1. 1That through official letter CG-077-2010 dated 10/06/2010 issued by Lic. José Luis Hernández Vega, Manager of the Cooperative of Artisanal Fisheries Supplies of Puntarenas R.L., he requests the Board of Directors of INCOPESCA to review the administrative cost (operating cost) that the institution charges at the Fishing Terminal, mainly in the case of commercial fishing vessels that use the screened area to stock up on ice and diesel.
2. 2That by means of official letter CT-008-2010, the Tariff Commission presents to the Board of Directors a proposed tariff for the users of Coopeinpesa R.L., with the purpose of making the Fishing Terminal facilities available to them with all the improvements required by SENASA regarding the safety and traceability of hydrobiological products.
3. 3That in agreement AJDIP/293-2009 concerning the tariffs for the 2010 period, a specific tariff was omitted for the concept of "wharf usage for foreign-flag commercial fishing vessels."
4. 4That in the mentioned agreement, a tariff was not considered for the concept of wharf usage for vessels that may eventually arrive in our country to carry out scientific, stock enhancement, research, or educational activities. Similarly, a tariff was not contemplated for the concept of wharf usage for vessels that may eventually need to use the screened area of the Fishing Terminal to carry out activities other than the unloading of fishery products or victualling.
5. 5That it is necessary that persons who engage in sport fishing be able to obtain the respective license, and given that some sport organizations have expressed difficulty in paying the total amount established as a single annual fee to date, they have requested the Board of Directors of INCOPESCA the possibility that the license fee be differentiated by its term of validity. That on this matter, by means of Official Letter CT-009-2010, the Tariff Commission presented the proposal to the Board of Directors.
6. 6That due to the need to include some additional tariffs as well as modify others, for services provided by the institution, it is deemed necessary to contemplate them for the 2010 period. Therefore,

THEY AGREE:

1º-To approve the following tariffs and their incorporation into and validity with agreement AJDIP/293-2009, concerning the tariffs for the 2010 period:

Stay of national, non-tourism, non-sport commercial fishing vessels for victualling (ice and diesel at Coopeinpesa R. L.) (¢30.00 * meter of length overall * hour or fraction thereof) + ¢2,550.00. Coopeinpesa R. L.)

Stay and unloading of foreign commercial fishing vessels ($0.30 * meter of length overall * foreign hour or fraction thereof) + ¢5,100.00.

Stay of a vessel for scientific, research, educational, and stock enhancement purposes ¢180.00.

Stay of a national or foreign vessel for purposes other than the unloading of fishery products or victualling ¢180.00 National, Resident, or Foreign License for those practicing inland or marine fishing from a vessel (one calendar month) $11.50 2º-For those services provided at the Fishing Terminal that are subject to the length of stay of vessels or vehicles, the term fraction will be applied as follows: a) In those cases where the length of stay of the vessel or vehicle is less than or equal to thirty minutes (30 min or less), the equivalent of 30 minutes will be charged. b) In those cases where the length of stay of the vessel or vehicle is greater than thirty minutes or equal to 60 minutes (31 min or 60 min), the equivalent of 1 hour will be charged. c) For stays greater than one hour and a fraction, the concepts indicated in points a) and b) above will be applied.

3º-In the case of unloading carried out at the wharf of the Multiservice Fishing Terminal in Barrio El Carmen, Puntarenas, the institution will not charge for the inspection carried out during ordinary working hours to national-flag commercial fishing vessels that are neither tourism nor sport vessels; however, this does not apply to the case of foreign-flag commercial fishing vessels that are not tourism vessels, from which the inspection must be charged, whether during ordinary or extraordinary working hours. Ordinary working hours are understood to be Monday through Friday, from 8:00 a.m. to 4:00 p.m., except on public holidays and days off.

4º-In relation to the stay of vessels for scientific, research, educational, and stock enhancement purposes, by means of a reasoned and justified resolution, the Board of Directors may exempt such vessels from this charge, in those cases where the purpose involves a public benefit to the country or the institution and a Cooperation Agreement or accord is signed for that purpose.

5º-In the case of the stay of national or foreign vessels for purposes other than the unloading of fishery products or victualling, prior to the corresponding authorization, the institution must assess the specific nature of the type of activities required to be carried out, in order to determine possible negative effects on the ecosystems or on the activity of unloading hydrobiological products that is being or will be carried out in the area designated for that purpose, so as to ensure the safety and the priority of unloading for fishery purposes.

6º-One-month sport or tourism fishing licenses will be sold solely for the use of national, resident, or foreign tourists. Interested parties, tour operating companies, or associations may acquire, in a planned manner in advance, the quantity of licenses they deem appropriate to keep available for their clients, and on the understanding that INCOPESCA will issue such licenses with an issue date on the day they are acquired and an expiration date one calendar month later. Once the expiration period has elapsed without the licenses having been used by the users, they will expire automatically without the possibility of being revalidated, nor will any reimbursement of the amounts paid proceed.

Firm agreement. Let it be published. Effective as of December 3, 2010.

