in the entirety of the text - Complete Text of Norm 36121 Declares of Public Utility for the interests of the State the Administrative Association of the Potable Water and Sanitary Sewer System of Mora de Turrialba Complete Text record: 152BBE No. 36121-J (This executive decree was rendered without effect by Article 1 of executive decree No. 43662 of July 5, 2022) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations, and Articles 27 and following of its Regulation.

I.-That Article 32 of the Law of Associations number 218 of August 8, nineteen thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.

II.-That the Administrative Association of the Potable Water and Sanitary Sewer System of Mora de Turrialba, legal ID number 3-002-292665, was registered in the Associations Registry of the Public Registry on May 9, two thousand one, under file No. 13168, volume No. 2009, consecutive one of the mechanized system, Mercantile Section of the Public Registry.

III.-That the purposes pursued by the Association, according to Article Three of its bylaws, and the modification dated September 30, two thousand six, are: "... A) To administer, operate, maintain, develop, and conserve in good condition the aqueduct and sanitary sewer system, in accordance with the provisions and Regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers, which shall be mandatory. B) To obtain the effective participation of the community in the construction, operation, maintenance, and development of the aqueduct. C) Collaboration in educational programs and campaigns that are undertaken. D) To help explain and disseminate in the community the provisions and regulations of Aqueducts and Sewers. E) To cooperate with the plans, projects, and works undertaken by Aqueducts and Sewers in the community. F) To participate in matters relating to the administration, conservation, and rational exploitation of waters, control of their pollution or alteration, definition of the measures and actions necessary for the protection of watersheds (cuencas hidrográficas) and ecological stability. G) To ensure that all systems and their aqueduct or sanitary sewer installations comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, rationalization of expenses, etc. H) To provide services in an efficient, equitable, and timely manner to all its users, without distinctions of any nature..." IV.-That such purposes solve a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore,

I.-Que el artículo 32 de la Ley de Asociaciones número 218 del ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.-Que la Asociación Administradora del Acueducto Potable y Alcantarillado Sanitario del Mora de Turrialba, cédula jurídica número 3-002-292665 se inscribió en el Registro de Asociaciones del Registro Público desde el día nueve de mayo de dos mil uno, bajo el expediente N° 13168, tomo N° 2009, consecutivo uno del sistema mecanizado, Sección Mercantil del Registro Público.

III.-Que los fines que persigue la Asociación, según el artículo tercero de sus estatutos, y la modificación de fecha treinta de setiembre de dos mil seis son: "... A) Administrar, operar, dar mantenimiento, desarrollar y conservar en buenas condiciones el acueducto y alcantarillado sanitario, de conformidad con las disposiciones y Reglamentos que al respecto emita el Instituto Costarricense de Acueductos y Alcantarillados, que serán de acatamiento obligatorio. B) Obtener la participación efectiva de la comunidad en la construcción, operación y mantenimiento y desarrollo del acueducto. C) Colaboración en los programas y campañas de índole educativa que se emprendan. D) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos de Acueductos y Alcantarillados. E) Cooperar con los planes, proyectos y obras que emprenda Acueductos y Alcantarillados en la comunidad. F) Participar en asuntos relativos a la administración, conservación y explotación racional de las aguas, control de su contaminación o alteración, definición de las medidas y acciones necesarias para la protección de las cuencas hidrográficas y la estabilidad ecológica. G) Velar porque todos los sistemas sus instalaciones de acueducto o alcantarillado sanitario cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc. H) Otorgar los servicios en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza.."'. IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
