in the entirety of the text - Complete Text of Regulation 36221 Declares a state of national emergency the situation caused by the extreme hydrometeorological conditions that have affected the National territory, in the agricultural and livestock sectors Complete Text record: D4A8D No. 36221-MP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred by articles 140, subsections 3) and 18), 146 and 180 of the Political Constitution, article 25 subsection 1), Emergency Response and Risk Prevention of Law No. 6227 of May 2, 1978, which is the General Law of Public Administration, and Law No. 8488 of January 11, 2006, which is the National Law of Emergencies and Risk Prevention, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural and Livestock Production (FODEA) and Organic Law of the MAG;

I.-That since the month of August of the current year, the country has been affected by various extraordinary events generated by adverse meteorological conditions that have generated abundant rains throughout the national territory and have caused flooding in populations and crops.

II.-That additionally, since the 20th of September of the current year, very strong and extraordinary rainy conditions have occurred caused by the storm affecting the Central, North, and South Pacific, and the Central Valley, with generalized effects throughout the entire national territory when associated with storm Nicole in the Caribbean Sea, characterized by rains of variable intensity related to low-pressure systems over Central America and the positioning of the Intertropical Convergence Zone (confluence of southwest and northwest winds).

III.-That all these adverse climatological conditions have caused serious and substantial damage throughout the agricultural and livestock sector, mainly in the agricultural and livestock zones, due to the excess of constant rains, as recorded in the reports submitted to the Ministry of Agriculture and Livestock, which has caused a situation of public calamity caused by acts of nature that are beyond the control of the institutions and the affected citizens, since it exceeds their ordinary capacity for reaction, as these are situations that are unforeseeable or foreseeable but inevitable, which cannot be controlled by the ordinary powers available to the Government.

IV.-That the National Meteorological Institute has warned that during the months of October and November of this year, the adverse weather conditions may increase, further affecting the populations, livestock, and crop areas that are already heavily affected, given that the soils are saturated and therefore surface runoff increases and the threat of floods and landslides grows.

V.-That the National Commission for Risk Prevention and Emergency Response has maintained since August 30 of this year a permanent green alert state in the Central Valley, Pacific, and Northern Zone of the country and a yellow alert in different zones of the territory in response to specific events that have occurred constantly, activating the existing response and prevention systems.

VI.-That the life and health of the population, as well as their property, must be protected or safeguarded by the State, which must ensure their protection and the security of the inhabitants and, in general, the conservation of social order.

VII.-That the National Law of Emergencies and Risk Prevention provides that in the event of public calamity caused by acts of nature or of man that are unforeseeable or foreseeable but inevitable and cannot be controlled, managed, or dominated with the ordinary powers available to the Government, the Executive Branch may declare a national emergency in order to integrate and define the responsibilities and functions of all organizations, public and private entities, and to be able to provide a solution commensurate with the magnitude of the disaster.

VIII.-That by reason of the foregoing, the enactment of a legal framework is necessary to take the exceptional measures indicated by the Political Constitution and the National Law of Emergencies and Risk Prevention, to confront the effects caused by these hydrometeorological phenomena and mitigate the consequences caused by their impact on the different zones of the country. Therefore, THEY DECREE:

Considering:

en la totalidad del texto - Texto Completo Norma 36221 Declara estado de emergencia nacional la situación provocada por las condiciones hidrometereológicas extremas que han afectado el territorio Nacional, en los sectores agrícola y pecuario Texto Completo acta: D4A8D N° 36221-MP LA PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE LA PRESIDENCIA En ejercicio de las facultades que les confieren los artículos 140, incisos 3) y 18), 146 y 180 de la Constitución Política, artículo 25 inciso 1), Atención de Emergencias y Prevención del Riesgo de la Ley N° 6227 del 2 de mayo de 1978 que es Ley General de la Administración Pública, y la Ley N° 8488 del 11 de enero del 2006, que es la Ley Nacional de Emergencias y Prevención del Riesgo, la Ley N° 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria (FODEA) y Orgánica del MAG;

I.-Que desde el mes de agosto del año en curso el país se ha visto afectado por diversos eventos de carácter extraordinario generados por condiciones meteorológicas adversas que han generado abundantes lluvias en todo el territorio nacional y han provocado inundaciones en poblaciones y cultivos.

II.-Que adicionalmente, desde el día 20 de setiembre del año en curso, se han presentado condiciones lluviosas muy fuertes y extraordinarias ocasionadas por el temporal que afecta el Pacífico Central, Norte y Sur, y el Valle Central, con afectación general en todo el territorio nacional al asociarse con la tormenta Nicole en el Mar Caribe, caracterizadas por lluvias de variable intensidad relacionadas a sistemas de baja presión sobre Centroamérica y al posicionamiento de la zona de convergencia intertropical (confluencia de vientos del suroeste u noroeste).

III.-Que todas estas condiciones adversas de carácter climatológico han provocado serios y cuantiosos daños en todo el sector agropecuario, principalmente en las zonas agrícolas y pecuarias, por el exceso de lluvias constantes, según consta en los reportes planteados ante el Ministerio de Agricultura y Ganadería, lo que ha ocasionado una situación de calamidad pública provocada por hechos de la naturaleza que están fuera del control de las instituciones y los administrados afectados, ya que excede su capacidad ordinaria de reacción, por tratarse de situaciones imprevisibles o previsible pero inevitables, que no pueden ser controladas por las potestades ordinarias de que dispone el Gobierno.

IV.-Que el Instituto Meteorológico Nacional ha advertido que durante los meses de octubre y noviembre del presente año las condiciones adversas del clima se pueden incrementar afectando aún más a las poblaciones, ganado y áreas de cultivos que ya están muy afectados, dado que los suelos están saturados y por ello aumenta la escorrentía superficial y se incrementa la amenaza de inundaciones y deslizamientos.

V.-Que la Comisión Nacional de Prevención del Riesgo y Atención de Emergencias mantiene desde el 30 de agosto del presente año un estado de alerta verde permanente en el Valle Central, Pacífico y Zona Norte del país y alerta amarilla en diferentes zonas del territorio ante eventos puntuales que se han presentado en forma constante, activando los sistemas de atención y prevención existentes.

VI.-Que la vida y salud de la población, así como sus bienes, deben ser protegidos o tutelados por el Estado, quien debe velar por su protección y por la seguridad de los habitantes y en general por la conservación del orden social.

VII.-Que la Ley Nacional de Emergencias y Prevención del Riesgo dispone que en caso de calamidad pública ocasionada por hechos de la naturaleza o del hombre que son imprevisibles o previsibles pero inevitables y no puedan ser controlados, manejados ni dominados con las potestades ordinarias de que dispone el Gobierno, el Poder Ejecutivo podrá declarar emergencia nacional a fin de integrar y definir las responsabilidades y funciones de todos los organismos, entidades públicas, privadas y poder brindar una solución acorde a la magnitud del desastre.

VIII.-Que en razón de lo expuesto se hace necesaria la promulgación de un marco jurídico para tomar las medidas de excepción que señala la Constitución Política y la Ley Nacional de Emergencias y Prevención del Riesgo, para hacerle frente a los efectos ocasionados por estos fenómenos hidrometeorológico y mitigar las consecuencias que ocasionó su impacto en las diferentes zonas del país. Por tanto,
