THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred upon them by articles 140, subsections 3) and 18) and 180 of the Political Constitution, articles 25 subsection 1), 27 subsection 1), 28 paragraph 2), subsection b), of Law No. 6227 of May 2, 1978, which is the General Law of Public Administration, and Law No. 8488 of November 22, 2005, which is the National Law on Emergencies and Risk Prevention.

I.-That by Executive Decree No. 36252-MP, of November 4, 2010, a national emergency state is declared for the situation caused by storm conditions and the passage of a low-pressure system associated with the indirect effects of tropical storm Tomás, in the Central, North, South Pacific, Central Valley and Los Santos Zone, which generated abundant rainfall, flooding, and landslides (deslizamientos) in different cantons of the Provinces of Alajuela, Cartago, Guanacaste, Puntarenas, and San José.

II.-That this Executive Decree did not include some cantons of the Provinces of Alajuela, Cartago, Guanacaste, and Puntarenas that also suffered flooding, landslides (deslizamientos), and damage to property and persons, making it necessary to amend article 1 of Executive Decree 36252-MP, of November 4, 2010. Therefore, They Decree:

AMENDMENT OF ARTICLE 1 OF EXECUTIVE DECREE 36252-MP OF NOVEMBER 4, 2010

Considering:

Además establece que para la atención de las necesidades de vivienda pendientes, aprobadas en el Plan General de la Emergencia, el Banco Hipotecario de la Vivienda (BANHVI), el Ministerio de Vivienda y Asentamientos Humanos (MIVAH) y las entidades autorizadas del Sistema Financiero Nacional para la Vivienda contarán con un plazo de doce meses a partir de la vigencia del presente Decreto para la ejecución de la mayor cantidad de soluciones habitacionales posibles. Para los restantes sectores involucrados en el Plan General de la Emergencia el cese del estado de emergencia regirá a partir de la vigencia del presente Decreto. Vencido el plazo de doce meses la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias deberá solicitar la derogatoria definitiva del Decreto de Emergencia.)

LA PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE LA PRESIDENCIA En ejercicio de las facultades que les confieren los artículos 140, incisos 3) y 18) y 180 de la Constitución Política, artículos 25 inciso 1), 27 inciso 1), 28 párrafo 2), inciso b), de la Ley N° 6227 del 2 de mayo de 1978 que es Ley General de la Administración Pública, y la Ley N° 8488 del 22 de noviembre del 2005, que es la Ley Nacional de Emergencias y Prevención de Riesgo.

I.-Que mediante Decreto Ejecutivo N° 36252-MP, del 4 de noviembre del 2010, se declara estado de emergencia nacional la situación provocada por condiciones de temporal y paso de un sistema de baja presión asociado a los efectos indirectos de la tormenta tropical Tomás, en el Pacífico Central, Norte, Sur, Valle Central y Zona de Los Santos, que generó abundantes lluvias, inundaciones y deslizamientos en diferentes cantones de las Provincias de Alajuela, Cartago, Guanacaste, Puntarenas y San José.

II.-Que en este Decreto Ejecutivo no se incluyeron algunos cantones de las Provincias de Alajuela, Cartago, Guanacaste, y Puntarenas que sufrieron también inundaciones, deslizamientos y daños a los bienes y a las personas, por lo que se hace necesario modificar el artículo 1° del Decreto Ejecutivo 36252-MP, del 4 de noviembre del 2010. Por tanto,

Considerando:
