1That Article 50 of the Political Constitution provides that it is the obligation of the State to procure the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.
2That Article 56 of the Political Constitution establishes that the State must guarantee dignified, honest, and useful work for society.
3That the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), Law No. 7384, establishes as a function of this state public entity, to regulate the rational use of fishery resources to achieve greater economic yields, and the protection and conservation of marine and aquaculture species.
4That it is the responsibility of INCOPESCA, as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources that allow for the protection of reproduction, recruitment, and feeding areas; that favor the increase of species and the growth of their biomass, in a manner that guarantees their sustainability for the benefit of the ecosystems and the fishers.
5That the FAO Code of Conduct for Responsible Fisheries, Executive Decree No. 27919-MAG, recognizes in its Article 6, the important contribution of small-scale artisanal fishing to the generation of employment, income, and food security. Hence the need for the State to appropriately guarantee the right of fishers, adopting regulatory measures that favor the use of fishery resources in waters under national jurisdiction.
6That scientific studies are available through which it has been demonstrated that the regulation of fishing gear and methods, as well as fishing effort in certain strategic areas, contribute to the increase of biomass and species populations.
7That the measures indicated in the preceding considering also represent a viable alternative that enables the generation of economic, social, and environmental benefits for fishing communities and for the ecosystems on which fishers depend for fishing.
8That the Board of Directors of INCOPESCA approved, through Agreement No. 138-2008 A.J.D.I.P., dated April 4, 2008, the "Regulation for the establishment of Marine Areas for Responsible Fishing."
9That the Executive Presidency of INCOPESCA, through Official Letter No. PESJ-315-08-2009, dated August 10, 2009, informed the six artisanal fishing organizations and the Costa Rican Association of Sport Fishing that carry out their activity in the Golfo Dulce, that the Board of Directors of INCOPESCA, through a unanimous and firm agreement, in its session of Friday, August 7, 2009, approved the process that ultimately allows for the official declaration establishing the Marine Area for Responsible Fishing of the Golfo Dulce.

10.-That in accordance with the provisions of Article 2 of the "Regulation for the establishment of Marine Areas for Responsible Fishing," through a Resolution dated July 30, 2009, the Executive Presidency of INCOPESCA created a Working Group, with the purpose of formulating and presenting to the Board of Directors the Fisheries Management Plan (Plan de Ordenamiento Pesquero) as a prerequisite for approving the establishment of the Marine Area for Responsible Fishing of the Golfo Dulce.

11.-That the Working Group has fulfilled the formalities established by Regulation No. 138-2008 and, in the Session of the Board of Directors of June 11, 2010, presented the "Proposal for a Fisheries Management Plan for the establishment of the Marine Area for Responsible Fishing of the Golfo Dulce." 12.-That the Executive Branch, through Executive Decree No. 35502-MAG, published in the Official Gazette "La Gaceta," No. 191, of October 1, 2009, in its article 15, declares the establishment of Marine Areas for Responsible Fishing to be of national public interest.

en la totalidad del texto - Texto Completo Norma 191 Declara el Golfo Dulce como área marina para la Pesca Responsable Texto Completo acta: D3852 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA A.J.D.I.P. 191-2010.-Puntarenas, a los once días del mes de junio del dos mil diez.

1Que el Artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.
2Que el Artículo 56 de la Constitución Política establece que el Estado debe garantizar el trabajo digno, honesto y útil para la sociedad.
3Que la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), Ley N° 7384, establece como función de este ente público estatal, normar el aprovechamiento racional de los recursos pesqueros para lograr mayores rendimientos económicos, la protección y conservación de las especies marinas y acuícolas.
4Que corresponde al INCOPESCA como Institución Rectora del sector pesquero y acuícola de nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos que permitan proteger áreas de reproducción, reclutamiento y de alimentación; que favorezcan el incremento de las especies y el aumento de su biomasa, de manera que se garantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.
5Que el Código de Conducta para la Pesca Responsable de la FAO, Decreto Ejecutivo N° 27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional.
6Que se cuenta con estudios científicos mediante los cuales se ha logrado demostrar que la regulación de las artes y métodos de pesca, así como el esfuerzo pesquero en determinadas áreas estratégicas, contribuyen al aumento de la biomasa y de las poblaciones de especies.
7Que las medidas señaladas en el considerando anterior, representan también una alternativa viable que posibilite la generación de beneficios económicos, sociales y ambientales para las comunidades pesqueras y para los ecosistemas, de los que los pescadores dependen para la pesca.
8Que la Junta Directiva del INCOPESCA aprobó mediante Acuerdo N° 138-2008 A.J.D.I.P., de fecha 04 de abril del 2008, el "Reglamento para el establecimiento de las Áreas Marinas para la Pesca Responsable".
9Que la Presidencia Ejecutiva del INCOPESCA mediante Oficio Nª PESJ-315-08-2009, de fecha 10 de agosto del 2009, informó a las seis organizaciones de pesca artesanal y la Asociación Costarricense de Pesca Turística que desarrollan su actividad en el Golfo Dulce, que la Junta Directiva del INCOPESCA mediante acuerdo unánime y firme, en su sesión del viernes 07 de agosto del 2009, aprobó el proceso que permita en definitiva la declaratoria oficial que establezca el Área Marina de Pesca Responsable del Golfo Dulce.

10.-Que de conformidad con lo que establece el Artículo 2 del "Reglamento para el establecimiento de las Áreas Marinas Para la Pesca Responsable", mediante Resolución de fecha 30 de Julio del 2009, la Presidencia Ejecutiva del INCOPESCA creó un Grupo de Trabajo, con el fin de formular y presentar ante la Junta Directiva el Plan de Ordenamiento Pesquero como requisito previo para aprobar el establecimiento del Área Marina para la Pesca Responsable del Golfo Dulce.

11.-Que el Grupo de Trabajo ha cumplido con las formalidades que establece el Reglamento N° 138-2008 y en la Sesión de Junta Directiva, del 11 de junio del 2010, presentó la "Propuesta de Plan de Ordenamiento Pesquero para el establecimiento del Área Marina para la Pesca Responsable del Golfo Dulce".

12.-Que el Poder Ejecutivo mediante Decreto Ejecutivo Nº 35502-MAG, publicado en el Diario Oficial "La Gaceta", Nº 191, del 01 de octubre del 2009, en su artículo 15, declara de interés público nacional el establecimiento de las Áreas Marinas para la Pesca Responsable.

Artículo 1 — To approve the establishment of the Marine Area for Responsible Fishing of the Golfo Dulce, in accordance with the provisions of Regulation A.J.D.I.P 138-2008 and Executive Decree No. 35502-MAG, published in the Official Gazette La Gaceta, No. 191 of October 1, 2009.

Artículo 2 — To approve, in accordance with the provisions of Regulation 138-2008 A.J.D.I.P., dated April 4, 2008, the proposal for the "Fisheries Management Plan for the establishment of the Marine Area for Responsible Fishing of the Golfo Dulce."

Artículo 6 — Any breach of the established fishing regulations shall be sanctioned in accordance with the provisions of the current legal system.

Artículo 8 — Firm agreement.

Artículo 1 — Aprobar el establecimiento del Área Marina para la Pesca Responsable del Golfo Dulce, conforme a lo establecido en el Reglamento A.J.D.I.P 138-2008 y el Decreto Ejecutivo Nº 35502-MAG, publicado en el Diario Oficial La Gaceta, Nº 191 del 01 de octubre del 2009.

Artículo 2 — Aprobar de conformidad con lo que establece el Reglamento 138-2008 A.J.D.I.P., de fecha 04 de abril del 2008, la propuesta del "Plan de Ordenamiento Pesquero para el establecimiento del Área Marina para la Pesca Responsable del Golfo Dulce".

Artículo 6 — Cualquier incumplimiento a las normas pesqueras establecidas será sancionado de conformidad con lo que señala el ordenamiento jurídico vigente.

Artículo 8 — Acuerdo firme.
