On the Atlantic Coast, those known as boats will be classified as small-scale artisanal fleet, that is, those built from a single piece and with an outboard engine.

2 As for the licenses for national and foreign captains and crew members of sport or tourist fishing or cetacean observation vessels, these shall be annual. For their issuance, they must present a copy of their identification document and a passport-sized photograph. Foreign captains in tourist condition shall be prohibited from working as such on tourist fishing vessels flying the national flag.

Licenses for one-year sport or tourist fishing shall be sold only for the use of national, resident, or foreign tourists. The use of these licenses shall be totally prohibited for working as a captain or crew member of sport or tourist fishing vessels. Interested parties, tour operating companies, or associations may acquire, in a prearranged and planned manner, the number of licenses they deem appropriate to keep available for their clients, with the understanding that INCOPESCA shall issue said licenses with the date of issuance on the day they are acquired and with the expiration date one calendar year later. Once the expiration period has lapsed without them having been used by the users, these shall fully expire by law without the possibility of being revalidated, nor shall any refund of the amounts paid proceed. For the purposes indicated in this section, INCOPESCA may enter into agreements with tour operators to improve the provision of services and the generation of resources from the sale thereof, in compliance with the legal provisions in force on the matter.

4 The permit holders or shipowners in whose name commercial fishing licenses are granted shall not be obligated to pay the corresponding item for the license established in Article 44 of the Ley de Pesca y Acuicultura, Ley N° 8436, given that their status is accredited in the corresponding fishing license.

5 For inspections, the ordinary fee corresponds to those carried out during the Institute's regular working hours, that is, from 8:00 a.m. to 4:00 p.m. The extraordinary fee corresponds to inspections carried out from 4:01 p.m. to 7:59 a.m., as well as those made on holidays, Saturdays, Sundays, or days off.

6 In the case of unloading carried out at the dock of the Terminal Multiservicios Pesqueros in Barrio El Carmen, Puntarenas, the institution shall not charge for the inspection performed during the ordinary working day for national-flagged commercial, non-tourist, non-sport fishing vessels; this is not the case for foreign-flagged commercial, non-tourist fishing vessels, which must be charged for the inspection, whether during the ordinary or extraordinary working day. Ordinary working day is understood as Monday through Friday, from 8:00 a.m. to 4:00 p.m., except holidays and days off.

7 In those cases where, at the interested party's request, INCOPESCA has carried out the procedures for the designation of the inspector and the latter appeared at the established place, time, and date, and the interested party decides to postpone the unloading, one hour of inspection shall be charged, according to whether it is during regular working hours or overtime. Once the suspended inspection has been rescheduled, the corresponding administrative costs must be charged again.

8 Regarding the stay of vessels for scientific, research, didactic, and development purposes, by reasoned and justified agreement, the Board of Directors may exempt this charge in those cases where there is a purpose of public benefit to the country or the institution and an Agreement or understanding to that effect is signed.

9 In the case of the stay of national or foreign vessels for purposes other than the unloading of fishery products or provisioning of vessels, prior to the corresponding authorization, the institution must assess the nature of the type of activities required to be carried out, to determine possible negative effects on ecosystems or on the unloading activity of hydrobiological products that are carried out or will be carried out in the area designated for that purpose, so as to ensure safety and priority of unloading for fishing purposes.

10 Every inspection must be paid for in advance or no later than the business day following its performance by the Institute's officials, whether by bank deposit or electronic transfer to one of INCOPESCA's bank accounts or by direct payment at one of the institute's offices. If the payment is made by deposit or transfer, the user must deliver a copy of the respective bank receipt to the nearest office. The institution is not authorized to grant credit for this service; therefore, all services provided by INCOPESCA shall be suspended for the user who does not comply with the established provision, and they must pay daily interest at the basic passive rate established by the Central Bank.

11 The user of the water service, stay and docking service, and electricity supply via generator shall pay for the services received before undocking the vessel or no later than 30 calendar days after receiving the services, provided they have credit previously authorized by INCOPESCA. If they do not have credit, they must pay for the services before undocking the vessel.

