º del Decreto Ejecutivo Nº 35753 MAG, publicado en La Gaceta Nº 43 del 3 de marzo de 2010, para que se lea así:

Artículo 4 — Las importaciones de arroz se regirán exclusivamente por lo dispuesto en decreto Nº 29963-MAG y sus reformas para efectos de tarifas de competencia del Servicio Fitosanitario del Estado.

Artículo 5 — Para los envíos en importación de fruta de naranja a granel para industria se cobrará ¢ 130,00 por cada tonelada métrica del envío inspeccionado.

Artículo 6 — Rige a partir de su publicación.