1. 1Que con oficio CG-077-2010 del 06/10/2010 emitido por el Lic. José Luis Hernández Vega, Gerente de la Cooperativa de Insumos Pesqueros Artesanales de Puntarenas R.L., solicita a la Junta Directiva del INCOPESCA la revisión del costo administrativo (costo operativo) que cobra la institución en la Terminal Pesquera, principalmente en el caso de las embarcaciones de pesca comercial que utilizan la pantalla para abastecerse de hielo y diesel.
2. 2Que mediante oficio CT-008-2010, la Comisión de Tarifas presenta a Junta Directiva una propuesta de tarifa para los usuarios de Coopeinpesa R.L., con el fin de poner a su disposición las instalaciones de la Terminal Pesquera con todas las mejoras exigidas por SENASA en materia de inocuidad y trazabilidad de los productos hidrobiológicos.
3. 3Que en el acuerdo AJDIP/293-2009 referente a las tarifas del periodo 2010, se omitió establecer una tarifa específica por concepto de "utilización de muelle para embarcaciones de pesca comercial de bandera extranjera".
4. 4Que en el acuerdo mencionado, no se consideró una tarifa por concepto de utilización del muelle para embarcaciones que eventualmente puedan llegar a nuestro país para realizar actividades científicas, de fomento, de investigación o con fines didácticos. De igual manera, no se contempló una tarifa por concepto de utilización del muelle para embarcaciones que eventualmente requieran utilizar la pantalla de la Terminal Pesquera para poder realizar otras actividades diferentes a la descarga de productos pesqueros o avituallamiento.
5. 5Que es necesario que las personas que ejecutan pesca deportiva, puedan adquirir el respectivo carne y siendo que algunas organizaciones deportivas han manifestado la dificultad de cancelar la suma que como monto único anual a la fecha esta establecida, han solicitado a la Junta Directiva del INCOPESCA, la posibilidad de que el cobro del carne sea diferenciado por su tiempo de vigencia. Que sobre este tema mediante Oficio CT-009-2010 la Comision de Tarifas presentó la propuesta a la Junta Directiva.
6. 6Que debido a la necesidad de incluir algunas tarifas adicionales así como modificar otras, por servicios que brinda la institución, se considera necesario contemplarlas para el periodo 2010. Por tanto,

ACUERDAN:

1º-Aprobar las siguientes tarifas y su incorporación y vigencia al acuerdo AJDIP/293-2009, referente a las tarifas del período 2010:

Estadía de embarcaciones de pesca comercial nacional, no turística ni deportiva para avituallamiento (hielo y diesel en Coopeinpesa R. L.) (¢30.00 * metro eslora * hora o fracción) + ¢2550,00. Coopeinpesa R. L.)

Estadía y descarga de embarcaciones de pesca comercial extranjeras ($0.30 * metro eslora * extranjeras hora o fracción) + ¢5100,00.

Estadía embarcación con fines científicos, de investigación, didácticos y de fomento ¢180,00.

Estadía embarcación nacional o extranjera para fines distintos a la descarga de productos pesqueros o avituallamiento ¢180,00 Carné Nacional, Residente o Extranjero que practica pesca continental o marina desde embarcación (un mes calendario) $11.50 2º-Aquellos servicios que se brindan en la Terminal Pesquera y que están supeditados a los tiempos de permanencia de las embarcaciones o los vehículos, se aplicará el término fracción de la siguiente manera: a) En aquellos casos en que el tiempo de permanencia de la embarcación o vehículo es igual o menor a treinta minutos (30 min o menos), se cobrará el equivalente a 30 minutos. b) En aquellos casos en que el tiempo de permanencia de la embarcación o vehículo es mayor a treinta minutos o igual a 60 minutos (31 min o 60 min), se cobrará el equivalente a 1 hora. c) Para permanencias mayores a una hora y fracción, se aplicarán los conceptos indicados en los puntos a) y b) anteriores.

3º-En el caso de las descargas que se realicen en el muelle de la Terminal Multiservicios Pesqueros del Barrio El Carmen, Puntarenas, la institución no cobrará por la inspección que se efectúe durante la jornada ordinaria, a las embarcaciones de pesca comercial de bandera nacional no turística ni deportiva, no así en el caso de las embarcaciones de pesca comercial de bandera extranjera no turística a las que sí se les deberá cobrar la inspección, sea en jornada ordinaria o extraordinaria. Entiéndase por jornada ordinaria de lunes a viernes, de las 8:00 a.m. a las 4:00 p.m., excepto días feriados y asuetos.

4º-En relación con la estadía de las embarcaciones con fines científicos, de investigación, didácticos y de fomento, mediante acuerdo razonado y justificado, la Junta Directiva podrá eximir de este cobro, en aquellos casos en que exista un fin de beneficio público al país o a la institución y se suscriba un Convenio o acuerdo al efecto.

5º-En el caso de la estadía de las embarcaciones nacionales o extranjeras para fines distintos a la descarga de productos pesqueros o avituallamiento las embarcaciones, previo a la autorización correspondiente, la institución debe valorar la naturaleza propia del tipo de actividades que se requieren realizar, a fin de determinar posibles efectos negativos sobre los ecosistemas o sobre la actividad de descarga de productos hidrobiológicos que se realicen o se vayan a realizar en el área destinada para ese propósito, de manera que se asegure la inocuidad y la prioridad de descarga para fines pesqueros.

6º-Los carné para pesca deportiva o turística de un mes serán vendidos únicamente para uso de los turistas nacionales, residentes o extranjeros. Los interesados, las empresas operadoras de tours o las asociaciones, podrán adquirir de manera previa y planificada, la cantidad de carné que consideren conveniente mantener a disposición de sus clientes y en el entendido de que dichos carné INCOPESCA los otorgará con fecha de emisión al día en que son adquiridos y con fecha de vencimiento a un mes calendario. Cumplido el plazo de vencimiento sin que hubiesen sido utilizados por los usuarios, estos caducarán de pleno derecho sin que puedan ser revalidados, ni procederá reintegro alguno de los montos pagados.

Acuerdo firme. Publíquese. Rige a partir del 3 de diciembre de 2010.