12 Vehicles entering to load and unload products shall pay for the hours of stay before leaving the designated dock area.

13 For those services provided at the Fishing Terminal subject to the stay times of vessels or vehicles, the term fraction shall be applied as follows: a) When the stay time of the vessel or vehicle is equal to or less than thirty minutes (30 min or less), the equivalent of 30 minutes shall be charged. b) If the stay time of the vessel or vehicle is greater than thirty minutes or equal to 60 minutes (31 min to 60 min), the equivalent of 1 hour shall be charged. c) For stays of more than one hour and a fraction, the concepts indicated in points a) and b) above shall be applied.

14 The money collected from the charged fees shall be deposited and entered into the bank accounts INCOPESCA holds in the banks of the National Banking System. In the event that payments for goods or services are made directly by the user from a banking entity or by electronic means, the obtaining of the service shall be subject to the presentation of the respective bank receipt at the corresponding regional INCOPESCA office, so that the payment invoice may be issued.

15 The established fees shall be subject to review and adjustment when appropriate, by INCOPESCA. Licenses not paid for in the corresponding period must be paid at the fee in force at the time the application is made before the institution.

En el Litoral Atlántico, serán catalogadas como flota artesanal pequeña escala, las conocidas como botes, es decir, aquellas construidas de una sola pieza y con motor fuera de borda.

2 En cuanto a los carné para capitanes y tripulantes nacionales o extranjeros de embarcaciones de pesca deportiva o turística o de observación de cetáceos, estos serán anuales. Para su otorgamiento deberán presentar copia del documento de identificación y una fotografía tamaño pasaporte. A los capitanes extranjeros en condición de turista, les estará prohibido el ejercicio como tal en embarcaciones de pesca turística de bandera nacional.

Los carné para pesca deportiva o turística de un año serán vendidos únicamente para uso de los turistas nacionales, residentes o extranjeros. El uso de estos carné estará totalmente prohibido para ejercer como capitán o tripulantes de embarcaciones de pesca deportiva o turística. Los interesados, las empresas operadoras de tours o las asociaciones, podrán adquirir de manera previa y planificada, la cantidad de carnés que consideren conveniente mantener a disposición de sus clientes y en el entendido de que dichos carnés INCOPESCA los otorgará con fecha de emisión al día en que son adquiridos y con fecha de vencimiento a un año calendario. Cumplido el plazo de vencimiento sin que hubiesen sido utilizados por los usuarios, estos caducarán de pleno derecho sin que puedan ser revalidados, ni procederá reintegro alguno de los montos pagados. Para los fines indicados en este aparte, el INCOPESCA podrá suscribir convenios con los tour operadores para mejor la prestación de los servicios y la generación de recursos por la venta de los mismos; cumpliendo con las disposiciones legales vigentes en la materia.

4 Los permisionarios o armadores a nombre de quienes estén otorgadas las licencias de pesca comercial no estarán obligados a cancelar el rubro correspondiente por concepto del carné establecido en el artículo 44 de la Ley de Pesca y Acuicultura, Ley N° 8436, en razón de tenerse por acreditada su condición en la licencia de pesca correspondiente.

5 Para las inspecciones la tarifa ordinaria corresponde a las realizadas dentro del horario ordinario de trabajo del Instituto, sea de las 8:00 a. m. a las 4:00 p. m. La tarifa extraordinaria corresponde a las inspecciones realizadas de 4:01 p. m. a 7:59 a. m. así como las efectuadas en días feriados, sábados, domingos o asuetos.

6 En el caso de las descargas que se realicen en el muelle de la Terminal Multiservicios Pesqueros del Barrio El Carmen, Puntarenas, la institución no cobrará por la inspección que se efectúe durante la jornada ordinaria, a las embarcaciones de pesca comercial de bandera nacional no turística ni deportiva, no así en el caso de las embarcaciones de pesca comercial de bandera extranjera no turística, a las que sí se les deberá cobrar la inspección, sea en jornada ordinaria o extraordinaria. Entiéndase por jornada ordinaria de lunes a viernes, de las 8:00 a. m. a las 4:00 p. m., excepto días feriados y asuetos.

7 En aquellos casos en que a solicitud del interesado, el INCOPESCA ha realizado las gestiones para la designación del inspector y este se hiciera presente en el lugar, hora y fecha establecidos, y el interesado decide posponer la descarga se cobrará un hora de inspección, según sea en horario ordinario o extraordinario. Una vez reprogramada la inspección que fue suspendida, se deberán cobrar nuevamente los costos administrativos correspondientes.

8 En relación con la estadía de las embarcaciones con fines científicos, de investigación, didácticos y de fomento, mediante acuerdo razonado y justificado, la Junta Directiva podrá eximir de este cobro, en aquellos casos en que exista un fin de beneficio público al país o a la institución y se suscriba un Convenio o acuerdo al efecto.

9 En el caso de la estadía de las embarcaciones nacionales o extranjeras para fines distintos a la descarga de productos pesqueros o avituallamiento a las embarcaciones, previo a la autorización correspondiente, la institución debe valorar la naturaleza propia del tipo de actividades que se requieren realizar, a fin de determinar posibles efectos negativos sobre los ecosistemas o sobre la actividad de descarga de productos hidrobiológicos que se realicen o se vayan a realizar en el área destinada para ese propósito, de manera que se asegure la inocuidad y la prioridad de descarga para fines pesqueros.

10 Toda inspección deberá ser cancelada previamente o a más tardar el día hábil siguiente a que es realizada por los funcionarios del Instituto, sea mediante depósito bancario o transferencia electrónica a una de las cuentas bancarias de INCOPESCA o mediante el pago directo en una de las oficinas del instituto. Si el pago se realiza por depósito o transferencia, el usuario deberá entregar copia del respectivo comprobante bancario a la oficina más cercana. La institución no está autorizada para conceder crédito por este servicio, por lo tanto, al usuario que no atienda la disposición establecida se le suspenderán todos los servicios que brinda el INCOPESCA y deberá pagar intereses diarios a la tasa básica pasiva establecida por el Banco Central.

11 El usuario del servicio de agua, servicio de estadía y muellaje y suministro de electricidad con generador, cancelarán los servicios recibidos antes de desatracar la embarcación o a más tardar 30 días naturales posteriores a recibir los servicios, siempre y cuando cuente con crédito autorizado previamente por el INCOPESCA. En caso de no contar con crédito, deberá pagar los servicios antes de desatracar la embarcación.

12 Los vehículos que ingresen a cargar y descargar productos cancelarán las horas de permanencia antes de salir del área delimitada de muelle.

13 En aquellos servicios que se brindan en la Terminal Pesquera y que están supeditados a los tiempos de permanencia de las embarcaciones o los vehículos, se aplicará el término fracción de la siguiente manera: a) Cuando el tiempo de permanencia de la embarcación o vehículo es igual o menor a treinta minutos (30 min o menos), se cobrará el equivalente a 30 minutos. b) Si el tiempo de permanencia de la embarcación o vehículo es mayor a treinta minutos o igual a 60 minutos (31 min o 60 min), se cobrará el equivalente a 1 hora. c) Para permanencias mayores a una hora y fracción, se aplicarán los conceptos indicados en los puntos a) y b) anteriores.

14 El dinero recaudado por las tarifas cobradas será depositado e ingresado en las cuentas bancarias que el INCOPESCA tenga en los bancos del Sistema Bancario Nacional. En el caso de que los pagos por bienes o servicios sean realizados directamente por el usuario desde una entidad bancaria o por medio electrónico, la obtención del servicio estará sujeta a la presentación del respectivo comprobante bancario ante la oficina regional del INCOPESCA correspondiente, a fin de que se emita la factura de pago.

15 Las tarifas establecidas estarán sujetas a revisión y ajuste cuando ello fuere procedente, por parte del INCOPESCA. Las licencias que no sean pagadas en el periodo correspondiente, deberán ser canceladas con la tarifa vigente al momento de realizar el trámite ante la institución.
